STATEMENT OF ISSUE:
Transmitted for Council consideration is an outline of the issues
being negotiated as part of a Development Agreement for the
Holly-Seacliff area between the City of Huntington Beach and the
Pacific Coast Homes.
RECOMMENDED ACTION:
Motion to: "Continue negotiations with Pacific Coast Homes for the
purpose of drafting a Development Agreement for the Holly-Seacliff
area and direct staff to set a public hearing before the Planning
Commission on September 18, 1990. "
ANALYSIS:
Traditionally, A development agreement is a contract between the
city and developer that provides assurance to the developer that
existing regulations and policies, in effect today, will apply in
the future. In exchange for this commitment, the city should
receive benefits that it would not typically derive through standard
development exactions.
The ability for cities to enter into development agreements was
written into state law because the state legislature recognized that
there is a lack of certainty in the approval of development
projects . This results in a waste of resources, escalation in the
cost of housing and discourages investment in, and commitment to,
comprehensive planning.
On February 1, 1990, Pacific Coast Homes proposed the idea of a
development agreement to the City for the Holly-Seacliff area. In
June, 1990 , Pacific Coast Homes outlined in a letter to the City
Council, their basic premise for the agreement .
