NO. 114-186-22 THIS INDENTURE made the 22nd day of September 1978 between ROBERT L. CITRON, Tax Collector of the County of Orange, State of California, first party, and the City of Huntington Beach second party,witnesseth: THAT WHEREAS, the real property hereinafter described was duly sold and conveyed to the State of California for the non-payment of taxes which had been legally levied and which were a lien upon said property;and WHEREAS, in conformity with the provisions of Division 1, Part 6,Chapter 8,Article 2 of the Revenue and Taxation Code of the State of California, by agreement therein authorized, first party agreed to sell to second party and second party agreed to purchase from first party the land hereinafter described; NOW, THEREFORE, the said first party in consideration of the premises and in accordance with the law in such case made and provided,does hereby grant to the second party,for the sum of b4 SEVEN HUNDRED DOLLARS that certain real property hereinbefore referred to, and situate in the County of Orange, State of California,more particularly described as follows,to wit: Lot 49 in Tract No. 45, as per map recorded in Book 9, Page 34 of Miscellaneous Maps , records of Orange County. AP 110-186-22 TRA 04-010 T. C. SALE #1246 This conveyance is made and accepted upon the following express conditions: 1. That within 10 years from September 22, 1978 CITY will either devote said property to public parks purposes or reconvey the property to the State of California; 2. That CITY will not offer the property for sale at any time during the ten-year period prescribed in 1 above; 3. That in the event CITY fails to devote said property to public parks purposes within the ten-year period prescribed in 1 above, or CITY desires to divest itself of said property within said ten-year period, CITY will execute a deed to the State of California reconveying to the State all the right,title and interest of the State in the property which CITY obtained by this Deed.Thereafter,such property shall be held as tax-deeded property by the State; Provided, that a breach of any of the foregoing conditions shall cause said property to revert to the State of California and the State of California shall have the right of immediate re-entry upon said property, to be exercised by and through its agent the Orange County Tax Collector,in the event of any such breach.
