thisletterarethefindingsandconditionsofapprovalforyourapplication.
Pleasebeadvisedthat theCommunityDevelopmentDepartmentreviewsthe conceptualplan
as a basic request for entitlementof the use applied for and there may be additional
requirementspriorto theissuanceof buildingpermits.Itis recommendedthatyouimmediately
pursuecompletionoftheconditionsofapprovalandaddressallrequirementsofthe Huntington
BeachZoningandSubdivisionOrdinanceinorderto expeditetheprocessing/completionofyour
project.Theconceptualplanshouldnotbeconstruedasa preciseplan,reflectingconformance
to allZoningandSubdivisionOrdinancerequirements.
Underthe provisionsof the HuntingtonBeachZoningand SubdivisionOrdinance,the action
taken by the CommunityDevelopmentDepartmentis final unlessan appealis filed to the
PlanningCommissionby you or by an interestedparty. A persondesiringto appealthe
decisionshallfile a writtennoticeofappealto theSecretaryofthe PlanningCommissionwithin
AdministrativePermitNo.16-012

ten (10) calendar days of the date of the Community DevelopmentDepartment's action. The
notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the groundsfor the appeal. A filing fee of $494 shall also accompanythe notice
of appeal. Said appeal must be in writing and mustset forth in detail the action and grounds by
which the applicant or interested party deems himself aggrieved. The last day for filing an

FINDINGSFORAPPROVAL—ADMINISTRATIVEPERMITNO.16-012:
The proposed lot coverage of 54.3 percentdoes not exceed a 10 percentdeviationfrom the
maximum allowed lot coverage of 50 percentapplicablein the RL (Low Density Residential
District) zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and
Subdivision Ordinance(HBZSO).
A typical lot width in the RL zone is 60 feet with a lot size of 6,000 squarefeet, whereas the
proposed projectsite has a substantiallysmaller lot width of 28.95 feet and a total lot size of
approximately2,287.50squarefeet; thus, creatinga hardshipfor the propertyownerto meet
the maximum lot coverage of 50 percent.The waiver of development standardsto exceed
maximum lot coverage improves the project by allowing for an efficient floor plan that
integrates the new addition of a 148 sq. ft. walk-in closet within the existing dwelling. The
proposed 148 sq. ft. walk-in closet maintains that all habitable areas within the existing
residence are accessible within the primary dwelling and will remain a single family
residence. Access to the proposed 148 sq. ft. walk-in closet is providedwithin the existing
master bedroom located on the second floor. The granting of a waiver for the proposed
project to exceed maximum lot coverage by 4.3 percent provides for a consistent interior
layout that providesoptimal internal circulationand improvedfunctionality;and a project that
meets desired design objectives, maintains neighborhood compatibility, and ensures
compliancewith Cityzoning standardsto the extent practicable.
The proposed project would not otherwise require any discretionary permits, and will not in
any way degrade the environment or result in any changes to land use or density. The
proposed project will be architecturally compatible with the existing residence and
surrounding neighborhoodand will remain a single-family residence. With the exception of
the proposed 54.3 percent lot coverage; the proposed project, as conditioned,conforms to
all applicabledevelopmentstandards,includingmaximumbuilding height.
CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.16-012:
The site plan, floor plan, and elevations received and dated May 20, 2016 shall be the
conceptually,approvedlayoutwith the following modifications:
a) Prior to submittal of building permits,the height of the addition area must be shown on
elevation plansand measuredfrom the peak of the new roofto the top of curb aswell as
the top of the slab. If no curb exists, the measurement shall be set at the highest
centerline of the street along the front property line. The height of the addition shall not
exceed 30feet, measuredfrom the top of curb or highestcenterlineofthe street.
Incorporating sustainable or "green" building practices into the design of the proposed
structures and associated site improvements is highly encouraged. Sustainable building
practices may include (but are not limited to) those recommended by the U.S. Green
Building Council's Leadership in Energy and Environmental Design (LEED) Program
certification (htt ://mw.us bc.or /Dis la Pa e.as x?Cate or ID=19) or Build It Green's
Green Building Guidelines and Rating Systems (htt ://www.buildit reen.or / reen-buildin -
•uidelines-rating).
INFORMATIONONSPECIFICCODEREQUIREMENTS:
The applicant and/or applicant's representative shall be responsible for ensuring the
accuracy of all plansand informationsubmittedto the Cityfor reviewand approval.
Administrative Permit No. 16-012 shall not become effective until the ten-calendar day
appeal period haselapsed.
Administrative Permit No. 16-012 shall become null and void unless exercised within six
months of the date of final approval or such extension of time as may be granted by the
Director pursuantto a written requestsubmittedto the CommunityDevelopmentDepartment
a minimum 30 days priorto the expirationdate.
The Community DevelopmentDepartmentreservesthe rightto revokeAdministrativePermit
No. 16-012, pursuantto a public hearingfor revocation,if any violation of these conditionsor
the Huntington BeachZoning and SubdivisionOrdinanceor MunicipalCode occurs.
The development shall comply with all applicableprovisionsof the Municipal Code, Building
Department, and FireDepartmentas well as applicablelocal, State and FederalFire Codes,
Ordinances, and standards,except as notedherein.
INDEMNIFICATIONANDHOLDHARMLESSCONDITION
The owner of the property which is the subject of this project and the project applicant, if
differentfrom the propertyowner, and each of their heirs,successors and assigns, shall defend,
indemnify and hold harmless the City of Huntington Beach and its agents, officers, and
employees from any claim, action or proceedings, liability cost, including attorney's fees and
costs against the city or its agents, officers or employees,to attack, set aside, void or annul any
approval of the City, including but not limited to any approval granted by the City Council,
PlanningCommission, or Design Review Boardconcerningthis project. The City shall promptly
notifythe applicant of anyclaim, action or proceedingand should cooperate fully in the defense
thereof.
