On February16, 2017, the CommunityDevelopmentDepartmentof the City of
HuntingtonBeachtook actionon your requestand APPROVEDIN CONCEPTyour
request. Attachedto this letterare the findingsand conditionsof approvalfor your
application.
PleasebeadvisedthattheCommunityDevelopmentDepartmentreviewstheconceptual
planasa basicrequestforentitlementoftheuseappliedforandtheremaybeadditional
requirementsprior to issuanceof building permits. It is recommendedthat you
immediatelypursue completion of the conditionsof approval and address all
requirementsof the HuntingtonBeachZoningand SubdivisionOrdinancein orderto
expeditethe processing/completionof yourproject.Theconceptualplanshouldnotbe
construedas a preciseplan, reflectingconformanceto all Zoning and Subdivision
Ordinancerequirements.
Underthe provisionsof the HuntingtonBeachZoningand SubdivisionOrdinance,the
actiontakenby the CommunityDevelopmentDepartmentis final unlessan appealis

filedto thePlanningCommissionbyyouorbyaninterestedparty. A persondesiringto
appealthedecisionshallfile a writtennoticeof appealto the Secretaryofthe Planning
Commissionwithin ten calendardays of the date of the CommunityDevelopment
Department'saction. The noticeof appealshallincludethe nameandaddressof the
appellant,the decisionbeingappealed,andthegroundsfor the appeal. A filingfee of
$2,364shallalsoaccompanythenoticeof appeal.Thelastdayforfilinganappealand
payingthe filingfeefor the abovenotedapplicationis Monday,February27, 2017at
5:00p.m.

FINDINGSFORPROJECTSEXEMPTFROMCEQA:
The CommunityDevelopmentDepartmentfinds that the projectwill not have any
significanteffectontheenvironmentandisexemptfromthe provisionsof theCalifornia
EnvironmentalQualityAct (CEQA)pursuantto section15303of the CEQAGuidelines,
becausethe projectconsistsof the repairandminoradditionto an existingmixed-use
structurelocatedwithinanurbanizedcommercialzone.
FINDINGSFORAPPROVAL-ADMINISTRATIVEPERMITNO.16-022:
AdministrativePermitNo.16-022to"approveinconcept"therepair,remodeland70
sq.ft. additiontoaCommercialMixedUsebuildingduetofiredamageconformswith
theGeneralPlanandtheDraftSunsetBeachSpecificPlandesignationofSunset
Beach.TheproposedprojectisconsistentwithCoastalElementPolicyC 1.1.1to
encouragenewdevelopmentto locatewithin,contiguousto,orincloseproximityto,
existingdevelopedareasableto accommodateit. Theproposedrepairs,remodel
and70sq.ft. additiontotheexistingmixed-usebuildingwilloccuronadeveloped
site,contiguoustoexistingcommercialdevelopments.
TheprojectisconsistentwiththerequirementsoftheCZOverlayDistrict,thebase
zoningdistrictandotherapplicableprovisionsoftheMunicipalCode.Theproject
complieswithallapplicabledevelopmentregulations,includingminimumsetbacks
andon-siteparking,andmaximumbuildingheight.
Atthetimeofoccupancy,theproposeddevelopmentcanbeprovidedwith
infrastructureina mannerthatisconsistentwiththeDraftSunsetBeachSpecific
Plan. Theprojectwillbeconstructedonapreviouslydevelopedsiteinanurbanized
areawithallnecessaryservicesandinfrastructureavailable,includingwater,sewer,
androads.
Thedevelopmentconformswiththepublicaccessandpublicrecreationpoliciesof
Chapter3oftheCaliforniaCoastalAct.Theprojectwillnotimpedepublicaccess,
recreation,orviewstocoastalresources.
CONDITIONSOFAPPROVAL—ADMINISTRATIVEPERMITNO.16-022:
1. Thesiteplan,floorplans,andelevationsreceivedanddatedJanuary20,2017,shall
betheconceptuallyapprovedlayoutwiththefollowingmodifications:
a. Removealleavesthatprojectintothepublicrightofway,unlessan
encroachmentpermitisobtainedbytheCaliforniaDepartmentof
Transportation(Caltrans)andapprovalbytheHuntingtonBeachPublic
WorksDepartmentandBuildingDivision.

