FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, SHEA VICKERS
DEVELOPMENT, LLC ("Grantor") does hereby GRANT to the CITY OF HUNTINGTON BEACH, a
municipal corporation ("Grantee"),I a perpetual, nonexclusive easement and right of way for underground
waterline purposes in, on, over, under and across all that real property in the CITY OF HUNTINGTON
BEACH, County of Orange, State of California, described as follows:
SEE ATTACHED EXHIBITS "A" AND "B" ATTACHED HERETO AND MADE A PART THEREOF.
Grantor shall have the right to reasonable use and enjoyment of the real property that is subject to the
easement, including but not,limited�to the construction of parking lots, curbs, fences, walls, gates,
walkways and landscaping on the property. Grantee shall be permitted to remove such landscaping or
improvements as reasonably 'required to maintain the waterline; provided that Grantee replaces such
landscaping and improvements to substantially the same condition that existed before removal.
