Pursuant to adjournment of November 18th, the City Council met and was called to order at 7:30 P.M. by Mayor McCallen. I Councilmen present: Morehouse, Chamness, Talbert, Henrickson, McCallen. ° Councilmen absent: None. Appropriation The Clerk presented and read a letter from the.Chamber of Commerce made for Christmas asking the City to appropriate the sum of $450.00 to cover Christmas activities baskets, Christmas lights and ornamental lighting for the streets and, ' on motion by Chamness seconded by Talbert, the sum of $300.00 was v appropriated. Tax title lots Mr. Hyde addressed the Council relative to some two hundred tax title lots on account of.delinquent taxes and offered to assist the city i in acquiring this property for the City. The matter was referred to Councilmen Talbert and Morehouse. Mr. Grassmuck Mr. Grassmuck addressed the Council and complained that he had been arrested and confined in jail for alleged failure to stop on Walnut Avenue at the intersection of Main and asked that an apology be furnished him. The matter was referred to the Police Committee, Henrickson and Chamness. Delegation of Mr. O'Brien and other oil men addressed the Council relative to oil men their property being posted for -cleaning up and complained that the ordi- nances and regulations were too drastic to be complied with. They were informed by the Mayor that the Huntington Beach oil field must be cleaned up but that no impossible requirements would be enforced upon anyone. Application ap- On motion by Talbert seconded by Chamness, the application of the proved - D & D Co. D. & D. Oil Company, Walter E. Dabney owner, for permission to pay license and operate wells 1, 3, 4, 6 and 7 located in blocks 517, 519 and 620 was approved. Girl Scouts On motion by Henrickson seconded by Morehouse, the request of the Girl Scouts for cancellation of charges on account of pot luck dinner in Memorial Hall, Wednesday, November 23rd, was approved. Volunteer Fire Councilman Chamness informed the Council that the Volunteer Fire _ Dept. dance in pavilion Department had been given permission to use the dance pavilion for their annual dance February 14, 1935. Lighta. - The Clerk read a letter from the Chamber of Commerce asking that Lake P ark additional lights be placed at the entrance of Lake Park. Ask for cancellation On motion by Talbert seconded by Henrickson, the City of County taxes Clerk was directed to appear before the Board of Supervisors of Orange County and ask for cancellation of taxes on property recently purchased for the extension of Fifth Street to Frank- fort Street. Lease - On motion by Talbert seconded by Chamness, negotiations with Sewage Disposal plant Peter Karales to enter into a lease for the cultivation of the City's sewer site was ordered cancelled. The Clerk presented and read a lease ` between the City of Huntington Beach and Ray Yakura whereby the latter is to plow and cultivate the city's property surrounding the new sewer plant and, on motion by Chamness seconded by Henrickson, the Mayor and City Clerk were authorized to execute same on behalf of the City. Surety Bond - On motion by Chamness seconded by Morehouse, the surety bond S.E.Tzlbert of S. E. Talbert doing business as the Talbert`.Housemoving Company was accepted and ordered filed. Mills Land & Water The Clerk•read a letter from the Mills Land and'Water Company Co. addressed to City Attorney Overacker relative to the purchase of a 50 acre tract near the easterly city limits and urged, that the City comply with an alleged verbal understanding prior to .the purchase of the beach front. The matter was laid over temporarily. Wilshire Oil Co. ) On motion by Henrickson seconded by Talbert, the application of Application / Wilshire Oil Company to redrill well located on'Lot 6, Block 118, 17th Street Section, was accepted and permission granted with the provisions that the necessary bond be filed with the City and -that the Wilshire Oil Company execute the required agreement. Do On motion by Henrickson seconded.by Chamness, the application of the Wilshire Oil Company to redr ill well located on Lot 8, Block 120, 17th Street Section, was accepted and permission.granted with provi- sions that the Wilshire Oil Company submit the necessary bond and execute the required agreement. Ord.#420 - The Clerk presented and read, for the first time, Ordinance No. First reading 420 regulating traffic. H. B. Company C. H. King informed the Council that he expected papers for the transfer of property for 5th Street and Frankfort Street right-of-way from the Huntington Beach Company within the next few days. Demands On motion by Talbert seconded by Chamness, demands approved by the Finance Committee were ordered paid. H. B. News - The Clerk read a letter from the Huntington Beach News asking Annual edition that the City -place an advertisement in their annual edition, Thursday, December 29th, rates $320.00 for a double page, $160.00 for a single page and the same ratio of'cost for any size desired. The matter was referred to the City Council as a committee of the whole to investigate and report at the meeting of Monday, December 5th. "1. D Page 3 m Minutes Nov. 28, 1938 City Attorney - opinion City Attorney Overacker presented a written opinion in which \ he expressed dissatisfaction with certain words, phrases and clauses contained in an agreement between the Southwest Exploration Company and the City of Huntington Beach covering easement for right-of-way r-, by the City of Huntington Beach to the Southwest Exploration Company. Mayor McCallen suggested that it might be well to terminate services of special attorney and close the matter. Following motion by Councilman Talbert:. 1°That the matter of working out an agreement with the Southwest Exploration Company be left to the attorneys of that company and the attorneys representing the city to work out and v (� submit to the City Council at an early date." The motion was lost for want of a second. ;. Mayor McCallen Mayor McCallen suggested that the City Attorney, the special F` attorney for the city and all members of the City Council call at the office of the Southwest Exploration Company on Tuesday, November 29th and meet with representatives of that company relative to closing the agreement. The suggestion was accepted unanimously by the City Council.
