On December 13, 2016, the Community Development Department of the City of
Huntington Beach took action on your request and APPROVEDIN CONCEPTyour
request. Attached to this letter are the findings and conditions of approval for your
application.
Pleasebe advisedthat the CommunityDevelopmentDepartmentreviewsthe conceptual
plan as a basicrequestfor entitlementofthe useappliedfor and there may be additional
requirements prior to issuance of building permits. It is recommended that you
immediately pursue completion of the conditions of approval and address all
requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to
expedite the processing/completionof your project. The conceptual plan should not be
construed as a precise plan, reflecting conformance to all Zoning and Subdivision
Ordinancerequirements.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the
action taken by the Community Development Department is final unless an appeal is

FINDINGSFORPROJECTSEXEMPTFROMCEQA:
The CommunityDevelopmentDepartmentfinds that the projectwill not have any
significanteffectontheenvironmentandisexemptfromtheprovisionsoftheCalifornia
EnvironmentalQualityAct (CEQA)pursuantto section15303of the CEQAGuidelines,
becausetheprojectconsistsoftheconstructionof onesinglefamilyresidenceslocated
withinanurbanizedresidentialzone.
FINDINGSFORAPPROVAL- ADMINISTRATIVEPERMITNO.16-011:
AdministrativePermitNo.16-011to"approveinconcept"thedemolitionofan
existing1,600sq.ft.singlefamilyresidenceandto constructa newthree-story4,621
sq.ft.singlefamilyresidencewitha508sq.ft. attachedgarage,withanoverall
maximumheightof35ft.,conformswiththeGeneralPlanandtheDraftSunset
BeachSpecificPlandesignationofSunsetBeachResidential.Theproposedproject
isconsistentwithCoastalElementPolicyC 1.1.1to encouragenewdevelopmentto
locatewithin,contiguousto,orincloseproximityto,existingdevelopedareasableto
accommodateit. Theproposedconstructionwilloccuronadevelopedsite,
contiguoustoexistingresidentialdevelopment.
TheprojectisconsistentwiththerequirementsoftheCZOverlayDistrict,thebase
zoningdistrictandotherapplicableprovisionsoftheMunicipalCode.Theproject
complieswithallapplicabledevelopmentregulations,includingminimumsetbacks
andon-siteparking,andmaximumbuildingheight.
Atthetimeofoccupancytheproposeddevelopmentcanbeprovidedwith
infrastructureinamannerthatisconsistentwiththeDraftSunsetBeachSpecific
Plan. Theprojectwillbeconstructedonapreviouslydevelopedsiteinanurbanized
areawithallnecessaryservicesandinfrastructureavailable,includingwater,sewer,
androads.
Thedevelopmentconformswiththepublicaccessandpublicrecreationpoliciesof
Chapter3oftheCaliforniaCoastalAct.Theprojectwillnotimpedepublicaccess,
recreation,orviewstocoastalresources.
CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.16-011:
1. Thesiteplan,floorplans,andelevationsreceivedanddatedNovember8,2016,
shallbetheconceptuallyapprovedlayoutwiththefollowingmodifications:
a. Thestructure'sfoundationshallcomplywiththeSunsetBeachSpecificPlan
andFEMAfloodzonedesignationstandardsofconstructionineffectatthe
timeofbuildingpermitsubmittal.Thefoundationstandardsineffectatthe
timeofthisactionaredescribedintheCoastalFloodplainDevelopment
StudyOrangeCountyCoastline(datedJanuary1985).Additionally,the

