thisletteraretheconditionsofapprovalforyourapplication
PleasebeadvisedthattheDepartmentofCommunityDevelopmentreviewstheconceptualplan
as a basic requestfor entitlementof the use appliedfor and there may be additional
requirementspriorto issuanceof buildingpermits It is recommendedthat you immediately
pursuecompletionoftheconditionsof approvalandaddressall requirementsofthe Huntington
BeachZoningandSubdivisionOrdinanceinorderto expeditetheprocessing/completionofyour
project Theconceptualplanshouldnotbeconstruedasapreciseplan,reflectingconformance
to allZoningandSubdivisionOrdinancerequirements
Underthe provisionsof the HuntingtonBeachZoningandSubdivisionOrdinance,the action
taken by the Departmentof CommunityDevelopmentisfinal unlessan appealis filed to the
PlanningCommissionby you or by an interestedparty A persondesiringto appealthe
decisionshallfile awrittennoticeof appealto theSecretaryofthe PlanningCommissionwithin
ten (10) calendardaysof thedateof the CommunityDevelopmentDepartment'saction The
notice of appealshall includethe nameand addressof the appellant,the decisionbeing

CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.16-014:
1. The site plan andfloor planreceivedand datedJune3, 2016shallbe the conceptually
approvedlayout.
2. Priorto the operationof the largefamilydaycareuse,the followingrequirementsshallbe
met:
A copy of the City BusinessLicensefor the daycareuse shall be submittedto the
CommunityDevelopmentDepartment.
TheuseshallbelicensedbytheCaliforniaDepartmentofSocialServices.A copyofthe
daycarelicenseshall be submittedto the CommunityDevelopmentDepartmentfor
inclusionintheentitlementfile.
Compliancewithall conditionsof approvalspecifiedhereinshallbe accomplishedand
verifiedbytheCommunityDevelopmentDepartment.
3. Theuseshallcomplywiththefollowing:
A maximumof 12children(orupto 14iftwoofthechildrenaresixyearsor older)may
beprovidedcareatanyonetime.
Hoursof operationshallbe limitedto between7:30AM and7:00PM,Mondaythrough
Friday.
Daycareemployeesshallparkinthegarageoronthedrivewayatalltimesto reducethe
impactsto on-streetparking.
All ingressandegresstothedaycarefacilityshalloccurthroughthefrontdoor. Nofoot
trafficshalloccuroveradjacentproperties.
Nosignsidentifyingthedaycarefacilityshallbeplacedontheproperty.
Loadingand unloadingof childrenfrom vehiclesshall occur only on the applicant's
drivewayorcurbsideonthepublicstreetdirectlyinfrontoftheresidence.
4. The applicantand/or applicant'srepresentativeshall be responsiblefor ensuringthe
accuracyofallplansandinformationsubmittedtotheCityforreviewandapproval.
INFORMATIONONSPECIFICCODEREQUIREMENTS:
1. AdministrativePermitNo. 16-014shall not becomeeffectiveuntil the ten-calendarday
appealperiodhaselapsed.(HBZSOSection241.14)

AdministrativePermitNo. 16-014shall becomenullandvoid unlessexercisedwithinone
year of the date of final approvalor suchextensionof time as maybe grantedby the
DirectorpursuanttoawrittenrequestsubmittedtotheCommunityDevelopmentDepartment
a minimum30dayspriortotheexpirationdate.(HBZSOSection241.16.A)
TheCommunityDevelopmentDepartmentreservestherighttorevokeAdministrativePermit
No.16-014,pursuantto a publichearingforrevocation,ifanyviolationoftheseconditionsor
the HuntingtonBeach Zoning and SubdivisionOrdinanceor MunicipalCode occurs.

Thedevelopmentshallcomplywithallapplicableprovisionsofthe MunicipalCode,Building
Division,and FireDepartmentas well as applicablelocal,Stateand FederalFire Codes,
Ordinances,andstandards,exceptasnotedherein.(CityCharter,ArticleV)
Minoraccessorystructuresmaybelocatedinrequiredsideandrearyardsetbacksprovided
that the structureis locatedin the rear two-thirdsof the lot and a minimumfive foot
clearanceismaintainedbetweenthestructureandthedwellingif it islocatedintherequired
sideyard.(HBZSOSection230.08.A)
INDEMNIFICATIONANDHOLDHARMLESSCONDITION
The ownerof the propertywhich is the subjectof this projectand the projectapplicant,if
differentfromthepropertyowner,andeachoftheirheirs,successorsandassigns,shalldefend,
indemnifyand hold harmlessthe City of HuntingtonBeach and its agents,officers,and
employeesfrom any claim,actionor proceedings,liabilitycost,includingattorney'sfees and
costsagainstthecityoritsagents,officersoremployees,to attack,setaside,voidorannulany
approvalof the City, includingbut not limitedto any approvalgrantedby the City Council,
PlanningCommission,orDesignReviewBoardconcerningthisproject.TheCityshallpromptly
notifytheapplicantof anyclaim,actionor proceedingandshouldcooperatefullyinthedefense
thereof.
