City Hall, Monday April 20th, 1936.
Pursuant to adjournment of April 6th, the City Council met and was
called to order at 7:00 b ! clock P.1u1. by Mayor Talbert.
Councilmen present: Marion, Chamness, Warner, Tovatt, Talbert.
Councilmen absent None.
Shooting of The Clerk_ read a letter from F D Decker, Long Beach, in which he

Pelicans called the attention of the City Council to:the indiscriminate shooting
of seals and pelicans along the beach. The matter was ordered referred
to the State Fish and Game Commission.
Application On motion by Marion seconded by Chamness, the application of Arthur
H. Schade to operate cafe at the Sea Breeze Camp was accepted and ordered
f iled.
Application The application of Tom Timmons for.position as pier wharf inger and
caretaker of the municipal camp was read and ordered filed.
Application The application of A. J. Parker for position on the police force was
--".read and referred to the police committee of the new Council.
-�, Strip of Land Attorney Overacker informed the Council that Mrs. Stewart asked for
along Frank-
fort payment of $200.00 net to her for the strip of road along Frankfort Street,

that she also stated that the City must stand the.expense of any search of
title. Ids. Overacker stated that it might be necessary to go through con-
demnation proceedings to acquire the land. The matter was referred back
to the City Attorney to continue his investigation and to secure from the
title company an estimate of cost of title search.
Demands On motion by Tovatt seconded by Chamness, demands approved by the
finance committee were ordered paid.
There being no further business to come before the Council in adjourned
session, on motion by Marion seconded by Warner, the Council adjourned.

MINUTES
City Hall, Monday April 20th, 1936
Pursuant to laws governing cities of the fifth and sixth classes,
the City.Council.met and was.called to order at 7:30 P.M. by Mayor
Talbert for the purpose of canvassing votes cast at the General Muni-
cipal Election held Tuesday, April 14th, 1936.

Councilmen present: Marion, Chamness, Warner, Tovatt, Talbert.
r Councilmen absent None.
Canvass of The City Council then proceeded to canvass the ballots of the
ballots
April 14th, 1936 election in accordance with law. After having
examined the records of the April 14th election and declaring the
same to be correct except the following errors which were corrected,
the Council then directed the City Clerk to open and examine the
absent voters' ballots. The errors above referred to were as follows:
.0n.the Election Board's "Result of Votes Cast" Precinct "B" showed
Robert M. Marshall 33 votes, the game record Precinct "D" showed
Robert B. Hosmer 24 votes and Robert M. Marshall 81 votes, whereas
the Talley List for Precinct "B" gave Robert M. Marshall 34 votes
and Precinct "D" gave Robert B. Hosmer 81 votes and Robert M.
Marshall 24 votes. The Clerk was directed by the Council to make
the correction and to make the records agree with the. Talley List.
Absentee The Clerk then presented the envelopes containing absent
Votes
voter ballots and informed the Council that the following ballots
had not been.returned up to 5:00 o'clock P.M. this date: Berl E.
Cady, Ballot #2463 and Lawrence K. Ridenour, Ballot #2479. The
Clerk also informed the Council that no more mail would be received
until 7:30 o'clock A. M. April 21st. City Attorney Overacker in-
formed the Council that it was his opinion that it was not necessary
to wait for the two outstanding ballots before proceeding to canvass
the absent voter ballots. Whereupon the Council proceeded to check
signatures with the Great Register and canvass the absentee ballots
as required by law.. In the canvass it was found that envelope
containing the vote of Earl Brownfield had not been signed by the
voter, whereupon Attorney Overacker challenged the vote for the
reason that it was not properly cast in accordance with law and, on
motion by Warner seconded by Chamness, the challenge was allowed.
The result of the canvass of absentee votes was as follows:

Total 41 votes allowed and one vote challenged and thrown out. The,
Council then proceeded to count the Absentee Ballots.
Resolution
The Clerk then presented and read Resolution #741, the original
#741
of which is on file in the office of the City Clerk and open to
public inspection, same being the City Council's Resolution declaring
the results of the above named election and, on motion by Chamness
seconded by Marion, Resolution #741 was passed and adopted by the
following vote:
AYES: Councilmen Marion, Chamness, Tovatt, Warner, Talbert.
NOES: None.

Vote of On motion by -Marion seconded by Talbert, the Council extended
thanks
a vote of thanks to retiring Councilman Tovatt for his services
during the past two years.
There being no further business to come before the Council,
on motion by Marion seconded by Chamness, the Council adjourned.

