HomeMy WebLinkAbout1937-08-20C MINUTES City Hall; Monday, August 20, 1937. Pursuant to adjournment of August 9th,,the City Council met and was called to order at 7:30 P.M. by Mayor Warner. Councilmen present: Morehouse, Chamness, Warner. Councilmen absent : Talbert, Henrickson. County Gas The Clerk read a letter and a copy of a Resolution-by,the City of Tax Santa Ana relative to the County gas tax allotment to cities and protesting against the reduction in amount allowed the cities and, on motion by More- house seconded by Chamness,`Mayor Warner and. --City Attorney Kuchel were authorized to represent.the City at a meeting of the Board of Supervisors cC' Tuesday, August 24th, 1937• Neon sign A letter from the Chamber of Commerce recommending a Neon sign at Five Points was taken under advisement. The request of the Chamber of Commerce to have a stop sign at the intersection of Lake Avenue and Acacia Avenue was referred to the Chief of Police for his recommendation. Neon sign On motion by Chamness seconded by Morehouse, the application of the Southern Counties Gas Company to erect a Neon sign was approved. Special City Attorney Kuchel addressed the Council relative to the matter of Election calling a special election for the purpose of electing a Chief of Police, City Judge and City:Attorney and informed the Council that he was unable' to find any provisions in the Charter of the City of Huntington Beach for calling a special election in that no time was set for such elections, therefore, no election -could he held for filling the above named offices until the regular April 1938 election. Attorney Kuchel advised the Council that he would submit his written opinion at next meeting of the City Council. Orf motion by Chamness seconded by.Morehouse, the matter was taken under advisement until next meeting of the City Council. Mayor recommends extra compen- P_Iayor Warner recommended that extra compensation be allowed Attorney sation for Att°y Kuchel for his extra work in connection with the County gas tax allocation. No action was taken by the Council. City Charter ;'::Attorney L.W.Blodget addressed the Council relative to two omissions in proceedings in the forming of the City Charter, first that the law pro- viding that a notice be published to the effect that copies of the proposed Charter are on file in the City Hall. That no such notice was published prior to the adoption of the Charter and second that the manner in which the propositions were placed on the ballot, namely, Proposition No. I for the;. , adoption of the Charter and Proposition No. II for the election of Councilmen by wards was confusing and that the result of the votes would indicate that there was not a majority in favor of the adoption of the Charter. Thereupon Attorney Blodget presented the City Council and City Clerk with -a-notice signed by S.R.Bowen to the effect that he was about -to -'apply to the Attorney General for leave to sue in the proceedings taken by the City Page 2 - Minutes Aug.20, 1937. Council in its -adoption of the City Charter. The cause of such action being to determine whether or not the City is operating under a legal charter. The City Clerk was directed to file the papers submitted by Attorney Blodget. .On motion by Chamness seconded by Morehouse,.the Council adjourned until 7:30 P.M.
