HomeMy WebLinkAbout1939-08-07356 MINUTES • Huntington Beach, California Council Chamber, City Hall August 7, 1939 The regular meeting of the City Council was called to order at 7:30 P.M. by Mayor McCallen. Councilmen present: Morehouse,Chamness,Talbert,Henrickson, McCallen. Councilmen absent: None. Minutes On motion by Chamness seconded by Talbert, minutes of the City Council for the month of July were approved as read. Break -water Councilman Chamness informed the Council that he had made some investigation relative to the building of a break -water, and that • he had contacted an engineer who had promised to be at the meeting tonight but was later informed that the engineer could not attend -the meeting. Councilman Chamness asked that the matter be continued until next meeting of the City Council. Councilman Talbert stated that he had discussed the matter with some engineers and yachtmen and that their tt' l advice was to get as much information as possible before proceeding. Monthly The Clerk presented and read the monthly reportsodf the City Reports Treasurer, City Clerk, City Collector, City Judge and Chief of Police, and on motion by Chamness, seconded by Renrickson, the reports were accepted and ordered filed. Franchise tax - H. V. Anderson, of the Southern California Water Company, So. Calif l Water Co. addressed the Council concerning the matter of franchise . Mr. Ander- son stated that he had read an account in the local paper to the 0. effect that his company was delinquent in its franchise payments. Mr. Anderson read excerpts from an opinion rendered by his company's attorney to the effect that the Water Company is operating under a constitutional franchise, therefore, not required to make payments to the City of Huntington Beach. Councilman Chamness informed Mr. Anderson that he had not made the statement that the company was • delinquent but rather that the company had never paid franchise tax. Musicians' Mr. Foster of Santa Ana, representing the Musicians' Union, Union addressed the City Council and stated that he understood the city is employing a non -union band on Friday nights and asked that the • ' city immediately employ a union band. He stated.that a band of five men could be employed four hours (4) per night at a cost of $52.00 and, on motion by Chamness seconded by Talbert, the matter was re- ferred to the Beach and Pier Committee to make an analysis of the situation and reportback to the City Council at its next meeting. r Page 2'- Minutes Aug.7, 1939• 37 C Twins' Conv.- The Clerk read a letter from the Huntington Beach Chamber of appropriation Commerce Twins Convention Committee requesting an appropriation of $150.00 to help defray the general expenses of the convention which N P," V (-r. r r R is to be held August 13, 1939, and, on motion by Morehouse, seconded by Henrickson,.the request was granted. Radio -broadcast - The Clerk read a letter from the Huntington Beach Chamber of Twins Conv. Commerce recommending that the City Council appropriate a sum of $60.00 for purpose of conducting a radio -broadcast of the Twins Convention. On motion by Talbert seconded by Chamness, the matter was ordered filed without action by Council. Adv. Contract The Clerk presented and read a contract between the City and the with C. of C. Chamber of Commerce covering expenditures to be allocated by the City to the Chamber of Commerce for advertising purposes between July 1, 1939 and June 30, 1940, amounting to $1,920.00 and on motion by Henrickson seconded by Talbert, the Mayor and City Clerk were authorized to execute the contract on behalf of the City. The motion was passed and carried by the following vote: YES; Councilmen; Morehouse,Chamness,Talbert,Henrickson,McCallen. NOES; Councilmen; None. ABSENT:Councilmen; None. Cost of seats The Clerk .read a, letter from City Engineer Overmyer to the effect on bluff that it will cost the City $1,590.00 with the help of the W.P.A. or $2,450.00 if done by the City alone to construct approximately 1,000 (one thousand) seats on the bluff facing the ocean. After some discussion the City Council decided that the number of seats was too small for the expenditure at the present time. Offer on Lots- The Clerk read an offer from George Kesterson, in the amount of Mr. Kesterson $150.00 for Lots # 17 & 19, Blk. 613. The letter was accompanied by a $50.00 deposit check. Same was ordered filed for future reference. Adv. in On motion by Henrickson, seconded by Talbert, the City Council Anaheim Bulletin appropriated the sum of $25.00 to cover the cost of a one-fourth (�) page advertisement in the Anaheim Bulletin issue of August 28, 1939- The Clerk was directed to turn the matter over to the Chamber of Commerce to prepare the copy and notify the Anaheim Bulletin. Orange Co. The Clerk read a letter from the Orange County League of Munici- League of Mun° palities, stating that the next regular monthly meeting will be held at 6:45 P. M. Thursday evening, August 10, 1939, at the Rendezvous, 204 South El Camino Real, -San Clemente. The letter was ordered filed. Waterworks The Clerk read a letter from Lewis Pickett and Company, 105 W. Admas bonds Street, Chicago, offering their services in connection with the sale of Water -works Bonds. The letter was ordered filed. Motor Vehicle- The Clerk read a letter from Paul Mason, State of California Depart - Dept. ment of Motor Vehicles, to the effect that the State is compelled to dis- continue -the service of the Drivers' License Examiner in Huntington Beach. The letter was ordered filed. r Page - Minutes Aug_. 