A t t a c h e d t o t h i s letter are the conditions of approval for your application. Please be advised that the Department of Community Development reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Community Development is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Community Development Department's action. The site plan, floor plans, and elevations received and dated March 14, 2016 shall be the conceptually approved design, with the following modifications: The new siding installed along the stairway and stairway landing shall be painted to match the existing house. The louvers to be installed along the upper portion of the landing shall be oriented such that the openings face the street and not the adjacent property to the north. 2. Within 30 days of the end of the appeal period for this action, the property owner shall submit to the Building Division all appropriate documents to obtain permits for all work associated with this request, including interior modifications to the unit and modifications to the stairway. 3. Within 90 days of the end of the appeal period for this action, the property owner shall obtain from the Building Division all permits for all work associated with this request, including interior modifications to the unit and modifications to the stairway. 4. Within 180 days of the end of the appeal period for this action, the property owner shall obtain final approval and sign off from the Building Division on permits for all work associated with this request, including interior modifications to the unit and modifications to the stairway. 5. Within 30 days of the issuance of building permits, a covenant restricting use of the main dwelling or the accessory dwelling to be owner-occupied shall be recorded with the County of Orange. A copy of the recorded covenant shall be filed with the Department of Community Development prior to final building inspection. 6. Administrative Permit No. 15-030 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Community Development Department a minimum 30 days prior to the expiration date. 7. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE REQUIREMENTS Administrative Permit No. 15-030 shall not become effective until the ten-calendar day appeal period has elapsed.(HBZSO Section 241.14) The Community Development Department reserves the right to revoke Administrative Permit No. 15-030, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. ThedevelopmentshallcomplywithallapplicableprovisionsoftheMunicipalCode,Building Division,andFireDepartmentaswellasapplicablelocal,StateandFederalFireCodes, Ordinances,andstandards,exceptasnotedherein.(City C h a r t e r , A r t i c l e V ) INDEMNIFICATION AND HOLD HARMLESS CONDITION: Theownerofthe propertywhichisthesubjectofthisprojectandtheprojectapplicantifdifferent from the property owner, and each of their heirs, successorsand assigns, shall defend, indemnify and hold harmlessthe City of HuntingtonBeach and its agents, officers, and employeesfrom any claim,actionor proceedings,liabilitycost, includingattorney'sfees and costsagainsttheCityor itsagents,officersoremployees,to attack,setaside,voidorannulany approvalof the City, includingbut not limitedto any approvalgranted by the City Council, PlanningCommission,or DesignReviewBoardconcerningthisproject. TheCityshallpromptly notifythe applicantof anyclaim,actionor proceedingandshouldcooperatefullyinthedefense thereof.
