GATES, City Attorney a DATE: July 6, 2016 SUBJECT: Mola Development OPA Deed from Successor Agency to City RLS 16-5332 The Office of Business Development requested that the City Attorney's Office review-the ab4,4- referenced OPA regarding the transfer of certain property from the former Redevelopment Agency to the City. On April 15, 1985 an Owner Participation Agreement was entered into between the Redevelopment Agency of the City of Huntington Beach and the Mola Development Corporation for the Charter Centre Project. Section VII-D (704) of the OPA states that after the completion of the public improvements (street paving, curbs, gutters and sidewalks) and following the property conveyance by Mola to the Agency, the Agency shall convey said property to the City. The Mola Corporation transferred title to the Agency in May of 1988, upon completion of the offsite improvements. For unknown reasons, the Agency did not transfer the property to the City and still holds title today. To clear up this matter and finalize the conveyance, it has been proposed that the Successor Agency (as the Redevelopment Agency's successor-in-interest) execute and record the attached quit claim deed in favor of the City. This would appear to be the simplest way to effect the intent of the original OPA and have title to the area properly vested in the City. Therefore, we have "approved as to form" the attached quit claim deed to effectuate the conveyance originally contemplated by the OPA.
