PROPOSED USE OF PROJECT:
A. THE PROPOSED PROJECT IS WITHIN RESIDENTIAL ZONING AND IS SURROUNDED BY ALLEYS TO
THE WEST AND NORTH. A RESIDENCE IS LOCATED ADJACENT TO THE PROJECT TO THE EAST.
E. THE SITE IS NOT LOCATED WITHIN A HAZARDOUS WASTE AND SUBSTANCE SITE PURSUANT TO
SECTION 65962.5 OF THE GOVERNMENT CODE.
JUSTIFICATION OF C.U.P.:
A. CURRENT ZONING REQUIRES 15 FOOT SETBACK. A C.U.P. IS REQUESTED TO
BUILD A SECOND STORY ON THE EXISTING 1ST STORY FOUDATION WHICH IS
SETBACK 10 FEET FROM THE PROPERTY LINE.
B. A C.U.P. IS BEING REQUESTED FOR A NEW ROOF GARDEN ABOVE THE SECOND
STORY. IT IS THE INTENT OF THE DESIGN THAT NO SHADOWS OR VIEWS BE
ENCROACHED UPON ON ANY SIDE OF THE ADJACENT PROPERTIES.
C. A VARIANCE IS REQUESTED FOR THE PROPOSED HABITABLE SPACE ABOVE THE
GARAGE TO ALLOW A 5'-0" SETBACK AFTER DETICATION. THIS WOULD IMPACT
ALLEY ONLY.
