Pursuant to adjournment of August 20th, the Council met and was i called to order at 7:30 P.M. by Mayor Warner. Councilmen present: Warner,Morehouse, Chamness, Talbert, Henrickson. F Municipalities calling attention to meeting to be held at Hotel , Laguna,.Laguna,Beach, Thursday, August 26th. The Clerk was directed to 'inform the League that six of the officials would be present. Rails on steps at Engineer Overmyer submitted an estimate for installing a rail City Hall on the steps at the entrance of the City Hall and, on motion by 'Chamness seconded by Henrickson, the City Engineer was directed to install two rails as per,sketch submitted. Renewal of Neon sign contract On motion by Henrickson seconded,by Morehouse, the Mayor and - City Clerk were authorizedto execute renewal of contract with the Neon Sign Company for the maintenance of the Neon sign at the inter- section of Main Street and.Ocean Avenue. a. Page 3 - Minutes Aug.23, 1937.- I gas tax The City Clerk read a Memorandum of Agreement with the Depart- ment of Public Works of the State of California for the exepnditure of gasoline tax funds on State highways within the City for the 1937-1939 biennium in.accordance with project statement previously l U executed, then the Clerk read Resolution No. 780, authorizing the _ Mayor and City Clerk to execute the Agreement on_behalf of the City Reso. and, on motion by Henrickson seconded by Chamness, Resolution No. 780 0780 was passed and adopted by the following vote: AYES: Councilmen: Morehouse, Chamness, Talbert, Henrickson, Warner. _ NOES:' Councilmen: None. ABSENT: Councilmen: None. The City Clerk read•a Memorandum of,Agreement with the Depart- ment of Public Works of the State of California for the expenditure of gasoline tax funds on Streets of Major Importance within the j City of Huntington Beach for the 1938 fiscal year in accordance with project statement previously executed, then the Clerk read Resolution Reso. No. 791, authorizing the Mayor and Clerk to execute the Agreement on #78l behalf of the City, and, on motion by Henrickson seconded by Talbert, Resolution No. 781 was passed and adopted by the following vote: AYES: Councilmen: Morehouse, Chamness, Talbert, Henrickson, Warner. �. NOES: Councilmen: None. ABSENT: Councilmen: None. Special Attorney Kuchel submitted his written opinion relative to the Election i calling of a special election and also informed the Council that he did not believe-that'provisions had been made in the Charter for the calling of special elections, however, he,said he had consulted the Long Beach attorneys who had been employed to draft the Charter and i that it seemed to be their opinion that an ordinance could be set Ord.#404 - by the City Council for calling special elections. Whereupon, the First reading City Clerk gave Ordinance No. 404 its first reading, same being an ,I I ordinance providing for the calling of special elections., 'M Charter In reference to the notice served upon the City Council by S. R. j Bowen on the matter -of testing the validity of the City Charter, Attorney Kuchel stated -that it was his opinion that the Charter should be tested in a Court of Records and informed the Council that they had ten days _from the date of filing of the notice in which to file objections with the Attorney General. No action was taken by the Council. Derrick - _ Attorney Kuchel informed the Council that the derrick at 9th and to be demol- :. ished Ocean may now .be demolished under the police power of the City if same I' is considered a hazard and, on motion by Henrickson seconded by More- house, the City Engineer was authorized and instructed to demolish the derrick located on Lots 1 - 2 - 3 -. 4, Block 109, Huntington Beach Tract. ' demolishing a dangerous building located on Lot �, Block 102, was referred to the City Attorney and City Engineer for their i investigation and report at next meeting of�the City Council.
