SYDNEY SHER AND SYLVIA SHER, his wife; SAUL SHER AND
DOROTHY SHER, his wife; and the HUNTINGTON BEACH COMPANY, a cor-
poration organized under the laws of the State of California
hereinafter called the GRANTOR hereby grants to the CITY OF
HUNTINGTON BEACH, a municipal corporation hereinafter called the
CITY, subject to the limitations hereinafter set forth, an easement
for a public water line to service a fire hydrant under the surface
of the following described real property in the City of Huntington
Beach, County of Orange, State of California.
A strip of land, 10. 00 feet in width, lying within Block D, Tract
No. 7, as shown on a map recorded in book 9, page 8, of Miscell-
aneous Maps, records of Orange County ' California, the center
line of which strip of land is more particularly described as
follows
Commencing at the intersection of the centerline of Delaware
Avenue (now Street) and the centerline of Main Street as shown
on the map of said Tract No. 7; thence northeasterly, along the
centerline of Main Street, 1006. 33 feet to a point; thence north-
westerly, perpendicular to the centerline of Main Street, 66.00
feet to a point in the northwesterly right of way in Main Street,
said point being the True Point of Beginning of above mentioned
easement centerline; thence continuing northwesterly along last
described line, perpendicular to the centerline of Main Street,
242. 37 feet to a point; thence West 79.63 feet to a point. The
side lines of each course of said easement shall be prolonged or
shortened to intersect the side lines of the other::course.
EXCEPTING and reserving unto GRANTOR, its successors and
assigns, for its and their benefit and the benefit of its and their
present and future subsidiaries and their respective successors and
assigns, the right at any time and from time to time, and at any
place or places, to-lay, construct, reconstruct, replace, renew,
repair, maintain, operate, change the size of, increase the number

of and remove pipe lines, and appurtenances thereof for the trans-
portation of oil, petroleum, gas, gasoline, water or other substances,
and to construct, maintain, operate, repair, renew, add to and remove
poles and overhead and underground wires, conductors, cables and
conduits, and appurtenances thereof, over, under, and along said
parcel and further reserving the right to free and unobstructed
use of said parcel for driveways, parking, and pedestrian and ve-
hicular traffic and the construction of buildings thereon; and the
City expressly covenants by the acceptance of the herein easement
that the rights so reserved may be so exercised during all said
times but in such manner as to not interfere unnecessarily with
the use of said easement for the purpose of installing a fire
hydrant at the terminus of the above described parcel.
Grantor further reserves the right to relocate said
easement and any water line constructed thereon provided that the
fire hydrant to be located at the terminus of the above described
parcel is located in substantially the same area.
This grant of easement is given and made for so long as
said pa-rcel shall be used continuously for a fire hydrant water
line and said easement shall terminate without further act by
GRANTOR or its successors and assigns upon the cessation of such
use for a period of six (6) months.
The City expressly covenants that the installation of
the water line and repairs and maintenance thereof, including the
surface of the parking lot situate on the surface of said parcel,
shall be the obligation of the City and the installation and repair
of said water line shall be performed in such manner as to not un-
reasonably interfere with the use of the areas adjacent to said
parcel.
This grant of easement is given subject-to all valid and

and existing licenses, leases, grants, exceptions and reservations
and encumbrances affecting said premises, but more particularly
subject to the exceptions, reservations limitations and covenants
hereinbefore made, and each of them.
IN WITNESS WHEREOF, GRANTOR has executed this grant of
easement this 5th day of February 1970.