Oath of In accordance with law governing cities of the fifth and sixth
Office
classes, Mayor Talbert administered the oath of office to the newly
elected city clerk C. R. Furr. .Whereupon the City Clerk administered
the oath of office to the following newly elected officers: Leland S.
Chamness;Councilman, Arndt L. Henrickson Councilman, Arthur W. More-
--. --- house Councilman and Bayard Butcher City Treasurer.
New -Council trVhereupon each of the above named officials took their seats

around the Council table. The Clerk then called the meeting to
order and announced that the first order of business would be the
election_of a president of the Council to serve during the ensuing
two years.
President Councilman Morehouse moved that Councilman Willis H. Warner.be
appointed
appointed president of the Council for the ensuing two years. The
motion was seconded:by Councilman Chamness, put and carried unanimously.
Mayor Mayor Warner addressed the Council thanking them for the confidence

imposed in him and pledging his best efforts in serving the City during
the term of his office.
Councilman Councilman T. B. Talbert addressed the Council and thanked them for

their cooperation during his term of office as Mayor and pledging his
support during the remainder of his term as councilman.
Appointments- Mayor Warner announced that the first order of business would be

Heads the appointment of the various department heads. There was some discussion
relative to the filing of applications for the various positions and the
Clerk informed the Mayor that no written applications had been filed in
his office.
Whereupon the following motion was made by Councilman Chamness:
"That all appointive offices be and are declared vacant and that applica-
tions by the present holders of the offices be and are considered received
and filed as of this date". The motion was seconded by -Councilman
Morehouse, put and carried unanimously.
City Attly The following motion by Councilman Henric�son: "That Ray H. Overacker
be re -appointed City Attorney at a salary.of $135.00 per month with an
additional allowance of $50.00 per month to cover stenographic expenses.
�► Term of appointment to be subject to the will and pleasure of the City
Council". The motion was seconded by Councilman Chamness: Councilman
Morehouse moved an amendment to the motion making the salary of Attorney
Overacker $100.00 per month instead of $135.00 per month. There being
no second to the motion, the Chair declared the motion lost for want of
a second. Whereupon the original motion was put and carried unanimously.
Chief of Following motion .by Councilman Chamness: "That Police Officer H. L.
Police
Grant be made Chief of Police at a salary of $205.00 per month, term of

appointment to be subject to the will and pleasure of the City Council".
Motion seconded by Councilman Henrickson, put and carried unanimously.
Chief - Following motion by Henrickson: "That J. K. Sargent be re -
Fire Dept.
appointed Fire Chief of the City of Huntington Beach at a salary of
$185.00 per month. Term of appointment to be subject to the will and
pleasure of the City Council". Motion seconded by Councilman Chamness,
put and carried unanimously..
City Engineer Following motion by Councilman-Henrickson; "That Harry.A. Overmyer
be appointed City Engineer at a salary of $205.00 per month. Term.of
office to be subject to the will and pleasure of the City Counc1111.
Motion seconded by Councilman Talbert, put and carried unanimously.
Surat. of Following motion by Councilman Chamness: "That Henry Wirth be

appointed Superintendent of Streets at a salary of $180.00 per month,
term of office to be subject to the will and pleasure of -the City
Council". Motion seconded by Councilman Talbert,:`put and carried
unanimously.
City Judge Following motion by Councilman Chamness: "That C. P. Pann be
appointed City Judge at the salary of $60.00 per month, term of office
to be subject to the will and pleasure of the City Council". Motion
seconded by Councilman Morehouse, put and. -carried, Talbert voting
City Controller Following motion by Councilman Chamness: " "That C. R. Furr be
appointed.City Controller at the salary of $135.00 per month, term
of service subject to the will and pleasure of the City Council".
Motion seconded by Councilman Henrickson, put and carried unanimously.
B1dg.Insp. Following motion by Councilman Chamness: "That Harry A. Overmyer
Sewer Inspt.
etc be appointed building inspector and that Henry Wirth be appointed
sewer inspector, electrical inspector and plumbing inspector. Both
to serve without extra salary and at the will and pleasure of the
City Council". Motion seconded by Councilman Henrickson, put and
carried unanimously.
Councilman Councilman Talbert addressed the Council and those present and
Talbert
stated that in line with recent recommendations, he was in favor of
doing away with the salary of all City Councilmen for the reason that
the position was an honorary opo and that the members thereof should
receive no money consideration for their services.
