The Estate conveyed herein is a fee simple defeasible upon the
condition that, if the property is used for any purpose other than
the operation of a public park, playground, and recreation facility
for the beneficial use of all residents of the County of Orange,
the entire estate conveyed herein, and all improvements thereon,
shall automatically revert to the GRANTOR without any further
action necessary on the part of the GRANTOR.
If at some future time the GRANTEE desires to free the property
or any portion thereof from this condition, GRANTEE shall pay
to the GRANTOR an amount equal to fifty percent (50%) of the fair
market value of the property from which the GRANTEE desires the
limitation removed. Said market value shall be the market value
of the land only and shall be valued as of the date the limitation
is removed.

Acting Mayor Green called the regular meeting of the City Council of the
City of Huntington Beach to order at 4:30 P'clock P.M.

The .City Administrator informed the Council that the City had recently
chased approximatel 27 ages of former County Refuse Disposal Station
#16 for Edison Corm i y Park. He stated that the City had acquired an
additional 4.59 acres from Getty Oil Company, and that 5 acres had been
sold to the Huntington Beach Elementary School District for use as a play-
ground per conditions of the County sale to the City. Mr. Rowlands further
informed the Council that under conditions covering the sale of property
from the County to the City, that property must remain as a parks and
recreational facility in perpetuity, and that the City was first instructed
to obtain a waiver of ths" condition `based on the mutual aid concept of
the Fire Stsatiot. He stated that such waiver was not acceptable to the
total Board of Supervisors due to precedent and they have, therefore, re-
quested the City to deed '4,500 square feet of the Getty property to the
County in exchange for "4,500 ,square feet of the dump site. He stated that
the Getty property would thel be deeded back to the City with the Parks
use res riotiont and' that this was a paper transaction which has been
reviewed by the City Attorney who sees no legal objection to the process.
Mr. Rowlands farther informed Council that the Board of Supervisors, in
order to expedite the process to allow construction, filed a "Notice of
Intent to Trade Property" on March l/#, 1972, with a request that the City'
adopt the ounce t. Mr. Rowlands then stated that it was his recommendation
that the Council ddopt the trade concept in principle, and authorize the
Mayor and City Clerk to execute the necessary documents.
On motion by Shipley, Council adopted the trade concept in principle, and
authorized the mayor and City Clerk to execute the necessary docuts
by the following roll call vote:
AYES: Councilmen: Shipley,; Bartlett, Green, Coen
NOES: Councin: None
ABSENTS Councilmen: Gibbs, Matney, McCracken
On motion by Shipley, the regular meeting of the City Council of the City
of Huntington Beach adjourned at 8:15 P.M. The motion was passed by the
following vote:
AYES: Councilmen: Shipley, Bartlett, Green, Matney, Coen
NOES: Councilmen-, stone

I RESOLUTION OF THE BOARD OF SUPERVISORS
2 OF ORANGE COUNTY, CALIFORNIA
3 May 10, 1972
4 On motion of Supervisor Baker, duly seconded and carried, the following
5 Resolution was adopted:
6 WHEREAS, a public hearing has been held this date to permit the City of
7 Huntington Beach to construct a fire station on certain property which has been here-
8 tofore conveyed by the County of Orange to the City of Huntington Beach limiting the
9 use of the property for park and recreation purposes; and
10 WHEREAS, the City has agreed to impose a similar condition on adjacent property
11 of the same size limiting the adjacent property to park and recreation purposes;
121 NOW, THEREFORE, BE IT RESOLVED as follows:

13 I 1. The Chai.rman.of this Board is hereby authorized to execute on behalf of the
J 14 � County of Orange a Quitclaim Deed to the City of Huntington Beach for Parcel PM 109-4
