Pursuant to adjournment of April l:st,,the City Clerk appeared
and opened the council chamber at 7:30 P.M.
There being no quorum present, the City Clerk adjourned the
meeting until 7:30 P.M. Wednesday:April 17th, 1935.

MINUTES
City Hall, Wednesday April 17th, 1935•
Pursuant to.adjournment of April 8th, the City.Council met and
was called to order at 7:30 P_M by Mayor Talbert.
Councilmen present: Marion, Chamness, Tovatt, Warner, Talbert.
Councilmen absent': None.
The Clerk presented and read Resolution No. 724,•accepting
deed to 44.26 acres to be used for sewer plant site and other
purposes and, on motion by Warner seconded by Marion, Resolution
No. 724 was passed and —adopted by the following vote:
AYES: Councilmen Chamness,Marion,Tovatt, Warner, Talbert.
NOES: None.
ABSENT: None.
The Clerk read an application signed by C. K Morrison asking
for the exclusive rights to operate live bait boat from the
municipal pier. After some discussion it was decided to call A. E
Brunner, the holder of similar permit, before the Council and, on
motion by_Chamness seconded by Marion, the Clerk was directed to
notify Mr. -Brunner to appear before the City Council at its
regular adjourned meeting, Monday April 29th, 1935, at.7:30 P.M.
to show cause why his contract should not be cancelled.
-The application of the Christian Science Church to place boxes
for the dispensing of Christian Science Literature in the city camp
ground and under the,pier was accepted -'and the Clerk directed to
notify the Clerk of the church that it would be permissible until
further notice to install the boxes.
Dues -- On motion by Warner seconded by'Chamness, the Council appropriated
Orange Co.
Coast Assin the sure of $25.00 to pay annual dues to the Orange County Coast
Association for the year 1935•

Hampshire Ave. A letter from S. V. Cortelyou, district engineer, outlining
widening
the manner in which Hampshire Avenue is to be widened and
improved and proposing that Mr. Louis.A Griley be employed.at
a salary of $8.00 per day plus automobile expense, was read.
The letter further proposed that the City of Huntington Beach
pay Mr. Griley's salary and expenses and -bill the State for same.
On motion by Marion seconded by Tovatt, the Clerk was directed
to write Mr. Cortelyou and state that the City Council accepted
the terms of his letter of April ll th.
Att'y Whealton Attorney Whealton, representing the Southern California Oil
Producers' Association, addressed the Council relative to
Assembly Bill AB 2392, known as the "State.Compact Bill". \
Mr. Whealton stated that his organisation objected to this bill
because it tends to tie up the resources of California oil
fields with other states and for that reason would not be workable. `I
Mr. Whealton referred back to AB 686, known as the crooked hole
bill and after citing the proposed damage to town lot drilling in
Huntington Beach and other cities, recommended that the City Council -�
go on record as opposed to this bill.
AB 686 The following motion by Marion: "That the City Council of
Huntington Beach go on record as opposing AB 686 in its present
r form, that the city clerk immediately wire Senator Nels T. Edwards,
Speaker of the House Ted Craig and Assemblyman James Utt to the
effect that the City Council opposed the above named bill and
asking their assistance in defeating same". The motion was
seconded by Tovatt, put and carried by the following. vote:
AYES: Councilmen Marion, Chamness, Tovatt, Talbert.
NOES: Councilman Warner.
ABSENT: None.
Councilman Warner stated that he was in sympathy with the action
opposing the bill but preferred to have time in which to study the \�
measure before voting yes on the question.
Street Sweeper Mr, Doneher, representing the Elgin Street Sweeper Company,
addressed the Council and stated.that the city was badly in need
of a new sweeper, that his company would allow $100.00 on the old
sweeper allowing the city to keep same and deliver a new sweeper
to the city for the sum of $7,005.00, less 2% for cash in 30 days.
Superintendent of Streets Wirth informed the Council that it would
cost about $600.00 to repair and maintain the old sweeper during
the next six months. On motion by Warner seconded by Chamness, the
matter was referred to the Street committee.for its investigation
and recommendation at next meeting of the Council.

Wm. Mosley The Clerk was directed to write Wm. Mosley Jones, assemblyman
Jones
and chairman of the oil investigating committee and.inform him that
the City Council room is available for his ..use on any day he wished
to hold a committee meeting.
Fishing Bill
No action of the Council was taken in the matter of fishing bill
now before the legislature.
Calif.sewage
On motion by Marion seconded by Tovatt, Councilman Warner and
Works Assen
meeting
City Engineer Overmyer were appointed delegates to the California
Sewage Works Association meeting to be held in Fresno April 26th and
27th, it being understood that the City is to bear the expenses of
Councilman Warner and Engineer Overmyer while on the trip.
Wideningy
City Engineer Overmyer submitted a report and drawings covering
Frankfort
proposed crossing leading from the east side to.the west side across
the railroad tract and, on motion by Chamness seconded by Marion,

Engineer Overmyer was directed to furnish an estimate and drawing
for improving Frankfort by widening same and the crossing at
Alabama Street.
Pier repairs
The Clerk raad a report from Engineer Overmyer in which he stated
completed
that pier repairs had been made by the contractor in a satisfactory
manner. Councilman Warner moved that the engineer's report be ac-
cepted and that he record notice of completion, that the.contractor's
check be held pending the release of all bills for material used on
the pier and, if such release is not received, to hold check for a

period of thirty-five days following the recording of notice of com-
pletion. Motion was seconded byMa,rion, put and carried.

Street was approved, on motion by Marion seconded by Tovatt.
Memo Hall
Councilman -Warner called attention to the cabinets obstructing
the exit in Memorial Hall, the City Clerk said that same would be

removed.
Councilman Warner read and presented a revised schedule for street
lighting. The report showed that additional lighting could be had and
the cost of same decreased under the new contract with the Edison
Company. It also provided for the installation of 32 refractors
on Main Street, same to cost $320.00.
On motion by Chamness seconded by Tovatt, the report was accepted
and the Superintendent of Streets was directed to carry out the terms
of the report with the assistance of Councilman Warner.
On motion by Warner seconded by Marion, the Street and Pier committee
instructed
were/to investigate the wire screening at the baseball park with a view
of extending same for the protection of the grand stand and report back
at next meeting.

Lease on Councilman Chamness and the City Attorney were asked to

look into the matter of Harvey Walker's lease and report at
next meeting.
Demands On motion -by Tovatt seconded by Chamness, demands approved
by the finance committee were ordered paid.
Weed Resolution Attorney Overacker was directed to prepare weed cleaning
resolution and present at the next meeting of the City Council.
On motion by Warner seconded by Marion, the'Council ad-
journed until 7:30 P.M. Monday April 29th,'1935.
