The addition is less than 10% of the permitted square footage. LOCATION: 1505 Palm Avenue, 92648 (southwest corner of Palm Avenue and 15th Street) DATE OF ACTION: October 1, 2013 Dear Mr. Hernandez: On October 1, 2013, the Planning & Building Department of the City of Huntington Beach took action on your request and APPROVED your request with findings and conditions of approval. Attached to this letter are the findings and conditions of approval for your application. Please be advised that the Department of Planning & Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your AP No. 13-010 October 1, 2013 Page 2 of 2 project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning & Building is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Planning and Building Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the filing fee for the above noted application is Frida October 11 2013 at 5:00 m. I FINDINGS AND CONDITIONS OF APPROVAL ADMINISTRATIVE PERMIT NO. 13-010 FINDINGS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 13-010 1. The proposed enclosure of an existing 286 sq. ft. deck to create a den, laundry room and bathroom addition on an existing legal non-conforming use to not exceed 10% of the permitted square footage is necessary to improve the aesthetic appearance of the structure's architecture by bringing the design into greater conformance with the surrounding neighborhood. The property's architectural appearance will be improved by removing non- permitted additions to the structure. 2. The proposed 286 sq. ft. addition will not increase the number of stories. Instead, the addition and alterations of removing the non-permitted construction will occur on existing floor levels. 3. The proposed 286 sq. ft. addition will not cause the floor area to exceed more than 10% of the floor area the structure contained at the time the use became nonconforming. The proposed addition will increase the floor area by approximately 8%. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 13-010 1. The site plans, floor plans, and elevations received and dated August 30, 2013 shall be the conceptually approved design with the following modification: a. The existing and proposed dens shall be modified so that at least 50% of one wall is open to an adjacent room or hallway. 2. Prior to submittal for building permits, the plans shall be revised in accordance with Condition of Approval No. 1 and submitted to the Planning Division for inclusion in the entitlement file. 3. Prior to final inspection for the 286 sq. ft. addition, all unpermitted construction shall be removed and replaced with landscape. 4. Incorporating sustainable or "green" building practices into the design of the proposed struc- tures and associated site improvements is highly encouraged. Sustainable building practices may include (but are not limited to) those recommended by the U.S. Green Building Coun- cil's Leadership in Energy and Environmental Design (LEED) Program certification (htt ://www.us bc.or /Dis la Pa e. as x?Cate o ID=19) or Build It Green's Green Building Guidelines and Rating Systems (htt ://www.buildit reen.or / reen-buildin - uidelines- rating). INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. Administrative Permit No. 13-010 shall not become effective until the ten-calendar day appeal period has elapsed and the required conditions of approval have been satisfied. 3. Administrative Permit No. 13-010 shall become null and void unless exercised within two years of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning and Building Department a minimum 30 days prior to the expiration date. 4. The Planning and Building Department reserves the right to revoke Administrative Permit No. 13-010, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof.
