REGULATORY EVALUATION The process equipment that will be operated in the Huntington Beach facility will be for non - production product testing for market viability and not manufactured for commercial sale or production. These types of activities are eligible for an exemption from South Coast Air Quality Management District (SCAQMD) permitting requirements pursuant to Rule 219, paragraph (c)(6), which reads: "Written permits are not required for: Laboratory testing and quality control testing equipment used exclusively for chemical and physical analysis, non -production bench scale research equipment, and control equipment exclusively venting such equipment." In the event Newlight moves into a product production activity for commercial sale, the necessary air quality permits to operate such equipment will be obtained from the SCAQMD.
