Pacific Avenue and 8thStreet, Sunset Beach) DATE OF ACTION:August 4, 2015 On August 4, 2015, the Planning and Building Department of the City of Huntington Beach took action on your request and APPROVED your requestwith conditions. Attached to this letter are the findings and conditions of approvalfor your application. Please be advised that the Departmentof Planning and Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinancerequirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning and Building is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning and Building Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompanythe notice of appeal. FINDINGS FOR APPROVAL—ADMINISTRATIVE PERMIT NO. 15-014: Administrative Permit No. 15 - 0 1 4 t o " a p p r o v e i n c o n c e p t " t h e r e b u i l d i n g o f a n e x i s t i n g 8 0 0 sq. ft. deck on the beach at the same footprint contiguous to an existing single family residence conforms with the General Plan and the D r a f t S u n s e t B e a c h S p e c i f i c P l a n designation of Sunset Beach Residential. The proposed project is consistent with Coastal Element Policy C 1.1.1 to encourage new development to locate within, contig u o u s t o , o r i n close proximity to, existing developed areas able to accommodate it. The proposed construction will occur on a developedsite, contiguous to existing residentialdevelopment. The project is consistent with t h e r e q u i r e m e n t s o f t h e C Z O v e r l a y D i s t r i c t , t h e b a s e - z o n i n g district and other applicable provisions of the Municipal Code. The project complies with all applicable development regulations, including a r e q u i r e m e n t f o r t h e d e c k t o b e temporary/removable, maximumdeck top elevation, and portablefurniture. At the time of occupa n c y t h e p r o p o s e d d e v e l o p m e n t c a n b e p r o v i d e d w i t h i n f r a s t r u c t u r e i n a manner that is consistent with the Draft Sunset Beach Specific Plan. The project will be constructed on a previouslydeveloped site in an urbanized area with all necessary services and infrastructure available. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project will not impede public access, recreation, or views to coastal resources. The Draft Sunset Beach Specific Plan has provisionsthat allow for structures accessoryto re s i d e n t i a l d e v e l o p m e n t w i t h i n t h e 2 0 f o o t s t r i p o f b e a c h p r o p e r t y contiguous to residential properties. CONDITIONS OF APPROVAL—ADMINSTRATIVE PERMIT NO. 15-014: The site plan, floor plans, and elevations received and dated June 30, 2015 shall be the conceptually approveddesign. Prior to construction of the deck, evidence of Coastal Development Permit approval by the California Coastal Commissionshall be submitted to the Planning and Building Department.
