of those entitled thereto, the right at any and all times to enter upon and
unto any and all parts of the portion of said land below such depth .of 500 feet
from its surface, for the purpose of exploring and drilling for, mining, developing.,
removing and extracting any and all such substances, by slant or directional
drilling or other Operations from other land, entering into and penetrating
the land the subject hereof only below such depth of 500 feet from its surface;
but with (and thereshall be) no right under such exception and reservation of
entry upon to use: of the surface, or subsurface to a depth of 500 feet below
the surface, as reserved by Dorothy Thayer Peck, Charles M. Thatcher and Title
Insurance and Trust Company, a corporation, all as trustees of the trust under
written declaration thereof by Carrie A. Peck dated December 18, 1936 as to
an undivided 25% of said 100% interest and by Dorothy T. Peck, a widow, in her
individual capacity, " to an undivided 25% of said 100% interest, by deed
recorded October 1, 1959 in Book 4907, page 389 of Official Records.

B or in the Conditions and Stipulations, said mortgage being shown in Sched-
ule B in the order of its priority;
all subject, however, to the Conditions and Stipulations hereto annexed, which

THIS DECLAIATION, made this K_ day of `aa ,
19689 by FREEVlAY INDUSTRIAL PARK, a California corporation, fee
owner of Tract 5787 and Lots 2 and 3 of Tract 4064, and PEDIGO
PRODUCTS, INC. , a California corporation, fee owner of Lots 6 and
7 of Tract 4064 (all hereinafter collectively referred to as
"Declarant") with reference to the following facts.-
A. A Declaration of Covenants, Conditions and Restrict-
ions for the portion of Tract 4064, except Lot 1 thereof, except
for the South 182 feet thereof, as shown on a map of said Tract
4064 recorded on March 3, 1961, in Book 142 at pages 36-37, in-
clusive, Miscellaneous Maps, Records of Orange County, California,
was made on August 18, 1964, and was recorded on August 209 19642
at pages 266 through 275, inclusive, of Book 71869 Official .Records
of Orange County, California.
B. Lots 4 and 5 of the aforesaid Tract 4064 have been re-
subdivided into Tract 5787, which is shown on a map recorded on
April 81 1965, at pages 24-25, inclusive, of Book 213 of Miscellan-
eous Maps, Official Records of Orange County, California.
C. The Declaration referred to in Paragraph'A'above was
amended by action of owners of at least five (5) lots in Tract 4064
as it existed at the time of the aforesaid Declaration by a Docu-
ment dated the 29th day of December, 1965, and recorded on February
2, 1966 at pages 696-701, inclusive, of Book 213, Official Records
of Orange County, California, to include a resubdivision of Lots 4
and 5 of Tract 4064, to-wit Tract 5787, in the Declaration referred
to in 'A' above.

C. The Declaration referred to in paragraph "A" above
was amended by action of owners of at least five (5) lots in
Tract 4064 as It existed at the time of the aforesaid Declaration
by a document dated the 29th day of December, 1965, and recorded
on February 2, 1966 at pages 696-701, inclusive, of Book 2131
Official Records of Orange County, California, to include a re-
subdivision of Lots 4 and 5 of Tract 40649 to-wit Tract 5787 In
the Declaration referred to in "A" above.
Do Article VII of the Amended Declaration provides that
such Amended Declaration may be amended from time to time by ac-
tion of the owners of any seven (7) lots in Tract 4064 and Tract
5787, and is therefore competent to amend the aforesaid Declaration
and Amended Declaration in accordance with Article VII thereof.
E. Declarant intends in the future to convey interests
in Lot 6 Of Tract 5787 to the City of Huntington Beach for use
as a site or location for a fire station and appurtenances and
other public uses and intends to amend the aforesaid Declaration
and Amended Declaration to waive all covenants, conditions and
restrictions in such Declaration and Amended Declaration insofar
as they relate to Lot 6 Of Tract 5787.
NOW, THEREFORE, IT IS HEREBY DECLi"_RED AS FOLLOWS:
1, Declarant considers that the use and occupancy of
all of Lot 6 of Tract 5787* which formerly was a part of Tract
4064, for a fire station and other public uses, would be a bene-
fit to the tract and consistent with the plan of development
set forth in the Declaration and Amended Declaration. Whatever
development standards are imposed and required by the City Of
Huntington Beach shall be deemed to be in full compliance with

the covenants set forth in the Declaration and Amended Declar-
ation, notwithstanding any contrary covenants contained there-
In, It being the intent of declarant to allow the development
of said Lot 6 of Tract 5787 in accordance with any and all re-
quirements of the City of Huntington Beach, California.
2. The covenants, conditions, restrictions, reserva-
tions, easements, liens and charges set forth in the "DECLARA-
TION OF COVE'NAN1_'39 CONDITIONS AND RESTRICTIONS," executed by
PEDIGO PRODUCTS, INC. , and FREEWAY INDUSTRIAL PARK on August
18, 1964 at pages 266 through 275, inclusive of Book 7186 of
the Official Records of orange county and in the Amendment of
Covenants, Conditions and Restrictions on Tract 4064 and apli-
cation thereof to Tract 5787 executed by FREEWAY INDUSTRIAL PARK
and PEDIGO PRODUCTS, INC. , on December 299 1965 and recorded
as Instrument NO. 1941 on February 29 1966 at pages 696 through
701, inclusive, Of Book 7829 of Official Records of Orange
County, henceforth shall not apply to Lot 6 of Tract 57872 and
are hereby waived, remised and released forever.
