HomeMy WebLinkAbout1938-05-02183 • MINUTES City Hall, Monday, May 2d, 1938 The regular meeting of the City Council was called to order at 7:30 P.M. by the City Clerk. Councilmen present: Morehouse, Chamness, Henrickson. Councilmen absent: Talbert, Warner Councilman In the absence of the Mayor, Councilman Henrickson moved that Morehouse Councilman Morehouse act as mayor pro-tem. Motion seconded by Councilman Chamness, put and carried. • Minutes The Clerk read minutes of the City Council of April l9th and 25th and, on motion by Chamness seconded by Henrickson, same were approved C�J as read. • Canvass votes The hour of 7:30 P.M. having arrived, the City Council proceeded to canvass the results of the general municipal election and consolidated bond election held in the City of Huntington Beach, April 12th, 1938. ' The returns from the four consolidated election precincts were canvassed; absentee ballots were counted in the manner required by law; the total absentee ballots were ten (10) and the result of such count was as follows: T. TARBOX 1 ` Proposition No. 1 Yes 9 Proposition No. 1 No 1 Total votes cast: 10 Resolution Whereupon, the City Clerk presented and read Resolution No. 796 entitled: • No.796 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, CANVASSING THE RETURNS OF THE GENERAL IAU141CIPAL ELECTION AND THE CONSOLIDATED BOND ELECTION FIELD IN SAID CITY ON TUESDAY APRIL 12, 1938", and on motion by Councilman Henrickson seconded by Councilman Chamness, Resolution No.796 was passed and adopted by the following vote: AYES: Councilmen: Chamness, Henrickson, Morehouse NOES: Councilmen: None ABSENT: Councilmen: Talbert, Warner. STATEMENT OF RESULT OF ELECTION 1. The whole number of votes cast in the City of Huntington Beach, including all absentee votes is 1287. 2. The names of the persons voted for are T. B. Talbert, M.M.McCallen, and D. T. Tarbox; and the proposition designated as Proposition No.l, voted upon at said consolidated election was the following: "Shall the City of Huntington Beach, California, incur a bonded debt of $100,000.00, such debt to bear interest at the rate of not to exceed 5% per annum to be paid annually the first year and semi-annually thereafter, for the acquisition, construction and -completion of a public park and playground within said -City together with such equipment and appurtenances as may be necessary or convenient to the use thereof?o 84 Page 2 - Uinutes May 2, 1938. 3. M. McCallen. On account of the absence of newly elected Councilman T. B. Talbert, the Clerk could not administer the oath of office to him. Election of Mayor - The Clerk announced that the next order of business would be M.M.McCallen the election of a mayor to serve during the ensuing two years. Councilman Morehouse moved the nomination of M. U. McCallen; • motion seconded by Councilman Chariness, put and carried. There being no other names submitted, the clerk ordered the nomination closed and, on motion by henrickson seconded by Chamness, the Clerk was directed to cast a unanimous ballot for the Council for • Councilman McCallen as Mayor for the ensuing two years. g - CeKrMorrison & This being the time set for the bearing in the matter of cancel - Ocean Sport lation of agreement with C. There being no response, the hearing was deferred until 9:00 P.M. this date. Page 3 - Minutes May 2, 1938. ,18 5 tI it 1 Disaster The Clerk read a letter from the Disaster Relief Commission of Relief Commission the Orange County Council of the American Legion, Inc. asking the City to subscribe to a double page advertisement to appear in the souvenir program of the first annual Orange County Relief picnic to be held at the Sycamore Grove camp in Santa Ana Canyon, Sunday, May 29, 1938. L. E. Mitchell addressed the Council relative to the advertisement and stated that all proceeds deriving from the adver- tising and the picnic were to be devoted first to a disaster relief fund, secondly to future Armistice Day celebrations and, on motion by Henrickson seconded by Morehouse, the Council voted to appropriate $125.00 for the above named purpose and the matter was referred to the Beach and Pier Committee to provide advertising copy. Orange Co`. The Clerk read an application addressed to Miss Maxine Whisnat, Recreation Project project manager of Orange County Recreation Project, 11 North Broadway, Santa Ana, In which the City makes application for recreation personnel through that department and, on motion by Henrickson seconded by Morehouse, the Mayor and City Clerk were authorized to execute same on behalf