2. Priortosubmittalforbuildingpermits,thefollowingshallbecompleted:
SubmitevidenceofCoastalDevelopmentPermitapprovalbytheCalifornia
CoastalCommission.
Zoningentitlementconditionsofapproval,coderequirementsidentified
hereinandcoderequirementsidentifiedinseparatelytransmitted
memorandumfromtheDepartmentsofFire,CommunityDevelopment,and
PublicWorksshallbeprintedverbatimononeofthefirstthreepagesofall
theworkingdrawingsetsusedforissuanceofbuildingpermits(architectural,
structural,electrical,mechanical,andplumbing)andshallbereferencedin
thesheetindex.Theminimumfontsizeutilizedforprintedtextshallbe12
point.
Onesetofrevisedsiteplan,floorplanandelevationsinaccordancewith
ConditionNo.1shallbesubmittedtothePlanningDivisionfor reviewand
approvalandinclusionintheentitlementfile.
3. Anyconditionsofapproval,imposedbytheCoastalCommission,thataremore
restrictivethanthosesetforthinthisapprovalshallbeadheredto.
4. Theapplicantand/orapplicant'srepresentativeshallberesponsibleforensuringthe
accuracyofallplansandinformationsubmittedtotheCityforreviewandapproval.
5. The DevelopmentServicesDepartmentsand divisions(Building& Safety,Fire,
Planningand PublicWorks)shallbe responsiblefor ensuringcompliancewith all
applicable code requirementsand conditions of approval. The Community
DevelopmentDepartmentmay approve minor amendmentsto plans and/or
conditionsof approvalas appropriatebased on changedcircumstances,new
informationor otherrelevantfactors.Anyproposedplan/projectrevisionsshallbe
calledout on the plan sets submittedfor buildingpermits.Permitsshall not be
issueduntilthe DevelopmentServicesDepartmentshavereviewedand approved
the proposed changes for conformancewith the intent of the Community
DevelopmentDepartment'saction.
6. Incorporatingsustainableor"green"buildingpracticesintothedesignofthe
proposedstructuresandassociatedsiteimprovementsishighlyencouraged.
Sustainablebuildingpracticesmayinclude(butarenotlimitedto)
thoserecommendedbytheU.S.GreenBuildingCouncil'sLeadershipinEnergyand
EnvironmentalDesign(LEED)Programcertification

INFORMATIONONSPECIFICCODEREQUIREMENTS
1. AdministrativePermitNo. 16-022shallnot becomeeffectiveuntilthe ten-calendar
day appealperiodhaselapsedandCoastalCommissionhasgivenfinal approval.

AdministrativePermitNo.16-022shallbecomenullandvoidunlessexercisedwithin
oneyearofthedateoffinalapprovalorsuchextensionoftimeasmaybegrantedby
the Directorpursuantto a writtenrequestsubmittedto theCommunityDevelopment
Departmenta minimum30 days priorto the expirationdate.(HBZSOSection
241.16)
The Community Development Department reserves the right to revoke
AdministrativePermitNo.16-022,pursuantto a publichearingfor revocation,if any
violation of these conditionsor the HuntingtonBeach Zoning and Subdivision
OrdinanceorMunicipalCodeoccurs.(HBZSOSection249.06)
Thedevelopmentshallcomplywithall applicableprovisionsof the MunicipalCode,
BuildingDivision,andFireDepartmentaswellasapplicablelocal,StateandFederal
Fire Codes,Ordinances,and standards,exceptas notedherein.(CityCharter,
ArticleV)
ThedevelopmentshallcomplywithallapplicabledevelopmentstandardsoftheDraft
SunsetBeachSpecificPlan(SP17Section3.3.2)
INDEMNIFICATIONANDHOLDHARMLESSCONDITION:
Theownerofthepropertywhichisthesubjectofthisprojectandtheprojectapplicantif
differentfromthe propertyowner,andeachoftheirheirs,successorsandassigns,shall
defend,indemnifyand hold harmlessthe City of HuntingtonBeachand its agents,
officers,andemployeesfromany claim,actionor proceedings,liabilitycost,including
attorney'sfeesandcostsagainsttheCityoritsagents,officersoremployees,to attack,
setaside,voidorannulanyapprovaloftheCity,includingbutnotlimitedtoanyapproval
grantedbytheCityCouncil,PlanningCommission,or DesignReviewBoardconcerning
this project. The City shall promptlynotify the applicantof any claim, action or
proceedingandshouldcooperatefullyinthedefensethereof.
