EASMMT FOR PEDESTRIAN CROSSING
THIS INDmiTURE made this 26th day of June, 1J41,
between the PACIFIC ELECTRIC RAILWAY COMPANY, a California
Corporation, party of the first part, and the CITY OF
HUNTINGTON BEACH, a municipal corporation of the State of
California, party of the second part:
WITN:`+ SETH: That first party., hereby grants to second
party (subject to the conditions hereinafter contained) the
right to construct and maintain a pedestrian crossing upon and
across that certain parcel of land situated in the City of
Huntington Beach, County of Orange, State of California, and
lying within the railroad right of way of first party, and des-
cribed as follows, to-wit:
A strip of land, eight (8) feet .in width, extending
across that certain 62 foot strip of land "Fourth" described in
deed to Los Angeles Inter Urban Railway Company,
recorded in
Book 155, page 2602 of Deeds, Orange County Records; the north-
westerly line of said strip of land, eight (8) feet in width, be-
ing described as follows:
Beginning at the point of intersection of the northeasterly
lame of said 82 foot strip with the southwesterly prolongation of a
line which is parallel to and eight (8) feet northwesterly, measured
at right angles, from the southeasterly line of Third Street (60
feet wide) as said street is shown .on map of Huntington Beach, re-
corded in. Book 3, page 369 of Miscellaneous Maps, Records of Orange
County; thence, from said point of intersection, southwesterly a-

The above described eight (6) foot strip is shown colored
red on plat C.EOK. 2231-a hereto attached and made a part hereof.
This grant is subject and subordinate to the prior and
continuing right and obligation of first party and its successors
to use and maintain its entire railroad right of way and property
in performance of its public duty as a common carrier, and is also
subject to the right and power of first party and its successors

in'.interest or ownership of the said railroad right of way
and property, to construct, maintain, use and operate, on the
present grade, or such grade as it may establish in the future,
existing or additional railroad tracks and appurtenances there-
to, including water and fuel pipe lines and conduits, and tele-
graph, telephone, signal, power, transmission and other electric
lines, and other railroad facilities and structures of any kind
upon, along or across any or all parts of said land above des-
cribed, all or any of which may be freely done at any time or
times by first party or its successors without liability to
second party or to any one else for compensation or damage, pro-
vided said highway shall not be interfered with except as necessary
during work on said railroad and appurtenances.
The rights and privileges hereby granted shall lapse
and become void if not exercised within one year from the date
hereof. Upon the termination of the rights herein granted to the
party of the second part, as hereinafter provided, the said party
of the second part shall thereupon remove said structure and
restore said premises, as nearly as possible, to the same state
and condition they were in prior to the construction thereof,
failing in which the party of the first part may perform such
work, and the said party of the second part agrees to reimburse
the party of the first part for the cost and expense thereof upon
demand.
The grant hereby made is .upon the further condition
subsequent that the premises aforedescribed shall at all times be
used by the party of the second part for pedestrian crossing and none
other, and if at any time such use shall be abandoned or discon-
tinued, all rights and privileges hereby granted shall forthwith
cease and determine, and the party of the first part, its suc-
cessors or assigns 'shallbe restored to its former estate in the
premises.
This grant is made in accordance with the terms and con-
ditions as outlined in Decision No. 33512- dated September 17, 1940,
of the Railroad Commission of the State of California.
This instrument is subject to all valid and existing
contracts,, leases, liens or encumbrances which may affect the said
property, and the word grant as used herein shall not be construed
as a covenant against the existence of any thereof®
IN WITNESS WHEREOF the parties thereto have caused their
respective corporate names and seals to be affixed hereunto and
these presents executed by their respective officers thereunto
duly authorized, the day and year first above written.
