HomeMy WebLinkAbout1939-07-24352 MINUTES • Council Chamber, City Hall, • Huntington Beach, California July 24, 1939 Pursuant to adjournment of July loth, -the City Council met and was called to order at 7:30 P.M. by Mayor McCallen. Councilmen present: Morehouse, Chamness, Talbert, Henrickson,McCallen. Councilmen absent: None. Breakwater - E. B. Stevens presented a petition containing the names of petition 326 persons requesting the City Council to call an election for the purpose of voting bonds in the sum of $$500,000.00 to help defray • the cost of construction of a break -water. Mr. Stevens asked the Council to pass an emergency ordinance for this purpose, election to be not later than November 7, 1939. The matter was referred by the Mayor to the Beach and Pier Committee for their investigation and report back to the City Council as soon as convenient. Councilman Morehouse suggested that the City secure the services of a competent marine engineer to pass on the feasibility of the plan but stated that he was not in favor of paying for such services from the City's funds. Paint - The matter of purchasing water proof paint was referred to the City Engineer for his recommendation. Damage to pier- The Clerk read a letter from City -Engineer Overmyer to the effect that the recent high waves had damaged the municipal pier and that ' it would cost approximately four or five hundred dollars to make the necessary repairs and, on motion by Henrickson seconded by Talbert, the City Engineer was authorized to proceed with the repairs and prepare a statement to the insurance company to cover the cost. Memorial Hall - The Clerk read a letter from the Church of God asking that rental charge for Memorial Hall be waived for meetings held there July 23rd to Seth inclusive and, on motion by Chamness seconded by Henrick- son, the request was granted. �¢ Gas tax The Clerk read MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF �¢ monies - GAS TAX MONIES ON STATE HIGHWAYS WITHIN THE CITY in accordance with project statement previously submitted. Whereupon the following motion was made by Councilman Talbert: 'That the Mayor and City Clerk be authorized to sign the above referred to Memorandum of Agreement with the State of California Highway Department on behalf of the City of Huntington Beach". Motion seconded by Councilman Chamness, put and carried unanimously. So. Calif. Water The Clerk read a letter from D.E.Burry, local superintendent Co. of the Southern California Water Company, asking that certain adjust- •. ments be made covering excavation permits due June 7, 1939; same was referred to the City Engineer for his investigation. 9 Page 2 - Minutes July 24, 1939 • Mun.Trailer Mrs. Lang addressed the City Council relative to her being camp - employed as publicity agent for the municipal trailer camp. She was • referred to the Beach and Pier Committee. Lots - The Clerk read a letter from J. C. Lamb, County Tax Collector, public auction notifying the City Council that his' department had been petitioned to sell at public auction lots 51 and 52, Block 910, Wesley Park., for the sum of $50.00 and, on motion by Morehouse seconded by Henrickson, the City Council agreed to the'sale and directed the City Clerk to so • notify the County Tax Collector. Memo.Hall On motion by Henrickson seconded by Morehouse, the request of charges waived Chief of Police Grant to waive charges for use of Memorial Hall by the Peace Officers' Association July 12th was granted. Removal of The Clerk read a memorandum from Mrs. A. J. Driller asking that urn tree requested - the Council either have removed or permit the removal of a large Eucalyp- tus tree at 510 - 14th Street. The matter was referred to Councilman Morehouse, Engineer Overmyer and Park Superintendent Beeson for their investigation and report back to the City Council. C. of C. The Clerk read a_ letter from the Chamber of Commerce requesting the City Council to include in its 1939-1940 budget the sum of $1500.00 for the purpose of providing seating facilities on the beach front. The letter was referred to the Beach and Pier Committee and City Engineer to furnish an estimate of cost together with their recommendation to the City Council. Mun. auto The Clerk read a letter signed by Mrs. Cleo Pickering, b309 camp - Riverside Avenue, Riverside, California, making certain suggestions con - the management of the municipal auto camp. The letter was ordered filed and the Clerk directed to reply to Mrs. Pickering's letter to the effect that"the City Council will do all in its power to -follow the sug- gestions made in the letter. Star Housemovers On motion by Henrickson seconded by Morehouse, the surety bond bond of the Star Housemovers, Inc., was accepted and ordered filed. • Bond - J.H. On motion by Henrickson seconded by Talbert, the bond of J. H.. Pryor Pryor, plumbing contractor, was accepted and ordered filed. Ord.#428 The Clerk gave Ordinance No. 428, an ordinance of the City Council passed of the City of Huntington Beach relating to'and regulating traffic on the public streets, its second and final reading and, on motion by Morehouse seconded by Talbert, Ordinance No. 428 was passed and adopted by the follow- ing vote: AYES: Councilmen: Morehouse, Chamness, Talbert, Henrickson, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. Ord.#429 - The Clerk gave Ordinance No. 429 its.first reading, an ordinance 1st reading - calling and providing for the holding'of a special election to be held in the City of Huntington Beach on Wednesday, the 27th day of September, 1939, for th-e purpose of submitting to the qualified voters of said City the pro- Page 3 - Minutes July 24,. 