B. B. and M. , in the Rancho Las Bolsas, City of Huntington Beach, County of Orange, State of 12 California, as per map recorded in Book 51, page 14, of © Z. Miscellaneous Maps, in the office of the County 13 Recorder of said County, described as follows : p m 14 A strip of land, 20 feet wide, lying 11 feet Northerly and 9 feet Southerly of the following 15 described line: w c 16 Beginning at the Northwest corner of said Northwest quarter; thence along the North line of said w 17 Northwest quarter, North 88`48' 50" East, 2127.57 feet q 18 to the Northerly prolongation of the Westerly line of the land conveyed to Southern California Edison Company by deed recorded September 13, 1957, in Book 4034, m 19 page 550, of Official Records, , in the office of the i� County Recorder of said County; thence along said 1 20 Westerly line and its Northerly prolongation d South 120 39' 47" West, 1157.71 feet to . the -TRUE POINT w 21 OF BEGINNING; thence South ,770 20' 13" East, 180.00 feet. 22 23 The side lines of said strip of land, 20 feet wide, shall be prolonged or shortened so. as to ter- �j24 minate in the Easterly and Westerly lines of said land conveyed to Southern California Edison Company. y; 25 Said easement is granted upon and subject to the fol- �' 26 lowing terms , covenants and conditions : +' 27 1. The aforesaid easement is granted subject to cov- I: 28 enants conditions restrictions reservations rights, leases 29 easements, licenses and encumbrances, whether of record or not, 30 affectingthe above described real property, or any portion 31 thereof, and subject also to the right of Grantor to construct, 32 maintain, use, operate, alter, add to, repair, replace, -1- 2 reconstruct and/or remove, in, on, over, under, through, along 2 and across the above described and adjoining real property, r-OD 0 I S� 3 electric transmission and distribution lines and telephone lines �9 4 together with supporting structures and appurtenances , for j U1 5 conveying electric energy for light, heat, power and telephone m 6 purposes, and pipe lines and appurtenances for the transportatio 7 of oil, petroleum, gas , water or other substances, and conduits 8 for any and all purposes , provided, however, that Grantor shall 9 not erect or place at any future time any of its said facilities 10 in, on, over, under, through; along or across the above describe 11 real property, or any portion thereof, so as to interfere with 12 Grantee's use of said real property for the purposes hereinabove 13 specified. 14 2. Grantee, by the acceptance of this easement, agree 15 to strictly comply with the following conditions : 16 (a) Any drainage structure installed hereunder shall 17 be constructed so as to support a crossing load of 23 tons. 18 (b) All construction equipment,used in the handling o 19 material and in the construction of any structure hereunder shall 20 be operated at all times in such a manner as to maintain a min- 21 imam of fifteen (15) feet of clearance from the electrical 22 conductors of Grantor, and no construction equipment used on the 23 said property of Grantor shall exceed a height of twenty (20) 24 feet above the surface of the ground. 25 (c) Grantee shall promptly and properly replace the 26 earth over any structure installed by Grantee hereunder and shall 27 thoroughly tamp such earth so that no depressions shall be left 28 or shall develop in the surface of the ground. 29 (d) No grading shall be performed within fifteen (15) 30 feet of any tower leg of Grantor. 31 32 -2- I (e) Suitable identification markers shall be installed 2 indicating the location and depth of any structure in the above - -cp-- 3 described real property. o 4 3. The rights hereby granted for storm drain purposes to 5 shall be so exercised by Grantee as not to endanger or interfere to -o m 6 with the construction, maintenance, use, operation, presence, M 7 repair, replacement, alteration, reconstruction or removal of .per 8 said electric transmission, distribution or telephone lines, pip 9 lines or conduits, and Grantee, by the acceptance of this 10 instrument, agrees that the said facilities of Grantor shall not 3-1 be damaged by reason of the construction, reconstruction or main- 3-2 tenance of any storm drain structure installed hereunder by 13 Grantee, or its contractors, and that, if necessary, Grantee 14 shall protect said facilities of Grantor against any such damage. 15 4. This agreement and each and all of the terms, cov- 16 enants and conditions thereof, shall run with the land and shall 17 inure to the benefit of and be binding upon the successors ,and a 18 assigns of the respective parties hereto. 19 5.
