In accordance with Huntington Beach Municipal Code Chapter 245,the items listed below do not constitute liens or encumbrances that would conflict with the intended use of the property to be dedicated for street purposes: l. Offeror expressly conditions the above Offer to Dedicate on the final approval and recordation of Lot Line Adjustment 97-3 and such offer shall be of no force or effect unless and until the recordation of Lot Line Adjustment 97-3. 2. This Offer to Dedicate is an easement for the use of real property and shall not express or imply any obligation now or in the future by Offeror to construct and maintain any street improvements or incur any other costs in connection with the dedicated land. 3. Offeror reserves the right to continue all present lawful uses of said land and to maintain any improvements presently located within the dedicated portion of said land until the City commences construction of street improvements on said land. The City shall give Offeror at least 90 days written notice of the date it intends to commence such work. 4. This Offer to Dedicate shall be binding on and shall inure to the benefit of Offeror and its successors and assigns and City and its respective successors and assigns.
