The issue at hand is the existing covered landing that shelters the front e n t r y t o the Phillips' 1905 family home and their plan to expand the structure to the re a r o f t h e property. They wish to do a more than 50% addition which triggers an issue with the front setback. The existing cove r e d l a n d i n g e x t e n d s t w o f e e t i n t o t h e 12 feet s e t b a c k . I b e l i e v e the HBZSOallows you as Director, to waive t h i s i s s u e a c c o r d i n g t o t h e p a r a m e t e r s o f S e c t i o n 241.22Waivers. We have been informed by Ricky an d H a y d e n i n a p r e v i o u s m e e t i n g t h a t t h e r e i s n o s p e c i f i c code, memoor policy statement t h a t d e l i n e a t e s h o w t h e 1 0 % d e v i a t i o n f r o m t h e s e t b a c k i s calculated and we believe t h a t a c a l c u l a t i o n b a s e d o n s q u a r e f o o t a g e i s t h e m o s t a p p r o p r i a t e way to preserve the historic landing and allow the Phillips family to achieve their historically sensitive addition. It is rare that home owners preserves these historic homes. While Ricky and Hayden have expressed support of this project and this method of assessment, they want your input/approval. The landing, with its nume r o u s o r i g i n a l v i c t o r i a n a r c h i t e c t u r a l f e a t u r e s , i s b a r e l y 5 1/2 feet by 5 1/2 feet s q u a r e . T h e e n c r o a c h m e n t i n t o t h e s e t b a c k i s o n l y 2 feet f o r a t o t a l o f only 11 square feet out of 300, an encroachment of less than 4%.Considering t h a t t h e e n t i r e front face of the home is setback at 1 5 f e e t a n d w i l l r e m a i n t h e r e i n p e r p e t u i t y w i t h t h i s addition, we believe it is reasonable to grant this waiver. The General Plan Historic Element supports this action and suggests goin g b e y o n d t h e parameters of 241.22and a l l c o d e s e c t i o n s , t o e n c o u r a g e h o m e o w n e r s l i k e t h e P h i l i p s ' a n d assure the retention and restoration of our h i s t o r i c s t o c k . We also believe you should consider the general principle of law that says "that which is not specifically prohibited is allowed".
