MINUTES
City Hall, Monday August ''6-), 1934.
The regular meeting of the City Council was called to order
at 8 :20 P.M. by Mayor Talbert.
Councilmen present: Marion,Chamness,Warner, Tovatt,Talbert.
Couneilmen.absent :. None.
Minutes On motion by Chamness seconded by Marion, Minutes for the
month of July were approved as read.
Bids for The Clerk presented and read bids of Edward S. Williams and
Audit
Crenshaw,Diehl and Wright, Certified Public Accountants. The bid of
Edward'S Williams being on a per diem basis of $20.00 per day for
himself and $10.00 per day for his assistants with a maximum fee of
$750.00 for auditing the City°s records covering the period.February
28th, 1932 to July 1st, 1934, together with a general review of
transactions from July lst, 1934 to date. The bid.of Crenshaw, Diehl
and Wright for similar services was on a per diem basis at the rate of
$15.00 per day per auditor with a maximum of $450.00 for the entire
audit. On motion by Warner seconded by Tovatt, the bid of Crenshaw,
Diehl and Wright was accepted and the other bid rejected.
Executive Mayor Talbert stated that the Council had been in executive .
session
session with prospective lessees of the beach tide land but that no
agreement had yet been reached between them.
License Mrs. A. W. Morehouse, Mrs. A. J. PParker and Elmer Forney
addressed the Council objecting to the. manner in which licenses
were being collected. No action was taken by the Council.

Bond On motion by Marion seconded by Chamness,*the surety bond of
W C Moldenhauser and John Schrader, housemovers, was accepted and
: ordered filed.
Machine Shop On motion by,Chamness seconded by Tovatt, the application of
Ernest Koppl to operate -machine shop at the corner of Frankfort and
Alabama was accepted and the License Department directed to issue �•

Monthly reports The Clerk read monthly reports of the City Treasurer, City Clerk,
City Engineer, City Judge, Superintendent of Streets and Police Chief,
and on motion by Marion seconded by Tovatt, same were accepted and
ordered filed.
The Clerk read a letter from Judge Chris P. Pann thanking the
Council for the use of the Council Chamber during the recent hearings,

County of Orange ve the gun clubs._ Same was ordered filed.
Ord. No.375 The Clerk gave Ordinance No.375, repealing building ordinance No.
2262 its first reading at this time. 4

Fireworks The Clerk read a letter from Chief of Police Gelzer recommending
that the Council adopt a resolution.against the use of fire works within
the city limits of Huntington Beach. A number of citizens, some of which
were in favor of the ordinance and others opposed, 4ddressed the Council
and, on motion by Marion seconded by Chamness, the City Attorney was
directed to prepare and submit an ordinance in accordance with Chief
Gelzer°s request..
The Clerk read a letter from the Chief of Police asking the Council's
approval of his appointment of James E Pontius as temporary desk sergeant

to serve while Officer Keller remains off duty on account of accident.
Resolution
On motion by Marion seconded by Chamness, Resolution No.714,
No > 714
authorizing the County Health Department to exterminate pests,was passed
and adopted by the following vote:
AYES: Marion, Chamness, Tovatt, Talbert, darner.
NOES: None.

Complaint---;
A letter from James S. Lawshe was read in which complaint was made

against certain oil companies allowing mud and oil to run in the streets
and drain pipe lines. Superintendent of Streets Wirth informed the Council
that the matter had been taken care of and that he felt there would be no

further violation.
Mrs. Cole :
The Clerk read a letter from C P Patton, President of the Library
appointed
to Lib. Board Board, in which the Council was informed that the term of Mrs. Frank Cole
expired as of June 30th, 1934, and recommended that she be reappointed.
Mayor Talbert informed the Council that he was appointing Mrs. Frank Cole
as a member of the Library Board for a period of three years beginning
July 1st2 1934, and, on motion by Chamness seconded by Tovatt, the ap-
pointment was unanimously confirmed by the Council.
tinsafe City Engineer Overmyer submitted a written report covering unsafe
derricks
oil derricks. The report stated that derrick on Lots 5 and 7, Block 413
had been demolished and the hole cemented off. That derrick located on
Lots 5, 7 and 9, Block 516 had been partially repaired but was still in
need of guying before it was safe. Derrick on Lots 14 and 16, Block 316,
nothing had been done by the owner to make this safe, that a copy of the
notice to repair had been posted on the derrick and a copy been mailed to
the record owner of the derrick but that the mailed copy had been returned
unclaimed.
Councilman Marion stated that the derrick last mentioned is very-
unsafe.and.Mr. Overmyer said it had been so for the past two years. The
matter -was referred to the City Attorney for further recommendation and
report at next meeting of the Councils
The City Attorney, City Engineer and Councilman Marion were asked
to prepare and present a new ordinance governing the construction and

