Bye- CITY OF HUNTING ON BEACH% 11✓` " By _ .� Its1 -- Dated: EASEMENT DEED FOR PEDESTRIAN OVERPASS PURPOSES THIS EASEMENT DEED FOR PEDESTRIAN OVERPASS PURPOSES ("EASEMENT") is entered into by and among the REDEVELOPMENT AGENCY OF THE CITY OF HUNTINGTON BEACH; a public body, corporate and politic ("Agency"), and the CITY OF HUNTINGTON BEACH, a municipal corporation of the State of.California ("City"), ' as of the IST4 day of 2000 ("Effective Date"). RECI-TALS A. Agency is the fee owner of record of that certain real property located in the City of Huntington Beach, County of Orange, State of California, legally described in Exhibit "A", attached hereto and by this reference made a part hereof("Property"). B. On or about September 14, 1998, Agency entered into-that certain Amended and Restated Disposition and Development Agreement ("DD'A"), which provides that, among other-. things, Agency will take the necessary steps to facilitate the construction of any pedestrian overpass contemplated by the approved Commercial Site Master Plan (as more particularly described in the DDA). - g:/jmf/99Agree/Pedestrian Easement/!05/03/00 7 NOW, THEREFORE, in consideration of the above Recitals, the covenants contained herein, and for other,good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Agency does hereby grant to City an easement in, on, over, under, across, and through that`portion of the Property as'described on Exhibit "B", attached hereto and by this reference made.a part hereof, for the purpose of enabling City to facilitate a pedestrian overpass and improvements and facilities appurtenant thereto, with the improvements and facilities to be substantially as described in Conditional Use Permit 98-53 with Variance 98- 22 approved by City on January 26, 1999, and as illustrated on the drawings attached hereto as Exhibit "C", attached hereto and by this reference made,a part hereof, and further, Agency does . hereby grant to City an easement in, over, across and.through that portion of the Property as described on Exhibit "D", attached hereto and by this reference made a part hereof, for the purposes of providing public pedestrian access from the adjacent public sidewalk at Pacific Coast Highway to said pedestrian overpass on walkways located within that portion of.-the Property described on Exhibit"D".