of the City. Damage to The Clerk read a report of City Engineer Overmyer covering loss on Lamp Posts account of damage to lamp posts from January 1, 1936 to April 25th, 1938 I,, Application - Cliff L. King amounting to $638.42. The letter was ordered filed together with that of the insurance company offering to insure the City's lamp posts against damage. The Clerk read a letter from Cliff L. King making application for a lease of the refreshment concession in the new pavilion in which Mr. King offered the City the sum of $900.00 per year on the lease. The matter was referred to the Beach and Pier Committee. Gasoline tank The application of Robert Snyder to install a gasoline pump and tank in the space between the sidewalk and curb on Lots 19 and 20, Block 1005, Vista Del Mar, was read and referred to the City Attorney ' to determine whether or not a tank could be so located. (4 ft National Air The Clerk read Proclamation of Mayor McCallen supporting National 4 Mail week Air Mail week, May 15 to 21st, inclusive, same was referred to the Huntington Beach News for publication. Excelsior Union The Clerk read a letter from Excelsior Union High School, Norwalk, High School requesting the City Council to allow Delbert Higgins to visit their school on May 19th to deliver a talk to the students on safety at the beach and, on motion by Chamness seconded by Henrickson, the request was granted and the Clerk directed to notify the school. Mayor McCallen On motion by Henrickson seconded by Morehouse, Mayor McCallen was appointed representative of the City,of Huntington Beach to attend Orange County League of Municipalities' regular and executive meetings. 186 Page 4 - Minutes May 2, 1938. Dining room in The Clerk read an estimate from Engineer Overmyer covering • pavilion proposed improvements in the dining pavilion of the new building � amounting to $163.50 and, on motion by Henrickson seconded by Chamness, the City Engineer was directed to proceed to install the necessary improvements in accordance with his estimate. IuIa.rgaret Coplin - The application of Margaret Coplin for position as beach play - application ground supervisor during the coming season was referred to the Beach and Pier Committee. • Bids - On motion by Henrickson seconded by Morehouse, the City Clerk Sound Equipment was directed to advertise for bids for furnishing the City with a complete set of sound equipment and the necessary stage and seating requirements, draperies, etc., for the new beach pavilion. Bids to be opened and examined at 7:30 P.M., May 19th, 1938. Anglers' Club A letter from the Huntington Beach Scientific Anglers' Club ' commending the City Council for the new buildings constructed and under construction was read and ordered filed. Application - The application of George M. Mitchell for position as janitor � janitor and watchman in the new beach pavilion was ordered filed. Neon sign On motion by Henrickson seconded by Morehouse, the application of Bayard Butcher to install Neon sign at 102 fAaini Avenue, was - approved. Womans' Golf Club The request of the Womans' Golf Club, Jessie M. Frost, president, for permission to use the Lake Park building during the noon and + afternoon hours Wednesday each week and on Friday, June 3rd, was referred to the City Engineer. , Invitation The Clerk read a letter from the City of Compton inviting City • from City of Compton Councilmen to be present during the Golden Jubilee celebration, May 21st, 1938, 1:30 P.M. The letter was ordered filed and the Clerk directed to write the Mayor of Compton to the effect that the City • Council was not able at this time to state whether or not any of the members could be present. Small bldg.on On motion by Chamness seconded by Henrickson, the City Engineer pier was authorized and directed to move the small building from the end of the municipal pier to the city ;yEtrd_ to be stored until released by the City Council and Chief of Police. 44 Fire Ind. On motion by Chamness seconded by Henrickson, the demand of Mrs. Payne for payment of premium on a fire insurance policy covering a portion of the insurance of the City Hall was ordered held over until next Monday and referred to the City Council as a committee as a whole to determine whether or not the City should accept the insurance. Demands On motion by Chamness seconded by Henrickson, demands approved by the Finance Committee were ordered paid. Page 5 - Minutes May 2, 1938. 