SERi� work - on Engineer Overmyer submitted a report and estimate.covering the
sidewalks
curbs repair of sidewalks. His estimate of $1435.00 covered all material to
repair curbs and sidewalks from First Street to 17th Street inclusive, and
an estimate of $625.00 covered all material necessary to do similar
repair work from First Street to 12th Street on Ocean Avenue, thence on 12th
Street to Orange Avenue, thence on Orange Avenue to 14th Street, thence
on 14th Street to Palm, thence on Palm Avenue to 17th Street, thence on
17th Street to the easterly city limits. All labor to be furnished by the
SERA. On motion by Chamness, seconded by Marion, the Mayor and City Eng-
meet were authorized and directed to make application to the SERA for
the necessary labor to repair sidewalks and curbs as outlined in the
_ w above named estimate.
Claim rejected- On motion by Marion seconded by Tovatt, the claim of Ray P. Watt
Ray P Watt for injury in an automobile accident on May 19th, 1934 was rejected and
__..._. _City Attorney Overacker was directed to so inform the claimant.
Garbage contract The matter of advertising for new garbage contract was deferred
until meeting of Tuesday,September 4th, 1934.
Neon Sign On motion by Tovatt seconded by Marion, the action of the Council
in ordering the installation of the Neon sign over the intersection of
Ocean Avenue and Main Street was ratified and approved.
Demands On motion by Chamness seconded by Tovatt, demands approved by the
Finance Committee were',,ordered paid.
Dodge Truck The Clerk informed the Council that the demand of L. D Coffing
Company in the amount of $1134.05 had not been approved by Chairman
Warner of the Finance Committee. whereupon, on motion by Marion seconded
by Talbert, the demand covering the purchase of a Dodge truck from L. D.
Coffing Company for the sum of $1134.05 was approved and ordered paid.
Councilman Marion, Chamness, Vvatt and Talbert voting "Yes".

Camp fires on Fire Chief Sargent and Police Chief Gelzer were authorized to
beach investigate and recommend some plan for the prevention of camp fires on
the beach between First Street and Main Street and report at next meeting.
Tables & stoves Councilman Chamness said that letters had been received complaining
on beach that visitors use the tables and as stoves on the beach front and that

in some instances individual parties would use the stoves and benches a

committee for its recommendations at next meeting of the Council.
Superintendent of Streets Wirth stated that additional electrical
wiring would be needed in the tent city if campers were allowed to
increase the use of lighting and heating equipment. This matter was
deferred until next season for opening the camp ground.
Superintendent of.Streets Wirth was authorized to proceed with
repairing of sidewalks along Main Street and the business district.
Vacation- On motion by Warner seconded by Chamness, Engineer Overmyer's
Overmyer
request for one week's vacation beginning August 14th, was -granted.

Claim of Tom City Attorney Overacker stated that he had received no further

information relative to the claim of Tom Price for injury sustained
while walking along the sidewalk in the oil field and that he recom-
mended that the claim be denied. On motion by Marion seconded by
Chamness, the claim of Tom Price for damages was denied and the City
Attorney directed to so notify the claimant.
Motion made by Tovatt seconded by Marion that City Engineer Harry
Overmyer be authorized to file membership application with the Pacific
Coast Building Official's conference for the purpose of adopting a
uniform building code for the City of Huntington Beach. The application
to be for ACTIVE PARTICIPATING MEMBERSHIP at a cost of $50.00 per year,
1 motion put and unanimously carried.
New se t of Mr. Crane of , Crane Company of Santa Ana appeared before the Council
sewer rods
with the recommendation that the city purchase a new type of sewer rod.

Both Superintendent of Streets Wirth and City. Engineer Overmyer recommended
the purchase. On motion by Warner seconded by Tovatt, the City Controller
was authorized to purchase of Crane Company a set of sewer. rods complete
with tools for a_sum not to exceed $250.00.
On motion by Warner seconded by Chamness, the Council adjourned
until 7:15 P.M., Monday August 13th, 1934.

There being no quorum prevent at 7:15 p.m., the City Clerk adjourned
the meeting of the City Council until 7:15 p.m. Tuesday A t 14th,1934.
