HomeMy WebLinkAbout1926-05-06 223 CITY HALL , May 6, 1926. Pursuant to adjournment of May 3rd, the meeting was called to order in the Council Chamber of the City Hall at 8:00 PM by President Boster. Members present: Wharton,Mitchell ,Harris , Boster. Absent: Trustee Ridenour. In the absence of W.R.Wright, City Clerk, the chair appoint- ed Trustee W.R.Wharton to act as clerk of the Board pro-tem. • Applications for The chair informed the Board that the first order of busi- Permits ness would be the consideration of applications for permits , thereupon the following applications were taken under consideration: r Foster <x Kleiser Application of Foster & Kleiser to erect a sign along the Signs. Coast Highway located approximately seven tenths of a mile south easterly from Main Street, demensione to be 4 panels 101x 25 ' valued at $200. A.B.Dinsmore Application of Mr. and Mrs. A.B.Dinsmore to erect a sign Sig 2'x4:' . on private property at the corner of 5th and Ocean Ave. ' for the purpose of advertising the Evangeline Hotel. Committee Appointed Upon motion by Trustee Harris, seconded by. Trustee Mitchell , to draft ordinance governing signs . and unanimously carried, the Chair was given permission to appoint a committee to draft and submit a new sign board ordinance govern- ing the erection of signs and that the two above named applica- tions be taken under advisement pending the adoption of the ordinance. The chair thereupon appointed Trustees Wharton and Mitchell and Attorney The�dieck to act on the Committee. Mutual Gasoline Co. , At this time the applicatil&n A pipe line permit by the Pipe Line Permit. Mutual Gasoline Company was considered and discussed and after some discussion the following motion was put by Trustee Mitchell and seconded by Trustee Harris: "That the application of MUTUAL GASOLIZ:E COMPANY be allowed and that 4 permit be issued tG the applicant, in accord- ance with the Ordinances of this city, and the description of the work presented with the application, upon the following express conditions: lst. . . That the applicant enter irto,execute and deliver a contract with the City of Huntington Beach, before the issum2ce of said permit, prepared by the City Attorney and approved by the Board of Trustees, containing the following conditions: (a) That the applicant shall pay to the City of Huntington_ Beach one and one quarter cents per thousand cubic feet for all gas sold , delivered , or furnished by Mutual Gasoline Company within the limits of the City of Huntington Beach, from whatever source the same is obtained , except such gas as shall be delivered a to applicant by Southern Counties Gas Company, a corporation. 224 CITY HAM, May 6 , 1926. Mutual Gasoline Co . , (b) That the above provision (a) shall include all gas sold, Pipe Dine Permit delivered or furnished, either directly or indirectly by applicant other than gas consumed by applicant in his own operations, and that received from Southern Counties Gas Company, within the City. (c) That all such gas shall be measured by meter system in- stalled under the inspection of the City Engineer, and monthly statements and payments made and rendered to the City of Hunting - ta n Beach therefor. (d) That the permit be revocable at any time upon thirty days notsce in writing to the applicant. (e) That no interest or right given by said permit shall be assigned or transferred without the consent of the Board of Trustees. " The chair at this time declared a short recess for the purpose of auditing and signing demands. Mutual Gasoline Co. The meeting was again called to order by the Preeidait, Pipe ' ine Permit and by permission_ of the Chair, Attorney H.Schwartz was allow- ed to speak on the above motion relative to application for permit by_ Mutual Gasoline Company. In substance Mr. Schwartz ' contention_ was that the Mutual Gasoline Company was acting in a capacity similar to that of a sole owner of a producing gas well and gasoline absorption plant combined , and that returning dry gas to the boilers or plant of the producer did not constitute a sale and therefore not in competition with the City of Huntington Beach Gas Department. Both Mr. D.R-White and W.L.Refenberck representing the Mutual Gasoline Company made short takke in accordance mi th those made by their attorney Schwartz. The chair informed the representatives of the