City Hall , Huntington Beach,Calif.
} Sept . 4th, 1928.
The Council was called to order at 8:00 o' clock P M by
Mayor Bowen.
Councilmen present: Bowen,Conrad,Mitchell,Harris,
Councilmen absent : Butcher.
Butcher absent Mayor Bowen appointed Councilman Harris to act on the
finance committee in the absence of Councilman, Butcher.
At this time, Mayor Bowen announced that Jas S Lawshe,
J S Lawshe representative of the Huntington Beach Company was in the

ocean front property between Third street and Main Street , to be
used by the City of Huntington Beach and its guestsas a play-

camp grounds immediately east of First street. At the time of
execution of these agreements, there was also a verbal agreement
to the effect that the City Council would pass an ordinance
restricting the use of closed `tents on the Beach. Our only
purpose in asking this, was for sanitary reasons. We object to
the use of closed t-ents, cooking and housekeeping on our
property for the reason that it is unsanitary and condusive to
immorality. We do not want people to camp on our property. "
"For some reason, unknown to us, the City Council did not
pass the ordinance agreed upon. Not getting any action from the
City we undertook to. prevent campiing and the use of closed tents.
Last Saturday ( Sept 1st) acting under my orders, our men posted
signs along the beach front , reading ' Closed Tents and "Camping
prohibited on Beach ( signed) HUNTINGTON BEACH COMPANY. " Our
men met imith opposition both from citizens and police. At 5:30
PM the police entered,. destr'oying and removing the signs and
otherwise interfering. "
Ownership claim "We claim sovereign right: and title to all beach front lands
lying between 1st street and 9th street and between the Pacific
Electric Railroad right of way and the mean high-tide line of
the Pacific Ocean. Below first street and above Kineth street we
own jointly with the Pacific Electric Land Company, the title
being in the name of the Pacific Electric Land Co"

Mayor Bowen then asked Chief of Police Steward to explain
Chief Steward what action was taken by the police department and upon what
called authority. Chief Steward informed the Council that their action
was based on verbal instructions from City Attorney Blodget , and
orders were executed by assistant Chief R. Choat .
(Bowen) " Haw meny menodid the Huntington Beach Co have
employed in erecting signs and orderiiig, ,campers off the beach?"
Roy. Patrick (Roy Patrick) " Two , Sam Youngblood and Fred Riley with
myself directing the work. Riley ®sme to me at the time and said
he had been. threatened with arrest"
(Bowen) " Word came to me about noon Saturday to the effect
that the Huntington Beach Company employees were ordering people
from the area between mean high tide line and low water mark,

whereupon I advised the Chief of Police to consult with the City
Attorney and act according to the attorney' s instructio.ns. "
(Blodget) " After having been called by the police department,
I went to the beach and was informed that the Huntington Beach Company
Atty ':Blodget had' a row of guards on the beach front who were running people off
the beach, whereupon, .I) in the name of law and order , advised the
police to take such action as was necessary to preserve peace and. order,
and to insure the rights and priviliges of visitors and citizens"
(Bowen) " I •regret very much that matters have taken . this turn, and
Bowen: Re- especially in vier of the fact that we were doing all possible to
beach acquisition reach an agreement with the Huntington Beach Company whereby the
beach front might become free and undisputed territory for the use
of the citizens of Huntington Beach and its visitors" . '
(Lawshe) " Instances of this kind will put our people in- a
bad frame of mind for making a deal to sell the City a portion'
of the beach front. We claim 165 feet from Pacific Electric rig4t,
of way toward 'nigh tide line and anything between this and actual
high tide line. "
X. Mayor Bowen at this time inquired if there were others in the

The Clerk read the minutes of the Council for meetings of
Minutes August 6th, 20th and 27th, and on motion by Conrad, seconded by
Mitchell, same were approved as read.
Dr K H Sutherland of the Orange County Health department
Dr Sutherland asked and was given permission to address the Council . Dr
Orange County_„ _ Sutherland informed the Council that the -resent contract between
Health Dept the City and his department would expire in the near future and
addressed Council asked that a renewal contract be entered into. The matter was
referred to Councilman Conrad for report at next meeting. Dr.
Sutherland submitted copies proposed contracts and an annual
report of work .done the past year in this City.
Atty Blodget not yet Attorney Blodget advised the Council that he was not ready to
ready with oil Ord. make final report on the proposed oil derrick license.
Mrs Benning The application of Mrs Benning to remove trees from in
remove trees front of Block 704 V D M has held over until next meeting.
the City Attorney was directed to confer with the Chief of
Parking Police and submit an ,amendment or redraft of parking and street
-Ordinance marking ordinance at next meeting.. *
Santa Ana Register The Music & Promotion committee reported no action on matter
advertising of advertising in the Santa Ana Register special edition. ,
Engineer Rosson advised the Council that he had no definite
Rosson., no report recommendations for lighting intersection of Ocean Ave and Main
on Main & Ocean Street , but had the matter up with Southern California Edison
lighting engineers and others.
The Clerk read a letter from Engineer Rosson stating that
Harbor Engineers he hoped to arrange a meeting with the Council and Los Angeles
delayed. harbor engineers in the near future. Mr Rosson informed the
Council that there was no immediate danger on account of the
condition of the pier. }
Engineer Rosson submitted a report on oil sumps on the east
side and recommended that some action be to drain them. He
East Side oil was directed to take up with the Orange County health department
dumps for a solution, also to compile further data on the possibility of
running into the 13th street storm drain.
This being the time set for opening and examining bids
_. for collection and disposal of city garbage, the Clerk opened and
read the following bids:

After a short recess the Council was again called to order by
Mayor Bowen and the following motion put by Conitad "That all bids
be rejected except that of .J ,W McIntosh, and that his bid of
J W McIntosh $150 per month be accepted, and that the Mayor be authorized to
awarded contract execute contract on behalf of the City of Huntington Beach. Motion
seconded by Mitchell, put and carried by the following vote:
Ayes Councilmen Conrad:!! Mitchell, Harris, Bowen.

Absent Councilman Butcher.
Demands On motion by Conrad seconded by Mitchell , demands
numbered 278 to 383 inclusive were approved and ordered paid.
The Clerk read Resolution No 613 fixing the tax tate for
Reso. 613 the fiscal year 1928-29, and on motion by Conrad seconded by
Tax rate. Mitchell Resolution 613 was passed and adopted by the following
vote:
Ayes Councilmen Conrad, Kitchell , Harris, Bowen,

Absent !' Butcher
Councilman Mitchell recommended that the Council make
Adv. for an appropriation for advertising the Orange County Coast
-Cost Assn. Association to the extent of approximately $250. Action was
deferred pending the submission of a written request giving
in detail the manner in which funds were to be used.
On motion by Conrad seconded by Harris the Council a
adjourned until 7:30 PM, Monday September 17th , 1928.
