CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.14-004:
ThesiteplanandfloorplanreceivedanddatedApril21,2014,shallbetheconceptually
approvedlayout.
Theuseshallcomplywiththefollowing:
The48 inchhighenclosuresurroundingthe outdoordiningareashallbepermanently
affixedtotheground.
A minimumoffive(5)feetofclearpassageshallbemaintainedfor buildingaccess.
Noalcoholicbeveragesshallbepermittedwithinthe restaurantandoutdoordining
areaunlessa conditionalusepermitforthespecificuseisreviewedandapproved.
INFORMATIONONSPECIFICCODEREQUIREMENTS
AdministrativePermit No. 14-004shall not becomeeffective until the ten-calendarday
appealperiodhaselapsed.(HBZSOSection241.14)
AdministrativePermitNo. 14-004shall becomenull andvoid unlessexercisedwithinone
year of the date of final approvalor such extensionof time as may be grantedby the
Directorpursuantto a writtenrequestsubmittedto the PlanningDepartmenta minimum30
dayspriorto theexpirationdate.(HBZSOSection241.16)
The Planningand BuildingDepartmentreservesthe rightto revokeAdministrativePermit
No.14-004,pursuantto a publichearingfor revocation,ifanyviolationoftheseconditionsor
the Huntington Beach Zoning and SubdivisionOrdinance or Municipal Code occurs.

ThedevelopmentshallcomplywithallapplicableprovisionsoftheMunicipalCode,Building
Department,andFireDepartmentaswellasapplicablelocal,StateandFederalFireCodes,
Ordinances,andstandards,exceptas notedherein.(CityCharter,ArticleV)
INDEMNIFICATIONANDHOLDHARMLESSCONDITION:
Theownerofthe propertywhichisthesubjectofthisprojectandtheprojectapplicantif different
from the property owner, and each of their heirs, successorsand assigns, shall defend,
indemnify and hold harmlessthe City of HuntingtonBeach and its agents, officers, and
employeesfrom any claim,actionor proceedings,liabilitycost, includingattorney'sfees and
costsagainstthe Cityor itsagents,officersoremployees,to attack,setaside,voidorannulany
approvalof the City, includingbut not limitedto any approvalgranted by the City Council,
PlanningCommission,or DesignReviewBoardconcerningthis project. TheCityshallpromptly
notifythe applicantof anyclaim,actionor proceedingandshouldcooperatefully inthedefense
thereof.
