Pursuant to a -call of the President a copy of which is SPECIAL attached and made a part of these minutes the Special Meeting was called to order at 2:00 P. M.. by- President Ridenour. Trustees present: Wharton, Boster, Drew, Ridenour. ROLL CALL Trustees absent None. The President advised the Board that the Special meeting PRESIDENT ADVISES had been called for the purpose of'- appointing- a successor to PURPOSE OF NBET- Trustee J. H. Macklin, resigned,. and asked nominations. • ING. Trustee Drew seconded by Trustee Wharton moved that H. T. Dunning be .appoir_ted to serve the balance of the term of H T DUNNING AP- J. H. I,Zacklin which was carried and the Clerk was instructed POINTED TRUSTEE to administer the oath of office to Mr. Dunning as soon as requested to do so. The matter of employment of special counsel in defense of the Board at the mandamus suit to be. heard in the Superior Court June 26th, was discussed. On motion by Trustee Wharton seconded by Trustee Drew the City Attorney was instructed to represent the Board in the mandamus suit and was authorized to employ SPECIAL COUNSEL additional: counsel if in his opinion the same was necessary, ALLOWED FOR 11,4AN- which was carried. On motion by Trustee Drew seconded by Trustee DA1v1US SUIT Wharton the special compensation of the City Attorney for the mandamus suit was fixed at $200.00 for a retainer and $25.00 per day 'for each day in Court, which was carried. On motion by Trustee Wharton seconded by Trustee Drew the same fees were -_ fixed for additional counsel if . required which was carried. == The.' Clerk read a communication to the Board signed by TRANSFER OF FUNDS himself stating that a profit of some $12,000 had been realized FROM GAS TO in the past year in the Gas Department and recommended that GENERAL $10,000 be transferred from the Gas Fund to the General Fund which was approved on motion by Trustee Boster seconded by Trustee Drew. The Clerk read a communication to the Board signed by himself stating that during the present fiscal year the cost of the Municipal Auto Park had been charged to the Music and TRANSFER OF FUNDS Promotion Fund amounting to ;p"11,360.26, and that after careful FROM MUUNIC AUTO consideration and consultation with the City .Attorney he had PARK TO GENERAL concluded that the charge properly, b,elonged in the General fund for the reason that the Auto Park would be a public service enterprise and charge would be made for service rendered. He therefore asked authority to change the distribution previous- ly made by charging the General Fund and Crediting Qusic and Promotion with the above amount. He also asked approval of correcting the entry covering ASSESSMENT OF the assessment for paving Fifth Street and lighting. Sixth Street PARK SITE CHANGED adjacent to block 505 which is the Park site in the rear of TO MUUSIC & PRO119. the City Hall, he having charged $1785,72 to the General Fund instead of Music and Promotion. On motion by. Trus tee Aarton seconded by Trustee Drew these correcting entries were approved. This having completed the business for which the Special ADJOURNMENT call provided the Board adjourned on motion by Trustee Wharton seconded by Trustee Drew.
