HomeMy WebLinkAbout1938-05-041 9 1- MINUTES 11 City Hall, Wednesday, May 4th, 1938 Pursuant to adjournment of May 2d, 1938, the City Council met and was called to order at 7:30 P.M. by Mayor McCallen. Councilmen present: Morehouse, Chamness, McCallen. Councilmen absent: Talbert, Henrickson. Hearing - This being the date set for a continuance of the hearing on the C.K.U;orrison & Ocean Sport matter of cancellation of contract with C. K. Morrison to operate boats Fishing,Inc. off the municipal pier, the City Clerk testified under oath that the various minute records referring to the above named agreement were true and correct. P.� Y--+ The City Attorney testified under oath that lie had made inquiry relative to the whereabouts of C. K. Morrison and had been reliably informed that he was at the present time not in California. City Attorney Overacker informed the Council that he was of the opinion that the above named agreement is not a franchise but that it Is a license, therefore, subject to be revoked by the City Council, further that he believes that the City Council has the power to revoke. • Motion Following motion by Councilman Morehouse: "That the City Council hereby cancel the agreement with C. K. Morrison and the purported assignment to Ocean Sport Fishing, Inc. be declared null and void and that the City Attorney be authorized and instructed to prepare a re- solution to that effect.' Motion seconded by Councilman Chamness, put and carried by the following vote: AYES: Councilmen: Morehouse, Chamness, McCallen. NOES: Councilmen: None ABSENT: Councilmen: Henrickson, Talbert. Barges On motion by Chamness seconded by Morehouse, the Beach and Pier Committee was authorized to contact owners of barges to meet with the committee and the City Attorney with a view of entering into a contract for use of the municipal pier landing in embarking and discharging passengers off fishing barges off the Huntington Beach coast. Application - The application of Harry C. Wilson, 1500 Dock Street, Terminal Harry C. Wilson ,Island, California, for permission to use the municipal pier landing to operate boats to and from the fishing barge "Star of Hollywood" off Huntington Beach coast was referred to the Beach and Pier Committee. Transfer of The City Clerk read a letter from-H. L. Grant, Chief of Police, • E. Errington requested recommending that E. Errington be transferred from the Street Depart- ment as of May 16th to the Police Department, working as license collector until June 1st then working as vacation relief at a salary of $135.00 per month. Page 2 - Minutes May 4, 1938 E. Errington On motion by Chamness seconded by Morehouse, the City Engineer was authorized to transfer E. Errington from the Street Department to the Police Department at a salary of $135.00 per month beaincling May 16th, 1938. Application The application of Mae Barnes for position as janitress of the beach pavilion was referred to the Beach and Pier Committee. Lee Mann appointed The Clerk read a letter from City Engineer Overmyer to the Mgr. beach pay. effect that he had appointed Lee Mann manager of the beach pav- ilion and civic auditorium subject to rules and regulations of u the City Council and that his compensation be as designated in Resolution No. 798 and, on motion by Chamness seconded by Morehouse, the appointment was approved. Bait & Fishing Councilman Chamness reported on the application of Mr. tackle stand Tipton for use of the first "T" on the municipal pier as a bait and fishing tackle stand and recommended the lease rental be $300.00 per year and $150.00 for the concession, payable in advance. Mr. Wood, owner of a concession on the pier, complained to the Council that there was not business enough for two concerns but if given preference of concessions, he preferred to remain at his present stand. City Att'y'in- On motion by Chamness seconded by Morehouse, the City structed to prepare contract Attorney was instructed to prepare a contract with Chas. B. Tipton providing for a down payment of $150.00 for the con- cession and a further payment of $300.00 a year, payable quarterly in advance. Mrs. Westmoreland The matter of lease for Mrs. Westmoreland was deferred until next meeting of the City Council. County life guards The matter of supervision of County life guards outside the city limits was referred to the Beach and Pier committee for further consideration. Gasoline pump No action was taken relative to the application of Robert Snyder to install gasoline pump between the sidewalk and curb on Lots 19 and 20, Block 1005, Vista Del Mar. On motion by Chamness seconded by Morehouse, the Council adjourned until 7:30 P.M., N 1 i 1 1