8 • Playground on vacant lots Jack McDonough addressed the Council and stated that there seemed suggested to be no place for the children to play after school hours and that it was dangerous for them to be on the streets. Mr. McDonough -suggested that the City Council endeavor to secure vacant lots at various places for the purpose of providing temporary playground. The matter was taken under advisement of the City Council. Hearing - At this time, 9 o'clock P.M., the Mayor asked if there was anyone Ocean Sport Fishing, Inc. in the audience representing C. K. I'dorrison or Ocean Sport Fishing, Inc. There was no response. • City Attorney Overacker presented and called the City Council's attention to the following documents: P^1 Agreement with C.K.Morrison dated 29th day of May, 1930; •� Agreement with C. K. Morrison dated May 21st, 1934; Photostatic copy of assignment of the last named agreement from C. K. Morrison to Ocean Sport Fishing, Inc., which assignment is dated the 12th day of June, 1937; A letter from Ocean Sport Fishing, Inc. dated April 11, 1938 to the effect that the Barkentine "Annie M. Rolph" was at that time anchored off Malibu pier and that they would be unable to operate or furnish service off the Huntington Beach pier during the coming season of 1938; Copy of a registered letter and return receipt from the City Clerk to Ocean Sport Fishing, Inc., 745 Western Pacific Bldg., Los Angeles, notifying them to have a representative appear • before the City Council of Huntington Beach at 7:30 P.M., 2nd day of May, 1938, and show cause why that certain agreement dated May 21st, 1934 by and between the City of Huntington Beach and C. K. Morrison should not be revoked; A letter from the Huntington Beach Chamber of Commerce urging the City Council to make provisions for fishing barge off the • coast of Huntington Beach,for the reason that they were re- ceiving many inquiries from fishermen and complaints from the businessmen to the effect that no fishing barge was being operated in the vicinity of Huntington Beach and that as a result fishermen were being greatly inconvenienced by having to go to other coast cities. The City Council received the above documents and ordered that they be placed on file in the office of the City Clerk. • Chief of Police City Attorney Overacker called Chief of Police Grant to the stand to testifies testify in the above named hearing. Chief Grant testified under oath that on Thursday, April 14, 1938, in company with Councilman Ciiamness, he had a conversation with J. A. McDonald, Secretary -treasurer of Ocean Sport Fishing Inc. in Mr. McDonald's office and in answer to the question whether or not his company intended to operate a barge off the coast of Huntington Beach during the coming summer season, Mr. McDonald stated he did not intend to 1 operate off Huntington Beach this season and that he refused to sign a release with the City of Huntington Beach calcelling the contract under which he proposed to hold against the City. ' W. J. Bristol of Huntington Beach testified under oath that he had W. J. Bristol �. urged the City -Council recently to take such action as was necessary to induce someone to operate a fishing barge off the Huntington Beach coast and that as a director of the Chamber of Commerce he had been approached by at least fifty persons who requested that the Chamber of Commerce and the City use their best efforts to have a fishing barge in operation during this summer season off the Huntington Beach coast. Mr. Bristol Page 6 - Minutes May 2, 1938 stated that various business concerns in the City were losing money for the reason that no barge is in operation and that he believed that a fishing barge off the coast of Huntington Beach was and is a public necessity. Walter Dabney Walter Dabney of Huntington Beach testified under oath that at least twenty-five persons had approached him during the past two weeks and urged that he use his influence with the City Council to have a fishing barge in operation off the coast of Huntington 40 Beach. Mr. Dabney expressed the belief that this was a public necessity. Sam Clapp Sam Clapp of Huntington Beach testified under oath that every s day during the past two weeks inquiries had been made at his office relative to a fishing barge, that he had known personally of groups who had come to Huntington Beach expecting to fish from the barge who were cisaDDointed and had to go to other coast cities. Mr. Clapp stated that he believed that a fishing barge was a public necessity. Delbert Higgins Delbert Higgins, Huntington Beach life CD guard, testified under oath that he had been approached by at least thirty persons during the past