BEACH EXPANDING-THE ORANGE COUNTY RECYCLING
MARKET DEVELOPMENT ZONE BY ADDING THE CITIES OF FULLERTON

WHE �-S'AS, California Public resources Code Section 42010, et a?. provides for the
establishment of the Recycling Market Development Zone program throughout the State which
provides incentives to stimulate development of post-consumer and secondary materials markets
for recyclables; and
WHEREAS, all California jurisdictions must meet a 50% reduction in landfill waste
disposal as mandated by the California Integrated Waste Management Act; and
WHEREAS, pursuant to Resolution No. 2015-52,the City Council authorized applying to
the California Department of Resources Recycling and Recovery ("CalRecycle") for designation
of Huntington Beach as the lead agency and administrator for the Orange County Recycling
Market Development Zone (the "Orange County RMDZ"). The Orange County RMDZ currently
includes the Cities of Huntington Beach, Orange, Garden Grove, Santa Ana, Stanton and the
Lmincorporated portions of the County of Orange; and
WHEREAS, the Orange County RMDZ is dedicated to establishing, sustaining and
expanding recycling-based manufacturing businesses, which is essential for market development
and to assist these jurisdictions in meeting the established landfill waste reduction goals; and.
WHEREAS, the Cities of Fullerton and Lake Forest desire existing and new recycling-
based manufacturing businesses located within their jurisdictions to be eligible for the technical
and financial incentives associated with the RMDZ program; and
WHEREAS, the addition of these jurisdictions to the Orange County RTQDZ r.s necessary
to facilitate local and regional planning, coordination, and support existing recycling-based
manufacturing businesses, as well as attract private sector recycling investments to the Orange
County RMDZ; and
WHEREAS, the Cities of Huntington Beach, Orange, Garden Grove, Santa Ana, Stanton,
Fullerton and Lake Forest,and Orange County have agreed to submit an application to CalRecycle
requesting the expansion of Orange County RMDZ to include the Cities of Fullerton and Lake
Forest; and
WHEREAS, Huntington Beach has agreed to act as Lead Agency for the proposed
expansion; and
WHEREAS, in accordance with the California Environmental Quality Act (CEQA), the
City of Huntington Beach has determined that this expansion is exempt from CEQA pursuant to
Section 20165.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach as follows:
The City of Huntington Beach approves the expansion of the Orange County RMDZ and
directs the Assistant to the City Manager to submit an application to CalRecycle requesting
expansion of the Orange County RMDZ to include the Cities of Fullerton and Lake Forest.
The City of Huntington Beach approves receipt of any Recycling Market Development
Zone related payments authorized by the Public Resources Code. The City Manager is hereby
authorized to execute in the name of the City of Huntington Beach all documents necessary to
secure payment and implement the associated activities.
The City of Huntington Beach will administer the Orange County RMDZ in a manner that
seeks to ensure the fair treatment of people of all races, cultures and incomes, including but not
limited to soliciting public participation in all communities within the RMDZ, including minority
and low-income populations.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
reguiar meeting hereof held on the 4th day of March , 2019.

I, ROBIN ESTANISLAU, the duly elected, qualified City Clerk of the
City of Huntington Beach, and ex-officio Clerk of the City Council of said City, do
hereby certify that the whole number of members of the City Council of the City of
Huntington Beach is seven; that the foregoing resolution was passed and adopted
by the affirmative vote of at least a majority of all the members of said City Council
at a Regular meeting thereof held on March 4, 2019 by the following vote:
