Councilmen absent : Huston. 'reoNlP of Co-.L Mayor Conrad presented ana ordered read a complaint vs Ci+Ir of W.D. of the people of Calmornia vs City of Huntington Beach et of and others relative to so called slant drilling in the Huntington Beach oil field, also an order to snow cause. A motion by Councilman King tnat the above matter be ` referred to the City Attorney to file an answer was lost for want of a second, Councilman Stevens and Marion nolaing tnat The matter snould be deterred until a later r date, Tne Clerk read a letter from C. B. Baldwin, Superin- Streets for plaggr.o,inds tendent of the Elementary School, asking that Sixth Street between Orange and Magnolia and Eigntn Street between Orange and Magnolia be blocked off for a children's playground. On motion by King seconded by Marion, the request was granted and the Chief of police directed to erect a I! barricade on the above named streets between the hours of ! a 9:30 A.M. and 2:00 P.M. during Monday, Tuesday, Wednesday, R esignati". on J.Li'ri Hut a+c Thursday and Friday of each week. Motion ppt and carried by the following vote: AYES: Councilmen Marion, Stevens, King, Conrad. NOES: None ABSENT: Councilman Huston. The Clerk read a letter from the attorney of the League of Municipalities in which the opinion was expressed that Councilman Huston upon accepting the position as acting postmaster was ineligible to act as City Councilman of Huntington Beach. Attorney Overacker stated that no opinion.had been received from the Attorney General covering this matter. Attorney Overacker concurred in the opinion of the attorney of the League of Municipalities.. The Clerk presented and read the resignation of J. Ed Huston, City Councilman, same to take effect immediately. At this time 8:30 P.M., the Council.recessed. Council again called to order at 9:00 P.M. On motion by Councilman King seconded by Councilman Marion, the resignation of J. Ed Huston was accepted unanimously by the Council. Mayor Conrad informed those present that the Council had been unable to agree upon a successor to fill the office vacated by Councilman Huston and that the Council would meet again on Monday night September l8th at 7:30 P.M. and announce a date for an election. Ralph 'turner addressed the Council and stated that inasmuch. as the total cost would be $1000 to hold an election, he believed that the Council should appoint Mr. Warner to fill the vacancy caused by the resignation of Mr. Huston. Mayor Conrad informed Mr. Turner that a special election would cost approximately $500 and not $1000. C. G. ,Ward spoke in favor of Mr. Warner. . M.A.Turner stated that he thought the Council should agree upon a successor to Mr. Huston and not call an election. E. L. Forney asked the Council why Mr. Warner was not appointed. rw:. On motion by King seconded by Marion the Superintendent' %yro'.i.nd of Streets was directed to close the camp ground immediately with the provision that Mr. & Mrs. W. C. White called the attention of the City Council to a resolution passed by the Chamber of Commerce protesting action takbneby the State of California in interfering with the drilling of oil wells in the Huntington Beach field and asked that the City Council pass a similar resolution. Whereupon the City Clerk read Resolution No. 696, and on motion by Marion, seconded by Stevens, same was passed and adopted by the following vote: AYES: Councilmen.Marion, King, Stevens, Conrad. NOES: None. ABSENT: None. On motion by Marion, seconded by Stevens, the Council adjourned until 7:30 P.I., Monday September l9tn, 1933. City C er and Ex-oftricio C erk of the City Council. Mayor ATTES Ci y Clerk M I N U T E S City Hall, Monday Sept. 18th, 1933• Pursuant to adjournment of September 15th, the City Council met and was called to order at 7:30 P.M. by Mayor Conrad. Councilmen present: Marion, Stevens, King, Conrad. Councilmen absent,: None. Mayor Conrad stated that this meeting was for the purpose of calling a special election to elect a councilman to fill the vacancy in the council caused by the resignation of Councilman J. Ed Huston. He then asked for the reading of a letter from the City Attorney which was , in the hands of the Deputy City Clerk, with reference to the matter. After the reading of the letter it was moved by Marion, seconded by Stevens that the date or the election be set for November 6tn, 1933:, that the City Attorney be instructed to draw up the resolution calling the election for presentation at a meeting of the Council to be held on September 25tn, 1933, and that the City Clerk be instructed to make the necessary ,� election publications. Carried unanimously.
