The aforesaid easement is granted subject to the 26 right of said Grantor, its successors and assigns, to construct, 27 maintain, use, operate, alter, add to, repair, replace, 28 reconstruct and/or remove in, on, over, under, through, along 29 and across the above-described real property, electric transmis- �► 30 sion and distribution lines and telephone lines, together with 31 supporting structures and appurtenances, for conveying electric 32 energy for light, heat, power and telephone purposes, and -1- CtiiNAL I pipelines and appurtenances for the transportation of oil, 2 petroleum, gas, water or other substances. �J1 3 2. Said easement shall be so exercised as not to 4 interfere with the construction, maintenance, use, operation, , N 5 presence, repair, replacement, relocation, reconstruction or 6 removal of such electric transmission, distribution or telephone 7 lines or pipelines. 8 3. Grantee, by the acceptance of this instrument, 9 agrees to hold harmless and indemnify Grantor, its successors 10 and assigns, from and against all claims, demands, actions, loss, 11 damage, expense and liability, arising from or growing out of 12 loss of or damage to property, or injury to or death of persons, 13 resulting in any manner whatsoever, directly or indirectly, by 14 reason of the exercise of the rights hereby granted, except for 15 acts of negligence on the part of Grantor. 16 4. Grantor shall not erect or place at any future 17 time any of its facilities so as to interfere unreasonably with 18 the Grantee's use for public road and highway purposes of the 19 land affected by the easement hereby granted. 20 5. Grantor reserves for itself, its successors and 21 assigns, the right to trim any tree or trees which may grow in 22 or on the real property which is the subject of this easement, 23 and which in the opinion of Grantor, its successors or assigns, 24 endanger or interfere with the proper operation or maintenance 25 of said electric transmission, distribution and telephone lines, 26 to the extent necessary to prevent any such interference or 27 danger. 28 6. The above-described property is to be used for 29 public road purposes only, and in the event said land is not 30 used for public road purposes, or if the project for the 31 construction of said road and appurtenant facilities is aban- 32 doned, or in the event said land shall hereafter be vacated as -2- ORIGINAL I a public road, it shall thereupon revert to said Grantor, its 2 successors and assigns. flb 3 7. The rights hereby granted are not necessary or 4 useful in the performance of the duties of said Grantor to the 5 public. 6 8.
