whether of record or not.

5 The aforesaid easement grant is also subject to the
6 right of said Grantor, its successors and assigns, to construct,
7 maintain, use, operate, alter, add to, repair, replace, recon-
8 struct and/or remove in, on, over, under, through, along and
9 across the above described real property, electric transmission
10 and distribution lines and telephone lines, together with
11 supporting structures and appurtenances, for conveying electric
12 energy for light, heat power and telephone purposes, and pipe
13 lines and appurtenances, for the transportation of oil, petro-
14 leum, gas, water or other substances; and said easement for
15 public street and highway purposes shall be so exercised as not
16 to interfere with the construction, maintenance, use, operation,
17 presence, repair, replacement, relocation, reconstruction or
18 removal of such electric transmission, distribution or telephone
19 lines or pipe lines, and the said Grantee, by the acceptance of
20 this instrument, agrees to hold harmless and indemnify said
21 Grantor, its successors and assigns, from and against all damage
22 to such electric transmission, distribution and telephone lines
23 and supporting structures and appurtenances and pipe lines and
24 appurtenances, by reason of the construction, reconstruction
25 and/or maintenance of said public street or highway, and to pay
26 to said Grantor, its successors and assigns, upon demand, any and
27 all costs of relocation and/or reconstruction of such electric
28 transmission, distribution and telephone lines and supporting
29 structures and pipe lines which may be or become necessary by
30 reason of the construction, reconstruction and/or maintenance
31 of said public street or highway.

1 Said Grantor reserves for itself, its successors and
2 assigns, the right to trim any tree or trees which may grow in

3 said street or highway, and which in the opinion of said Grantor,
4 its successors or assigns, endanger or interfere with the proper
5 operation or maintenance of said electric transmission, distri-
6 bution and telephone lines, to the extent necessary to prevent
7 any such interference or danger.
8 As a controlling part of the consideration for the
9 execution of this instrument, this grant of easement is made and
10 accepted upon and subject to the express condition that any open-
11 ing, widening and/or improvement of the street or highway for
12 which this easement is given commenced prior to the improvement of
13 the adjacent property of Grantor, shall be done without cost or
14 expense whatsoever to said Grantor, its successors or assigns, and
15 that in the event a special assessment or assessments is or are
16 levied by any authorized lawful body against the real property of
17 said Grantor, its successors or assigns, for said opening, widen-
18 ing and/or improvement, the said Grantee, in consideration of the
19 execution and delivery of this Road Easement by said Grantor,
20 agrees, by the acceptance of this instrument, that it will reim
21 burse said Grantor, its successors or assigns, and it shall be
22 the binding obligation of the said Grantee to reimburse said
23 Grantor, its successors or assigns, for the full amount of any
24 and all such special assessment or assessments so levied for said
25 improvement and paid by said Grantor, its successors or assigns.
26 As a part of any such opening, widening and/or improvement,
27 Grantee agrees to install at its sole expense a curb depression
28 sixteen (16) feet in width on the west side of Cannery Street at
29 the location specified by Grantor.
30 The rights hereby granted are not necessary or useful
31 in the performance of the duties of said Grantor to the public.
32 IN WITNESS WHEREOF, said Grantor has caused its

This is to certify that the interest in real property conveyed by the deed dated
october 4 , 19 67 from Southern California Edison Company
to the City of Huntington Beach, a municipal corporation, is hereby accepted
by the undersigned officer or agent on behalf of the City Council of the City
of Huntington Beach pursuant to the authority conferred by resolution of the
City Council of the City of Huntington Beach adopted on March 20, 1967, and
the grantee consents to the recordation thereof by its duly authorized officer.
