Dear Sir:
Herewith are submitted proposed deed and
proposed Agreement between the City and myself
for dedication and improvement of streets in con-
nection with the issuance of a building permit
for a drive-in-theater on may property at the
northeast corner, of Wintersburg Road and the ex-
tension of Gothard Street in the City of
Huntington Beach. The legal description referred
to as Exhibit A has been forwarded to the City
Engineer and will be attached to the agreement.
It is respectfully requested that the matter
of approval of the issuance of the building per-
mit be placed on the agenda for the Council meet-
ing of April 3, 1961.

AGREEMENT TO DEDICATE RIGHT-OF-WAY FOR STREET PURPOSES
AND TO IMPROVE„SAID STREET UPON CERTAIN CONDITIONS
THIS UNDERTAKING is made and entered into this 31st
day of March, 1961, by the undersigned in favor of the
CITY OF HUNGTINGTON BEACH.
PURSUANT to requirement of said City and Section i-104'1 17#®4"?,
of its Municipal Code, as a necessary condition of the is-
suance of a building permit for the construction of a drive-
in-theater on approximately 8 acres located at the north-
east corner of Wintersburg Road and proposed Gothard Street
in the said City, owned by the undersigned, the legal de-
scription of which is attached hereto as Exhibit "A." and
made a part hereof by reference, the undersigned, in con-
sideration of the issuance of the building permit, agrees
as follows:
1. To improve the easterly one-half of proposed
Gothard Street, immediately adjacent to the said property,
with curb, gutter and pavement according to City specifica-
tions, in the event, and only in the event, that the under-
signed employs proposed Gothard Street adjacent to his
property for vehicular access, ingress or egress to the
property described herein in Exhibit"A" in connection with
the use of the drive-in-theater operation. Upon offer of
the undersigned owner to make the said improvements, said
City shall allow access to him, and issue the appropriate ;
permit.

2. Said improvements upon said conditions as above de-
scribed shall not extend northerly of the northerly property
line of the undersigned, and shall be confined only to curb,
gutter and pavement on the property hereinafter agreed to be
dedicated to the City by the undersigned owner.
3. Concurrently herewith, the undersigned agrees to
execute and deliver to the City, a deed granting and dedicat-
ing to the City, for street purposes only, and also in consid-
eration of the issuance of a building permit, as required by
of its Municipal Code, the westerly 42 feet of
the property described herein as Exhibit "A" together with
right of access thereto. Said deed shall be in a form accept-
able to the City Attorney of said City, and is for the purpose
of granting right-of-way for proposed Gothard Street.
4. The undersigned owner further agrees, in connection
with the issuance of the said building permit, to dedicate
the necessary property (30 feet) for the widening of
Wintersburg Road, and to improve with curb, gutter and pave-
ment, that portion of Wintersburg Road which is dedicated.
Said deed for street purposes shall be executed and delivered
to the City concurrently herewith.
