The site plan and floor plan received and dated July 21, 2017, shall be the conceptually approved layout. 2. The use shall comply with the following: The hours of operatio n s h a l l b e M o n d a y — S u n d a y f r o m 8 : 0 0 A . M . - 8 : 0 0 P . M . The r e a r m a n d o o r l o c a t e d a l o n g t h e n o r t h e r l y p o r t i o n o f t h e b u i l d i n g s h a l l b e c l o s e d during operating hours. No o u t d o o r e x e r c i s i n g o r a n i m a l a c t i v i t i e s s h a l l b e p e r m i t t e d . There shall be no boarding of animal's onsite unless a Conditional Use Permit is approved f o r t h e u s e . 3. The maximum number of students shall not exceed twelve (12) during any class session. 4. The instructional area shall not exceed 75 percent of the total floor area occupied by the personal enrichment use, or 1 , 8 7 5 s q u a r e f e e t . 5. The subject facility shall not host competitions, competitive events, or live entertainment activities. 6. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE REQUIREMENTS Administrative Permit No. 17-012 shall not become effective until the ten-calendar d a y appeal period has elapsed.(HBZSO S e c t i o n 2 4 1 . 1 4 ) Administrative Permit No. 17-012 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Commu n i t y D e v e l o p m e n t D e p a r t m e n t a minimum 30 days prior to the expiration date.(HBZSOSection 2 4 1 . 1 6 . A ) The Community Development Department re s e r v e s t h e r i g h t t o r e v o k e A d m i n i s t r a t i v e P e r m i t No. 17-012, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. (HBZSO Section 241.16.D) The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.(City C h a r t e r , A r t i c l e V ) AP No. 17-012 August 9, 2017 Page4 of 4 INDEMNIFICATIONAND HOLD HARMLESSCONDITION The owner of the property which is the subject of this project and the project applicant, if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the city or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof.
