City Hall, Monday September llth,1933.
Pursuant to adjournment of September 7th, the City
Council met and was called to order at 7:30 P.M. by
Mayor Conrad.
Councilmen present: Marion, Stevens,King,Conrad.
Councilmen absent : Huston.
The--ffa.yor appointed Councilman Marion to act on
the Finance Committee.
:notes The Clerk presented the Minutes of the meetings of
the Council for the month of August, and on motion by King
seconded by Marion, same were approved as read.
v�_`' ncy o:. Councilman Marion addressed the chair and said he

wanted to know if there was a vacancy in the Council.
The chair answered by saying that no resignation had been
received up-to-date, therefore, the presumption was there
was no vacancy.
Councilman Marion asked City Attorney Overacker for
his opinion. Mr. Overacker said that he had. communicated
by telephone with the Assistant Attorney General who was
of the opinion that the offices of postmaster and that of
City Councilman were incompatible.
The chair then asked Attorney Overacker to secure
written opinions from the attorney for the League of
Municipalities and the Attorney General in Sacramento.
Councilman Stevens moved that an officer be sent
and Councilman Huston be brought into the meeting. The
motion was seconded by Marion and put by the chair, Marion
and Stevens voted "Yes", Conrad and. King voting "No". The.
motion lost.
Councilman Stevens made the following motion, I'If
there is a, vacancy on the City Council, 1, move,-. that
Willis Warner be appointed councilman", motion seconded. by
Marion, roll call was ordered -and the result was as follows:
AYES: Marion and Stevens.
NOES: King and Conrad.
ABSENT: Huston.

was taken at this time by the Council.

setting the tax rate for the fiscal year 1933-34, and.
on.motion by King seconded by Marion, same was passed
by the following vote:
AYES: Marion, King, Stevens, Conrad.
NOES: None.
ABSENT: Huston.

The Clerk read monthly reports of the City
Engineer, Superintendent of Streets, Building Inspector,
City Clerk, City Treasurer, City Judge and Chief of
Police, and, on motion by King seconded by Marion, same
were accepted and. ordered filed.

the construction of automobile filling stations and.
gare,ges. This ordinance having been given its first
reading August 14th. On motion by King seconded. by
Marion, the second reading was dispensed with �and. on
motion by King seconded by Marion, was passed. and
adopted by the following vote:
AYES: Marion,King,Stevens, Conrad.
NOES: None
ABSENT: Huston.

:K.TV' C. Lab,ur The Clerk presented and read a letter from John
H. Ead.er, president of the Board of Trustees of the
elementary school, requesting that the city transfer
some of its R.F.C. labor ro the' elementary school.
Councilman King informed the Council that this was
already being done at the present time.
A letter from Building Inspector Overmyer
relative to damaged building oi-ined by L. F. Paresek,
Lot 17, Block 209, was referred, to the City Attorney
for his opinion as to whether or not tree structure
constituted a menace and, if' so, the procedure for
abating same..

The.Clerk presented and read a letter from Bertha
Li unary g,ard
P. Reynolds, secretary of the Library Board, calling the
Council's attention to the vacancy on the Board occasioned
by the expiration of the terms of Mrs. May S. Jackson and
Rev. Luther Arthur. The letter recommended that the above
t,,uo members be reappointed, thereupon the Mayor informed
the Council that the appointment was satisfactory to him,
and on motion by Marion seconded. by Stevens, the appoint-
ments by .the Mayor was confirmed.
A letter signed by the City Treasurer, Bayard Butcher-,
asking that Grace M. Brose be made assistant city treasurer
for the duration of Mr. Butcnerl.s term, was read and on motion..
by Marion seconded by King, the Council approved and ratified
the action of City Treasurer Butcher.
Licences The following licene +pplications were approved;
Health center Cafe, 250 Elmira Street applicant Ada Golden;
Cafe at 427 Main Street, applicant H. T. Rork;
Restaurant at 1508 Olive Avenue, applicant Grace Overocker;
The above applications were approved on motion by Marion
seconded by King.
Licenses The application of John Wright for peddling cigars,
deniPH
lunches, etc; Duncan McPherson for peddling lurches and
J. W. Sullivan for peddling lunches, all on veteran's license,
were denied on motion by King seconded by Marion.

Chi-ef of and Clarence E.E:xline for operating a lunch wagon were referred
j' back to the Chief of Police and health officer for their ap-
proval before being acted upon by the Council.,

to read Class No.- 2, was approved on -motion by King seconded
by Marion.
The application of J. ?r, Sullivan for Class No. 2
beer license was read and referred back to the Chief of
Police for his recommendation.
Flc..er src,ty The application of J. S. Denny, manager of the
Huntington Beach Garden Club, for use of the city auditorium
to stage a flower show October 9th to 14th, was approved on
motion by King seconded by Marion.
The matter of painting the CityHall was referred to
the Building Committee for report at next meeting.

On motion by Stevens seconded by King the City
Controller was authorized to procure a new power lawn
mower for the sum of $275,00 and that the old mower
now in use be turners. in fo.r a, credit of ��0.0�? making
the net price of the new mower $235.00.

VPeenly dances .The Clerk read a letter signed by Jack :6aurice
asking for a permit to use the City Auditorium for
dances on Friday nia,iNt of each week. Mr. Maurice
.proposed to pay the City 305o of the net gate receipts.
The matter was referred. to the City Clerk with permission
to inform Mr: Maurice that he might hold at least two
..dances providing the terms were amended to read 30% of the
gross receipts and that a guarantee Cf. 85.00 be made to the
City for the use of the hall, it being understood that
arrangements for later dates may be made if agreeable to
the Council.
Surety bond On.rriotion by Stevens seconded by King, the surety
bonds of H. C. Sanderson; Homer B. Morgan and Geo. J.
Morgan doing business as the Two Macks Electric Company
and the Petroleum Rectifying Company were accepted and
ordered filed.
V —1 t The City Clerk called the Council's attention to
the need for more vault room and recommended that a
vault be constructed under the opuzer entrance stairway.
After some discussion the Clerk was directed to get
prices on secondhand vault doors and report to the Council
at an early date.
-� On motion by Stevens seconded by Marion, demands
wnn1".•ed approved by the Finance Committee were ordered paid.
On recommendation by Councilman Marion the .Mayor
requested. the City Attorney to look into the matter of
bonding oil companies so as to secure the payment of
wages of their employees and report at next meeting.
LPu-„P of On motion by King seconded by Marion, the Council
appointed City Clerk C. R. Furr and City Attorney Ray,-H.
Overacker to represent the City at 'the California League
of Municipalities meeting to be held in Santa, Cruz
September 18th'to 22d inclusive.

Petition
The Clerk presented and read a petition signed by
approximately 745 citizens asking that the Council appoint
Willis H..Warner to fill the first vacancy that may occur
on the Council.

Mayor Conrad presented and ordered read a complaint
of the people of California vs City of Huntington Beach
and others relative to so called slant drilling in the
Hunting -con Beach oil field, also an order to snow cause.
A motion by Councilman King that the above matter be
referred to the City Attorney to file an answer was lost
for want of a second, Councilman Stevens and Marion
nolaing tnat the matter should be deterred until a later
date.
The Clerk read a letter from C. B. Baldwin, Superin-
tendent of the Elementary School, asking that Sixth Street
between Orange and Magnolia and Eighth Street between
Orange and Magnolia be blocked off for a children's"
playground.
On motion by King seconded by Marion, the request was
granted and the Chief of police directed to erect a
barricade on the above named streets between the hours of