1939 354 position of incurring a bonded indebtedness by said City for the J acquisition, construction and completion of municipal water works. Application On motion by Henrickson seconded by Chamness, the applica- appr ov e d tion of C. B. Turner to operate service station at the corner of Main and Olive was approved. H.B.Garden Club - �l The Clerk read a letter from the Huntington Beach Garden ffugge s t ing•. -land- uJ scaping Club suggesting that the grounds around the new fire station and memorial hall be properly landscaped. The Clerk was directed to write the Garden Club stating that the.Council would endeavor to do the work to the best of its ability. H. B. Garden Club The Clerk read a letter from the Huntington Beach Garden Spring flower I show Club requesting the use of the beach dance pavilion for staging a flower show during the 3rd week of April, 1940. The matter was referred to the City Engineer and the Beach and Pier Committee to work out a plan for the protection of the dance floor and assured � l the Garden Club that they would be given the use of the hall. Ventilation in-,- Councilman Talbert stated that ventilation was inadequate adequate in pavilion in the beach pavilion dance hall. This matter was referred to the Beach and Pier Committee and the City Engineer to work out a plan and proceed with the work of providing better ventilation. Bid on Lots - The Clerk read a letter from Charles E. Burkhard offering Chas,Burkhard the sum of $250.00 for Lots 5, 7 and 9, Block 313, Huntington Beach i Tract. The letter was accompanied by a check in the amount of $25.00. a This matter was referred to Councilmen Talbert and McCallen and the City Attorney with authority to work out and submit a plan for the sale of tax deeded lots and the Clerk was directed to acknowledge receipt of the letter and check and to inform the bidder that same is being held subject to action of the City Council. C. of C. The Clerk read a letter from the Chamber of Commerce commend- ing city officials for their assistance in staging the 4th of July celebration. The letter was ordered filed. Calif.Ass°n of The Clerk read a letter from the president of the California Park Adm.. Association of Park Administrators thanking the City Council for its 1 cooperation during a recent meeting of the organization in the City of Huntington Beach. The letter was ordered filed. Reso. - The Clerk read a letter and resolution adopted by the City Beverly Hills of Beverly Hills protesting,against the practice of city police and fire departments in soliciting funds for their various benefit enter- d tainments. The letter requested the City Council to pass a, similar resolution. This was referred to the Fire and Police Committee for Imo. their recommendation. 101 Baseball park The request of A. D. Marshall for use of the baseball park Friday afternoon July 28th was read and, on motion by Henrickson onded by Talbert, the Clerk was directed to notify Mr. Marshall that Page 4 - Minutes July 24, 1939• . the park could be had free of charge by their organization, the Aluminum Sales organization. H.B.Company The Clerk informed the Council that at a recent meeting of the Lots planning Commission a motion was put and carried requesting the City Council to in turn request the Huntington Beach Company to place certain property along Main Street on the market for home building. The request was ordered tabled for the reason that the City Council believed such action not to be a proper function of either the Planning Commission or the City Council, Demands On motion by Talbert seconded by Chamness, demands approved by the Finance Committee were ordered paid. Drivers' Councilman Henrickson stated that he had been informed the State license of California will discontinue the service of sending a representative to Huntington Beach for the purpose of issuing -automobile drivers' license p� •�- and, on motion by Henrickson seconded by Morehouse, the Clerk was directed to write a letter to Chief Raymond E. Cato protesting against such action. Franchise tax Councilman Chamness stated that he had been informed that neither .A• the water company or telephone company operating in Huntington Beach were paying or had been paying an annual franchise tax to the City. In this connection City Attorney Overacker stated certain cases were pending against the electric and gas companies and that he believed there was a possibility of the city collecting additional franchise taxes from the various utilities and, on motion by Chamness seconded by Henrickson, • the matter was referred to the City Attorney to make a thorough investi- gation and report back to the City Council their findings as soon as possible. Waterworks The Clerk read a letter fom O'Melveny, Tuller & Myers, attorneys, bonds 433 So. Spring Street, Los Angeles, offering to assist with the preparation of the bond proceedings of the City of Huntington Beach for water works • purposes and to render their opinion upon the bonds as issued for the sum of $2.00 per thousand for the issue of $265,000.00 or a total fee of $530.00, payable one-half after the election carries and the other one-half after the 40 bonds are sold. If the election fails to carry, the total sum would be $265.00. The following motion by Councilman Talbert: "That the offer of O'Melveny, Tuller & Myers, attorneys at law, to assist in the preparation of bond proceedings for the waterworks and render their opinion thereon for $2.00 per one thousand or $530.00 for the entire bond issue, one-half to be paid when the election carries and balance when bonds are sold and in the event bonds are defeated the total charge would be one-half or the total of $265.00, be and the same is hereby accepted." Motion seconded by Councilman Chamness, put and carried unanimously.