CoastalFloodplainDevelopmentStudyOrangeCountyCoastline(dated
January1985)requiresthatthegradingplansandarchitecturalelevations
shallbeinternallyconsistent,shallusethesamedatumfornaturalgradeand
finishedfloor,andallmeasurementsshallbefromthehighestnaturalgrade.
b. Theproposedbalconieslocatedonthesecondandthirdfloorsshallnot
encroachintotherequiredsixinchfrontyardsetback.
2. Priortosubmittalforbuildingpermits,thefollowingshallbecompleted:
SubmitevidenceofCoastalDevelopmentPermitapprovalbytheCalifornia
CoastalCommission.
Zoningentitlementconditionsofapproval,coderequirementsidentified
hereinandcoderequirementsidentifiedinseparatelytransmitted
memorandumfromtheDepartmentsofFire,CommunityDevelopment,and
PublicWorksshallbeprintedverbatimononeofthefirstthreepagesofall
theworkingdrawingsetsusedforissuanceofbuildingpermits(architectural,
structural,electrical,mechanical,andplumbing)andshallbereferencedin
thesheetindex.Theminimumfontsizeutilizedforprintedtextshallbe12
point.
Onesetofrevisedsiteplan,floorplanandelevationsinaccordancewith
ConditionNo.1shallbesubmittedtothePlanningDivisionforreviewand
approvalandinclusionintheentitlementfile.
3. Anyconditionsofapproval,imposedbytheCoastalCommission,thataremore
restrictivethanthosesetforthinthisapprovalshallbeadheredto.
4. Theapplicantand/orapplicant'srepresentativeshallberesponsibleforensuringthe
accuracyofallplansandinformationsubmittedtotheCityforreviewandapproval.
5. The DevelopmentServicesDepartmentsand divisions(Building& Safety,Fire,
Planningand PublicWorks)shallbe responsiblefor ensuringcompliancewith all
applicable code requirementsand conditions of approval. The Community
DevelopmentDepartmentmay approve minor amendmentsto plans and/or
conditionsof approvalas appropriatebased on changedcircumstances,new
informationor otherrelevantfactors.Any proposedplan/projectrevisionsshallbe
calledout on the plan sets submittedfor buildingpermits.Permitsshall not be
issueduntilthe DevelopmentServicesDepartmentshavereviewedandapproved
the proposed changes for conformancewith the intent of the Community
DevelopmentDepartment'saction.
6. Incorporatingsustainableor"green"buildingpracticesintothedesignofthe
proposedstructuresandassociatedsiteimprovementsishighlyencouraged.
Sustainablebuildingpracticesmayinclude(butarenotlimitedto)
thoserecommendedbytheU.S.GreenBuildingCouncil'sLeadershipinEnergyand
EnvironmentalDesign(LEED)Programcertification

AdministrativePermitNo. 16-011shallnot becomeeffectiveuntilthe ten-calendar
day appealperiodhaselapsedandCoastalCommissionhasgivenfinal approval.

AdministrativePermitNo.16-011shallbecomenullandvoidunlessexercisedwithin
oneyearofthedateoffinalapprovalorsuchextensionoftimeasmaybegrantedby
the Directorpursuantto a writtenrequestsubmittedto theCommunityDevelopment
Departmenta minimum30 days priorto the expirationdate.(HBZSOSection
241.16)
The Community Development Department reserves the right to revoke
AdministrativePermitNo. 16-011,pursuantto a publichearingfor revocation,if any
violationof these conditionsor the HuntingtonBeach Zoning and Subdivision
OrdinanceorMunicipalCodeoccurs.(HBZSOSection249.06)
Thedevelopmentshallcomplywithall applicableprovisionsof the MunicipalCode,
BuildingDivision,andFireDepartmentaswellasapplicablelocal,StateandFederal
Fire Codes,Ordinances,and standards,exceptas notedherein.(CityCharter,
ArticleV)
INDEMNIFICATIONANDHOLDHARMLESSCONDITION:
Theownerofthe propertywhichisthesubjectofthisprojectandtheprojectapplicantif
differentfromthe propertyowner,andeachoftheirheirs,successorsandassigns,shall
defend,indemnifyand hold harmlessthe City of HuntingtonBeachand its agents,
officers,andemployeesfrom anyclaim,actionor proceedings,liabilitycost,including
attorney'sfeesandcostsagainsttheCityor itsagents,officersoremployees,to attack,
setaside,voidorannulanyapprovaloftheCity,includingbutnotlimitedtoanyapproval
grantedbytheCityCouncil,PlanningCommission,or DesignReviewBoardconcerning
this project. The City shall promptlynotify the applicantof any claim, action or
proceedingandshouldcooperatefullyinthedefensethereof.