few weeks who desired a fishing barge off the coast of w Huntington Beach. B. R. Ries B. R. Ries, Huntington Beach merchant, testified under oath that he had had a number of telephone calls from out of town people during the past few weeks inquiring how soon the city would have a fishing barge off the coast. William Gallienne William Gallienne, secretary of the Huntington Beach Chamber of Commerce, testified under oath that during the past month his office has answered numerous inquiries about a fishing barge, that the various newspapers throughout the State are not listing, Huntington � Beach in their sport directory for the reason that there is no barge in operation, that the City is losing much advertising and publicity on account of having no barge, that he believed that the operation of a barge off the coast of Huntington Beach is a public necessity. John H . Games John H. Games- testified under oath that he had examined the records of Mr. Barker who operated a fishing barge off the coast of Huntington Beach June 5th to July 11, 1937, and that the records showed 1040 persons had visited his fishing barge during that period, that the City of Huntington Beach is from thirty minutes to one hour closer to fishing banks than any other city along the coast, that he believed that a fishing barge off the coast of Huntington Beach is a public necessity. James L. Rice James L. Rice of Huntington Beach testified under oath that he had examined the records of C. K. Morrison and that as many as 16,700 persons had visited his fishing barge in one season, Mr. Rice stated Page 7 - Minutes May 2, 1938. A that a fishing barge off the coast of Huntington Beach is a public necessity. P. L. Wood P. L. Wood, operator of a tackle and bait stand in Huntington Beach, says.tha.t he is having daily calls from fishermen who wish to fish from a barge off the coast of Huntington Beach, that at least 0 two hundred inquiries have come in to his place of business during the past two months, that fishermen generally refer to the Huntington Beach coast as being better for fishing than other cities. Mr. Wood stated that he believed a barge off the coast of Huntington Beach is a public necessity. Resolution The Clerk presented and. read Resolution No. 797, cancelling certain No-797 taxes on property within the City of Huntington Beach and, on motion by Chamness seconded by Henrickson, Resolution No. 797 was passed and adopted by the following vote: • AYES: Councilmen: Morehouse, Chamness, Henrickson, McCallen. NOES; Councilmen: None ABSENT: Councilmen: Talbert Resolution The Clerk presented and read Resolution No. 798, creating the em- No. 798 ployment of pavilion manager and, on motion by Chamness seconded by Henrickson, Resolution No. 798 was passed and adopted by the following vote: • AYES: Councilmen: Morehouse, Chamness, Henrickson, McCallen. NOES: Councilmen: None ABSENT: Councilman: Talbert. Ord.411 The Clerk presented and read, for the first time, Ordinance No. First reading 411 fixing the rate and amount of bonds for various city officials. Resolution The Clerk presented and read Resolution No. 799, regulating use of No-799 Lake Park recreation building and., on motion by Henrickson seconded by Chamness, Resolution No. 799 was passed and adopted by the following vote: AYES: Councilmen; Morehouse, Chamness, Henrickson, McCallen. NOES: Councilmen: None ABSENT; Councilmen: Talbert Resolution The Clerk presented and read Resolution No. 800, weed resolution, No.800 and, on motion by Henrickson seconded by Chamness, Resolution No. 800 was passed and adopted by the following vote;. NOES: Councilmen: None ABSENT: Councilmen: Talbert 19 0 Page 8 - Minutes May 2, 1938a Lease - The Clerk presented and read lease of the City of Huntington Dwight Clapp Beach to Dwight Clapp covering beach concession and, on motion by Chamness seconded by H1enrickson, the Nayor and City Clerk were authorized to execute same on behalf of the City. Mr. Tipton In the matter of application of Mr. Tipton to lease "T" on the pier, Councilman Chamness stated that he had no report to make, Ocean Sport Fishing, Inc. Mrs. Westmoreland 0, matter deferred until next meeting of the City Council. At this time, 10:30 P.1111. , Dlayor Mc Callen informed those present that he would continue the hearing of Ocean Sport Fishing, Inc. until Wednesday, May I+th, 1938, at the hour of 7:30 P.M. The matter of proposed lease betUTeen the City and Mrs. West- moreland for space to operate store at the municipal trailer camp was deferred until next meeting of the Council.
