It is recommended that you immediately pu r s u e completion of the conditions of approval and addressall requirementsof the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The waiver of developmentstandardsto exceed maximumlot coverageimprovesthe project by allowinga wider hallwayand new leadingto the third floorterrace. The propertycurrently has an exterior spiral staircase leading to the third floor terrace which does not comply with the HBSZO and would be removed in conjunctionwith this request. Granting the waiver allows for a cohe s i v e i n t e r i o r l a y o u t w i t h o p t i m a l i n t e r n a l c i r c u l a t i o n a n d i m p r o v e d functionality. Additionally, the project meets des i r e d d e s i g n o b j e c t i v e s , m a t c h e s t h e architecturestyleof the existing house;and maintainsneighborhoodcompatibility. The proposed project would not otherwise require any discretionary permits, will not in degrade the environment, a n d w i l l r e s u l t i n a n y c h a n g e s t o l a n d u s e o r d e n s i t y . W i t h t h e exception of the proposed 55 percent lot coverage, the proposed project, as conditioned, conformsto all applicabledevelopme n t s t a n d a r d s , i n c l u d i n g m a x i m u m h e i g h t a n d f l o o r a r e a ratio, minimumyard setbacks,and requiredonsiteparking. CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.14-012: 1. The site plan, floor plan, and elevations received and dated October 10, 2014, shall be the conceptually approvedlayout with the following modification: All proposedexterior building colors, materials,an d w i n d o w s s h a l l m a t c h t h e e x i s t i n g s t r u c t u r e . INFORMATIONONSPECIFICCODEREQUIREMENTS: The applicant and/or applicant's representative shall be r e s p o n s i b l e f o r e n s u r i n g t h e accuracyof all plansand informationsubmitte d t o t h e C i t y f o r r e v i e w a n d a p p r o v a l . Administrative Perm i t N o . 1 4 - 0 1 2 s h a l l n o t b e c o m e e f f e c t i v e u n t i l t h e t e n - c a l e n d a r d a y appeal period haselapsed. Administrative Permit No. 14-012 shall become null and void unless exercised within o n e year of the date of final approval or such extension of time as may be granted by the Director pursuantto a written request submittedto the Planningand Building Departmenta minimum30 days priorto the expirationdate. The developmentshall complywith all applicable provisionsof the MunicipalCode, Building Department,and Fire Departmentas well as applicablelocal, State and Federal Fire Codes, Ordinances,and standards,except as noted herein. INDEMNIFICATIONANDHOLDHARMLESSCONDITION The owner of the property which is the subject of this project and the project applicant, if different from the propertyowner,and each of their heirs,successorsand assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs againstthe city or its agents,officers or employees,to attack,set aside,void or annul any approval of the City, including but not limited to any approval granted by the City Cou n c i l , Planning Commission,or DesignReview Boardconcerningthis project. The City shall promptly notify the applicant of any claim, action or proceedingand should cooperatefully in the defense thereof.
