Pacific Avenue, (between 20th and 21st Streets, Suns,-t Beach) DATE OF ACTION:July 7, 2015 On July 7, 2015, the Planning and Building Department of the City of Huntington Beach took action on your request and APPROVED your request with conditions. Attached to this letter are the findings and conditions of approval for your application. Please be advised that the Department of Planning and Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning and Building is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning and Building Department's action. The notice of appeal shall include the name and address of the appellant,the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. FINDINGS FOR APPROVAL —ADMINISTRATIVE PERMIT NO. 15-011: Administrative Permit No. 15-011 to "approve in concept" the construction of one new three- story single family residence (4,331 sq. ft. at 35 ft. in height) c o n f o r m s t o t h e G e n e r a l P l a n and the Draft Sunset Beach Specific Plan designation of Sunset Beach Residential. The proposed project is consistent with Coastal Element Policy C 1.1.1 to encourage n e w development to locate within, contiguous to, or in close proximity to, existing developed areas able to accommodate it. The proposed construction will occur on a vacant (previously-developed) site, contiguous to existing residential development. The project is consistent with the requirements of the CZ Overlay Di s t r i c t , t h e b a s e z o n i n g district and other applicable provisions of the Municipal Code. The project complies with all applicable development regulations, including minimum setbacks and on-site parking, and maximum building height. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Draft Sunset Beach Specific Plan. The project will be constructed on a previously develope d s i t e i n a n u r b a n i z e d a r e a w i t h a l l n e c e s s a r y s e r v i c e s and infrastructure available, including water, sewer, and roads. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project will not impede public access, recreation, or views to coastal resources. CONDITIONS OF APPROVAL —ADMINSTRATIVE PERMIT NO. 15-011: 1. The site plan, floor plans, and elevations received and dated June 10, 2015 shall be the conceptually approved design with the following modifications: a. The 18 ft. by 18 ft. parking area in the garage at 16581 S. Pacific Avenue shall be clear with no obstruct i o n s ( n o d o o r s w i n g i n g i n w a r d ) . Prior to submittal of building permits, the following shall be completed: Submit evidence of Coastal Development Permit appr o v a l b y t h e C a l i f o r n i a C o a s t a l Commission. Zoning entitlement condition s o f a p p r o v a l a n d c o d e r e q u i r e m e n t s i d e n t i f i e d i n separately t r a n s m i t t e d m e m o r a n d u m f r o m t h e D e p a r t m e n t s o f F i r e , P l a n n i n g a n d Building, and Public Works shall be printed verbatim o n o n e o f t h e f i r s t t h r e e p a g e s of a l l t h e w o r k i n g d r a w i n g s e t s u s e d f o r i s s u a n c e o f b u i l d i n g p e r m i t s ( a r c h i t e c t u r a l , structural, electrical, mechanical, and plumbing) and shall be referenced in the s h e e t index. T h e m i n i m u m f o n t s i z e u t i l i z e d f o r p r i n t e d t e x t s h a l l b e 1 2 p o i n t . 3. During demolition, grading, site development, and/or construction, the following shall be adhered to: Construction e q u i p m e n t s h a l l b e m a i n t a i n e d i n p e a k o p e r a t i n g c o n d i t i o n t o r e d u c e emissions. The structure(s) cannot be occupied and the final building permit(s) cannot b e a p p r o v e d until the following have been completed: All improvements must be completed in accordance with approved plans. Compliance w i t h a l l c o n d i t i o n s o f a p p r o v a l s p e c i f i e d h e r e i n s h a l l b e v e r i f i e d b y t h e Planning and B u i l d i n g D e p a r t m e n t . All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. 5. Any conditions of approval, imposed by the Coastal Commission, that are more restrictive than those set forth in this approval shall be adhered to. 6. Administrative Permit No. 15-011 shall become null and void unless exercised within two years of the date of final Coastal Commission approval or such extens i o n o f t i m e a s m a y b e granted by the Director pursuant to a written request submitted to the Planning & Building Department a minimum 30 days prior to the expiration date. 7. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. APNo.15,011 July7,2015 Page5 of 5 The Development Services Departments and divisions (Building & Safety, Fire, Planning and Public Works) shall be responsible for ensuring compliance with all applicable code requirements and conditions of approval. The Director of Planning and Building may approve minor amendmentsto plans and/or conditions of approval as appropriate based on changed circumstances, new information or other relevant factors. Any proposed plan/project revisions shall be called out on the plan sets submitted for building permits. Permits shall not be issued until the Development Services Departments have reviewed and approved the proposed changes for conformance with the, intent of the Director's action. Incorporating sustainable or "green" building practices into the design of the proposed structures and associated site improvements is highly encouraged. Sustainable building practices may include (but are not limited to) those recommended by the U.S. Green Building Council's Leadership in Energy and Environmental Design (LEED) Program certification (htt ://www.us bc.or /Dis la Pa e.as x?Cate o ID=19) or Build It Green's Green Building Guidelines and Rating Systems (htt ://www.buildit reen.or / reen-buildin - uidelines-ratin / . INFORMATION ON SPECIFIC CODE REQUIREMENTS Administrative Permit No. 15-011 shall not become effective until the ten-calendar day appeal period has elapsed and Coastal Commission has given final approval.(HBZSO Section 241.14 and California CoastalAct) The Planning and Building Department reserves the right to revoke Administrative Permit No. 15-011, pursuantto a public hearingfor revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. (HBZSO Section 249.06) The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.(City Charter, Article V) The development shall comply with the requirements of the Coastal Floodplain Development Study Orange County Coastline (dated January 1985) and the HBZSO Floodplain Overlay District.(Sunset BeachSpecific Plan Sections 2.4 and 3.3.8)