7, 1 Vacation - The Clerk read a letter from Chief of Police Grant, asking Chief Grant J l permission to start his two -weeks vacation August 15, 1939. Also requesting that the Council approve of his appointment.of D. M. Blossom as acting chief during the Chief's absence, and on motion by Chamness, — by Talbert,.the seconded request was granted. Removal of The request of James H. Kaae, 734 Main St., to have a Blue -gum tree tree removed from the parking in front of his residence was referred c� to Councilman Morehouse and Park Superintendent Beeson, for their investigation and recommendation. Stop -signs The Clerk read a letter from F. E. Bundy, thanking the City Council and Chief of Police for the installation of various stop - signs in the City and recommending that stop -signals be installed along Ocean Ave. on the easterly side from First St. to Twenty-third St. The matter was referred to the Police and Fire Committee and Chief of Police for their recommendation. Demands. On motion by Chamness, seconded by Talbert, demands,approved by the Finance Committee, were ordered paid. Decalcomania On motion by Henrickson, seconded by Talbert, the City Clerk was Seals f authorized to purchase one hundred (100) Decalcomania Seals, to be J� I used on city cars at a total cost of $$55.00. Deed portion of The Clerk read a deed from the City of Huntington Beach to Lot 18, B1k,504 to Wardwell George W. Wardwell and Ada Wardwell, covering a portion of Lot #18, Block 504 and, on motion by Talbert seconded by Morehouse, the Mayor and City Clerk were authorized to execute same on behalf of the City. Southwest Expl. The application of Southwest Exploration Company to drill a Co. - State well #21 well, known as State 21, was granted on motion by Henrickson seconded by Talbert. Ord. 429 - The Cleivk gave:Ordinance No. 429,. calling and providing for the passed - Special I election holding of a special election on Set. 27, 1939, its second and final reading and, on motion by Councilman Henrickson seconded by Councilman Chamness, Ordinance No. 429 was passed and adopted by the following vote: AYES: Councilmen: Morehouse, Chamness, Talbert, Henrickson, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. Reso. - Clerk On motion by Chamness, seconded by Talbert, the City Attorney was for Eng. Dept. authorized to prepare a resolution providing for the.employment of an engineer's clerk, beginning as of Aug..l, 1939. Reso. #847 - City Attorney Overacker informed the Council that he had been purchase of McIntyre units advised by County Tax Collector Lamb, that an offer had been made — covering the sale of one hundred ninety-two (192) McIntyre units on account of delinquent taxes, whereupon, the Clerk read Resolution No. 847-consenting to the above named sale and on motion by Chamness, seconded by Talbert, Resolution No. 847 was passed and adopted by the following vote: ° I Page 4 - Minutes Aug.7, 1939 �` AYES: Councilmen; Morehouse, Chamness, Talbert, Henrickson, McCallen. Fire hose On motion by Henrickson, seconded by Chamness, the City Clerk was authorized to purchase 900 ft.. of fire -hose at a cost of $416.00 plus � sales tax. 49 acre After some discussion relative to the purchase of a 49 acre tract tract adjoining easterly city limits, Councilman Talbert made the following motion; "That the City Attorney be authorized to work out an option for the purchase of the 49 acres providing for a $3,000.00 deposit from the 1 fr t city and payments to extend over a period of years in accordance with a tentative offer which had been made by the Mills Land and Water Company." The motion was lost for want of a second. Committee Mayor McCallen appointed Councilmen Talbert, Chamness, and Morehouse appointed i 5';a_-co►nmittee to investigate the above named and submit a report to- gether with their recommendation at the next meeting of the City Council. Registration On motion by Talbert, seconded by Chamness, the City Attorney of bicycles was authorized to prepare an Ordinance providing for the registration of bicycles, the cost of registration to be 25¢ per bicycle. Storm drain - On motion by Chariness, seconded by Talbert, the City Engineer was 13th Street authorized to prepare detailed plans and specifications for the installation of a storm drain on Thirteenth Street between Orange and Main Streets and EIto prepare the necessary application to the W.P.A. for their assistance.
