ROLL CALL Trustees present: Wharton, Dunning, Boster, Drew, Ridenour. - Trustees absent None.. . President Ridenour announced that this was the time for hear- TIME FOR HEARING ing appeals from the determinations -of the Street Superintendent APPEALS FOR or City Engineer ir__. the matter of assessment for the improvement SEVENTH SIT of Seventh Street from Ocean Avenue to Palm Avenue and asked if any appeals had been filed. The Clerk informed the Board that there were no appeals filed prior- to the date set for hearing same but that a protest signed by five (5) persons had been filed at 8:03 P. M. , July 6th, 19'25. r President Ridenour then asked that it be read. The President SEVENTH ST PROTEST- then asked if any one present wished to present any protest in ED the matter. No one answered. President Ridenour then asked if any of the signers of this protest were present and desired to DISCUSSION present evidence in .support of their objections to the approval of the work on Seventh Street from Ocean Avenue to Palm Avenue. The President asked Mrs. S. T. McLean if she had any evidence to offer. She replied that she did not. The President also asked Mr. McLean if he had any evidence to offer. He replied that his ENGINEER BILLINGS evidence was all in the written protest. It appeared that none STATES l�'ORK IS of the other signers of the protest were present. Trustee Dreg DONE IN ACCORDANCE asked City Engineer Billings vhat he had to say about the quality truITH SPECIFICATIONS of the work done on Seventh Street from Ocean Avenue to Palm Avenue and 4r. Billings at this time presented a letter which he asked to have read which .stated that the work had been done in accordance with specifications and had been carefully super- vised. Trustee Dunning asked the Engineer if complete reports for the construction of this work were on file. Mr. Billings stated they were. Trustee Drew asked if all reports show that the work COMPLETE REPORTS was done according to specifications. Mr. Billings replied that FOR 'lWORK ON 7TH he had an inspector on the street and one at the asphalt mixing ` STREET ON FILE plant during the carrying on of the work and that screen tests were frequently made and that if there was any reason for changes in the mixture they were ordered. Trustee Drew seconded by Trustee Wharton moved that the PROTEST URRUI`ED N22* otest be over-ruled which was carried, therefore Resolution dismissing appeals and ordering the warrant for the work on A 4 RESOLUTION DOP Seventh Street was read, a copy of which is .on ff le in the office PASSED AND ADOPTED of the Clerk and on motion by Trustee Drew seconded by Trustee Wharton was passed and adopted by the follozing vote: Ayes: Trustees >7,harton, Dunning, Boster, Drew, Ridenour. Noes: None. Absent: None. RESOLUTION #523 Resolution #523 approving the assessment and ordering the warrant for the work on Seventh Street from Ocean Avenue to Palm PASSED AND .ADOPTED Avenue was read, a copy of vhich is on file in the office of the Clerk and on motion by Trustee Dunning seconded by Trustee Drew was passed and adopted by the followkng vote: Ayes: Trustees Wharton, Dunning, Boster, Drew, Ridenour. Noes: None. Absent: None. A communication from G. la. Souter was read - asking for a G. M. SOUTERb 90 days extension of his contract for the improvement of Seventh GRANTED 90 DAYS street from Ocean Avenue to Palm Avenue. This extension was GRAN TED 9 OF CON- granted on motion by Trustee Drew seconded by Trustee Vd'hartonEXTE , TRACT by a unanimous vote. • The Clerk submitted a letter from the Southern Counties Gas Company calling attention to; an omission in the Gas Contract GAS CONTRACT recently entered into with this City, of a paragraph required by REFERRED TO CITY the Railroad Commission which provides for their jurisdiction. ATTORNEY On motion by Trustee Boster seconded by Trustee Drew this communica- tion was referred to the City Attorney for report at the next meeting. D r - 16 I.Iinutes Continued July loth, 1925. The matter of aurarding the sewer contract was again brought , up. and City Engineer Billings reported that he had. made some Resolution #524 AWARD- inquiry as to the responsibility of Mike Radish,. the low bidder ING SEVER CONTRACT and. had a very good_ report, therefore Resolution #524, awarding TO MII E RADICH the . sewer contract .to Mike Radich was read, a copy of which is on file in the office of the Clerk and on motion by Trustee Boster seconded by Trustee Wharton was passed and adopted by the following vote : Ayes: Trustees Wharton, Dunning, Boster, Drew, Ridenour. Noes: None. , Absent: None. A communication signed by A. M. Huston was .read stating that W. R. Wha-rton was .disqualified as a City Trustee on the grounds that he was not a resident of the City and for this reason all acts of the Board since June 20th were null and A. M. HUSTON IS ADVISED void. Trustee Dunning asked what wasthe limit of time for a Two R. WHARTON IS STILL Trustee to be absent from the City or State and the City RESIDENT OF CITY Attorney advised him that 90 days was -the limit except by permission of the Board. Mr. 14harton' stated that he still maintained his, residence in Huntington Beach even though his business called him away,--a portion of the time . On motion by Trustee Drew seconded by Trustee Boster Mr. Hustons communication was placed on file . ADJOUR11IdIENT On motion by Trustee Drew seconded by Trustee Boster the Board adjourned.
