actiononyourrequestandAPPROVEDyourrequestwithconditions.Attachedtothisletterare
theconditionsofapprovalforyourapplication.
PleasebeadvisedthatthePlanningandBuildingDepartmentreviewstheconceptualplanasa
basicrequestfor entitlementof the useappliedfor andtheremaybe additionalrequirements
prior to issuanceof buildingpermits. It is recommendedthat you immediatelypursue
completionoftheconditionsof approvalandaddressallrequirementsofthe HuntingtonBeach
Zoning and SubdivisionOrdinancein order to expeditethe processing/completionof your
project.Theconceptualplanshouldnotbeconstruedasa preciseplan,reflectingconformance
to allZoningandSubdivisionOrdinancerequirements.
Underthe provisionsof the HuntingtonBeachZoningandSubdivisionOrdinance,the action
takenbythePlanningandBuildingDepartmentisfinalunlessanappealisfiledtothe Planning
Commissionbyyouorbyaninterestedparty. A persondesiringtoappealthedecisionshallfile
awrittennoticeofappealtotheSecretaryofthePlanningCommissionwithintencalendardays

CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.14-008
Thesite plan andfloorplanreceivedanddatedJune23, 2014,shallbe the conceptually
approvedlayoutwiththe modificationthata maximuminstructionareaof 1,238squarefeet
shallbeshownonthefloorplan.
Themaximumnumberof students/patronsutilizingthefacilityat anytimeshallnotexceed
thenumberof parkingspacesallocatedto thetenantspace. Basedonthe occupiedfloor
area(approximately1,650sq.ft.)andtheapplicableparkingstandardofoneparkingspace
per200squarefeet,the numberof parkingspacesallocatedis eight(8). Therefore,the
numberof studentsshall not exceed eight (8) during any session.Additionally,the
instructionalarea shall not exceed75 percentof the total floor area occupiedby the
personalenrichmentuse,or 1,238squarefeet.
Iftheapplicantcandemonstrate(bya parkinganalysis)thatadditionalparkingspacesmay
beallocatedto thetenantspace,thenanincreaseinthemaximumnumberof studentsata
timemaybepermittedsubjectto reviewandapprovalbythePlanningDivisionandissuance
of a newCertificateof Occupancybythe BuildingDivision.No newAdministrativePermit
shallberequired.
INFORMATIONONSPECIFICCODEREQUIREMENTS
AdministrativePermitNo. 14-008shall not becomeeffectiveuntil the ten-calendarday
appealperiodhaselapsed.(HBZSOSection241.14)
AdministrativePermitNo. 14-008shallbecomenullandvoid unlessexercisedwithinone
year of the date of final approvalor suchextensionof time as may be grantedby the
Directorpursuantto awrittenrequestsubmittedtothe PlanningDepartmenta minimum30
dayspriortotheexpirationdate.(HBZSOSection241.16)
The Planningand BuildingDepartmentreservesthe rightto revokeAdministrativePermit
No.14-006,pursuanttoa publichearingforrevocation,ifanyviolationoftheseconditionsor
the HuntingtonBeach Zoning and SubdivisionOrdinanceor MunicipalCode occurs.

ThedevelopmentshallcomplywithallapplicableprovisionsoftheMunicipalCode,Building
Department,andFireDepartmentaswellasapplicablelocal,StateandFederalFireCodes,
Ordinances,andstandards,exceptasnotedherein.(CityCharter,ArticleV)
INDEMNIFICATIONANDHOLDHARMLESSCONDITION:
Theownerofthepropertywhichisthesubjectofthisprojectandtheprojectapplicantifdifferent
from the propertyowner,and each of their heirs, successorsand assigns,shall defend,
indemnifyand hold harmlessthe City of HuntingtonBeach and its agents, officers,and
employeesfrom any claim,actionor proceedings,liabilitycost,includingattorney'sfees and
costsagainsttheCityoritsagents,officersoremployees,toattack,setaside,voidorannulany
approvalof the City, includingbut not limitedto any approvalgrantedby the City Council,
