and APPROVEDyour requestwith conditions.Attachedto this letter are the conditionsof
approvalforyourapplication.
Pleasebe advisedthatthe CommunityDevelopmentDepartmentreviewsthe conceptualplan
as a basic requestfor entitlementof the use appliedfor and there may be additional
requirementspriorto issuanceof buildingpermits.It is recommendedthat you immediately
pursuecompletionoftheconditionsof approvalandaddressallrequirementsofthe Huntington
BeachZoningandSubdivisionOrdinanceinordertoexpeditetheprocessing/completionofyour
project.Theconceptualplanshouldnotbeconstruedasa preciseplan,reflectingconformance
to allZoningandSubdivisionOrdinancerequirements.
Underthe provisionsof the HuntingtonBeachZoningandSubdivisionOrdinance,the action
taken by the Departmentof Planningand Buildingis final unlessan appealis filed to the
PlanningCommissionby you or by an interestedparty. A persondesiringto appealthe
decisionshallfilea writtennoticeofappealtotheSecretaryofthePlanningCommissionwithin
tencalendardaysofthedateofthe PlanningandBuildingDepartment'saction. Thenoticeof
appealshallincludethe nameandaddressoftheappellant,thedecisionbeingappealed,and
thegroundsfortheappeal.Afilingfeeof$494shallalsoaccompanythenoticeofappeal.Said
appealmust be in writingand mustset forth in detailthe actionandgroundsby whichthe

CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.16-020:
Thesiteplan,floorplan,andelevationsreceivedanddatedDecember21,2016shallbethe
conceptuallyapprovedlayout.
Within30 daysof the issuanceof buildingpermits,a covenantrestrictinguseof the main
dwellingortheaccessorydwellingto beowner-occupiedshallbe recordedwiththe County
of Orange. A copyoftherecordedcovenantshallbefiledwiththe Departmentof Planning
andBuildingpriortofinalbuildinginspection.
AdministrativePermitNo. 16-020shallbecomenullandvoid unlessexercisedwithinone
year of the date of final approvalor such extensionof time as may be grantedby the
Directorpursuantto awrittenrequestsubmittedtotheCommunityDevelopmentDepartment
a minimum30dayspriortotheexpirationdate.
The applicantand/or applicant'srepresentativeshall be responsiblefor ensuringthe
accuracyofallplansandinformationsubmittedtotheCityforreviewandapproval.
INFORMATIONONSPECIFICCODEREQUIREMENTS
AdministrativePermitNo. 16-020shall not becomeeffectiveuntil the ten-calendarday
appealperiodhaselapsed.(HBZSOSection241.14)
TheCommunityDevelopmentDepartmentreservestherightto revokeAdministrativePermit
No.16-020,pursuanttoa publichearingforrevocation,ifanyviolationoftheseconditionsor
the HuntingtonBeach Zoning and SubdivisionOrdinanceor MunicipalCode occurs.

ThedevelopmentshallcomplywithallapplicableprovisionsoftheMunicipalCode,Building
Department,andFireDepartmentaswellasapplicablelocal,StateandFederalFireCodes,
Ordinances,andstandards,exceptasnotedherein.(CityCharter,ArticleV)
INDEMNIFICATIONANDHOLDHARMLESSCONDITION:
Theownerofthepropertywhichisthesubjectofthisprojectandtheprojectapplicantifdifferent
from the propertyowner, and each of their heirs, successorsand assigns,shall defend,
indemnifyand hold harmlessthe City of HuntingtonBeach and its agents,officers,and
employeesfrom any claim,actionor proceedings,liabilitycost,includingattorney'sfees and
costsagainsttheCityoritsagents,officersoremployees,toattack,setaside,voidorannulany
approvalof the City, includingbut not limitedto any approvalgrantedby the City Council,
PlanningCommission,orDesignReviewBoardconcerningthisproject.TheCityshallpromptly
notifytheapplicantof anyclaim,actionorproceedingandshouldcooperatefullyinthedefense
thereof.