Mutual Gasoline Company that the Board had no intention of being un- fair with their Company in its operations, but was still of the opinion that a charge should be made for the return of all dry gas within. the City limits of Huntington Beach. With the consent of his second, Trustee Mitchell withdrew his motion_ to allow the application of the Mutual Gasoline Company and the matter was again laid over for further investigation with the consent of all concerned. The Chair then informed the representatives of the Mutual Gasoline Company that the Board would meet with them for further discussion at 7 :30 o ' clock PM, Tuesday, May the llth,1926 , which was agreed to by Attorney_ Schwartz. Paring limit on Main St. Trustee Harris stated that some of the business folks along discussed. Main Street were complaining about the time automobiles were standing parked in front of their stores and were asking that a time limit be made by ordinance. After some discussion_ the chair informed those present that if a petitinh was presented , the Board by interested parties, the matter would receive due con- 225 CITY HALL MAY 6, 1926. sideration, but warned tham that the adoption of such an ordinance would necessitate the employment of additional police to properly enforce the ordinance. Regulating Drilling operation of oil wells was given its second and final reading, Operations. and on motion by Trustee Wharton seconded by Trustee Harris was adopted by the following vote: Ayes- Trustees Wharton., Mitchell , Harris, Boster, Noes-- Trustees None Absent- Trustee Ridenour. Resolution No.553, The Clerk read Resolution No. 553 confirming appointment Appointment of John P.Walker to by the Board of John P.Walker of Long Beach, California to audit Audit City Books, t2E City Books and on motion by Trustee Mitchell , seconded by Trustee Harris was adopted by the following vote: r Ayes - Trustees Wharton, Mitchell, Harris , Boster, Noes- None Absent- Trustee Ridenour. ` Appointment of A waitten request signed by Maggie G-Moore , J.Ed Huston, Mrs-Mae Jackson, C.P.Patton and Luther Arthur reed mmending the appointment of Library Board . Mrs. Mae Jackson_ to fill the place on the Library Board made vacant by the resignation of Clark Reid was read by. .the Clerk and on motion b;, Trustee Mitchell , seconded by Trustee Harris and carried , Mrs. Mae Jackson was. made a member of the Library Board. Painting of three. A comm::nication addressed to the Board bj Chief Tinsley strips on Ocean Ave. recommending painting of three strips on Ocean Ave. was read and on motion by Trustee Wharton, seconded by Trusteeelilitchell , the Street Superintendent was ordered to do the work under the supervision of the Chief of Police. Approval of Julian On motion by Trustee Wharton, seconded by Trustee Harris Pet.Co®Surety Bond. Electrical Contractor. the surety bond of Wilshire Oil Company to engage in the Electri- cal construction_ busine,s was approved. Permit to operate truck On motion. by Trustee Wharton_ seconded by Trustee Mitchell , to haul bait t6 end of Pier. the request of C.i_.Morrison to operate a small truck over the municipal pier for the purpose of unloading , fish bait was granted. Traffic Button at The matter of placing a tutton on Ocean Avenue was referred Main and Ocean Ave. to the Chief of Police to take up with the Auto Club and the Street Department to install under the supervision of the Chief of Police. 226 0ITY HALL May 6, 1926. Cut of Orange Show On motion_ by Trustee Harris seconded by Trustee Mitchell , Display the Advertising Manager was authorized to have a cut made and ' 5000 appropriate cards printed by the Huntington Beach News for distribution at the Anaheim Orange Show May 13th to 23rd, cut to be held for further printing should same be required. H.B.Band Employed On Motion by Trustee Wharton, seconded by Trustee Mitchell , for opening of Orange Show. the. H.B.Municipal Band was employed to furnish music for the opening day at the Anaheim Orange Show. Gas Dept-Salaries The chair called attention to the salary_ schedule of the Gas Department and on motion by Trustee Mitchell seconded p; Trustee Wharton the follow .ng monthly salaries were authorized: Clint Creamer,$200i L.E.Hill , $165; S•A• Smith, $135; C.D.Hooper, $135; Helen Rardir_, $100. , There being no "further business , on motion_ by Trustee Adjournment.
