The regular meeting of the City Council was called to order a.t 7:30
P.M. by. Mayor McCallen.
Councilmen present: Morehouse, Chamness, Henrickson, McCallen.
Councilmen absent: Talbert (Councilman Talbert arrived at 7:55 P.M.)

Minutes
•
On motion by Henrickson seconded by Chamness, minutes for the month
of August were approved as read.
Public Address Mayor McCallen stated that he had contacted the Otto K. Oleson

Illuminating Company relative to their bill of $60.33 covering certain
changes in the public address system at the beach pavilion and that the
company asked that the bill be held over pending further investigation
by them.
Application
On motion by Henrickson seconded by Morehouse, the license applica-

Application
On motion by Henrickson seconded by Chamness, the license applica-

tion of F. H. Berdelman to .operate cafe at 120 Main Street was approved.
Monthly
On motion by Chamness seconded by Henrickson, monthly reports of the

city treasurer, city clerk, building inspector, city engineer, city judge,
chief of police and city collector were accepted and ordered filed.
Damage to
The Clerk read a letter and statement from City Engineer Overmyer

covering damage to the municipal pier July loth to the.il2.th 1.939, and re-.!-
commending that the city file claim with the Home Insurance' Company
,.of -:,New Ybrk in the sum of $1,224.14 and, on motion by Henrickson seconded
by Chamness, the report was accepted and the engineer was authorized to
execute and file claim as per his recommendation.

At this time, 7:55 P.M., Councilman Talbert arrived.

The Clerk read a letter from City, Engineer Overmyer relative to agree -

ment with the State providing for the expenditure of 1/4 cent gas tax monies
on streets of major importance within the City of Huntington Beach as budgeted

in accordance with project statement previously submitted. The Clerk pre-

sented and read Project Agreement - 1940 Fiscal Year between the City.of
Huntington Beach and the Department of Public Works of the State of California,

No.850
also Resolution No. 950 authorizing the Mayor and City Clerk to sign the

above named agreement on behalf of the City and, on motion by Chamness
seconded by Henrickson, Resolution No. 850 was passed and adopted by the
following vote:
AYES: Councilmen: Morehouse,Chamness,Henrickson, Talbert, McCallen.
NOES: Councilmen: None.
ABSENT: Councilmen: None.
Mayor McCallen asked if there was anyone in the audience who wished
to address the City Council.

Union musicians Councilman Talbert addressed the City Council relative to
for all dances
the employment of musicians for the beach pavilion and stated
that he had received a number of protests against the change '
of orchestras for the Friday night dances. Mr. Foster, sec-
retary of the Orange County Union of Musicians, addressed the
Council and stated that he had received instructions from
National Headquarters to discontinue allowing a union band at
the Huntington Beach pavilion on Saturday nights or any other
time so long as the city employed a non -union band. Approximate-
ly seven people in the audience addressed the Council in favor
of retaining the present non -union band for furnishing music on
Friday nights. Councilman Talbert also spoke in favor of this
arrangement. Councilman Henrickson made the following motion:
"That the City employ union bands exclusively for the beach
pavilion." Councilman Talbert moved a substitution to the
above motion that the City continue both union and non -union
bands. The motion lost for want of a second.
Councilman Morehouse moved that the dances be closed for one
week and that the Council endeavor to work out the situation. This
motion was lost for want of a second.
Whereupon the Chair put the above named motion by Councilman
Henrickson and same was carried by the following vote:
AYES: Councilmen: Morehouse,Chamness,Henrickson,MeCallen.
NOES: Councilmen: Talbert.

Old Timers'
dances - Councilman Talbert asked that someone be appointed in his
sponsor
place as sponsor of the Old Timers' dances. No action was -taken ?:
by the Council.
Orchestra
Councilman Talbert stated that he would notify the orchestra
which had been playing for the Old Timers,'.. dances and inform them
that their services would no longer be needed.

On motion by Morehouse seconded by Talbert, the Chamber of
Commerce was granted a free permit to operate a merry-go-round
until Tuesday, September 12, 1939.
Mr. Gries
Mr. H. A. Gries, P.O.Box 573, Hollywood, California, address-
ed. the Council and stated that he had tendered check in full
payment of all taxes and penalties assessed against Lots 10 and
12, Block 419 and Lots 26 and 28,Block 618, and that the check had
been returned to him with a letter to the effect that the City
could not accept the check for the reason that the lots had been
deeded to the City and were subject to sale in the near future.
Mr. Gries asked that his check be accepted. He was informed by the
City Attorney that proceedings for sale had reached the stage where
it would be impossible for the City to handle the matter in the
manner requested by him. No further action ms taken by the Council.

Application On motion by C'hamness seconded by Talbert, the application of

Lula B. Clapp to operate restaurant at 104 Main Street was approved.
J_ C:.Clark - On motion by Henrickson seconded by Morehouse, the Council
Convention
allocated the sum of $50.00 for expense of J. C. Clark to attend the
California League of Municipalities, Sewage Works division, September
18th and 19th, 1939.
Planning The Clerk read a letter from the Huntington Beach Planning Com-
Commission
mission asking the City Council to appropriate a sum not to exceed
$400.00 or the sum of $50.00 per month for a period n6t exceeding
eight months for the employment of G. M. Parks, planning engineer, to
assist the local planning commission in its work and, on motion by
Chamness seconded by Morehouse, the Council allocated the sum of $50.00

per month for a period not exceeding eight months for the purpose of
employing an expert to assist the local planning commission.
Tax bate
This being the time for the City Council to set the tax rate for

the fiscal year 1939-1940, the Clerk presented and read Resolution No.

851, a resolution of the City Council of the City of Huntington Beach,
California, fixing the tax rate for said City of Huntington Beach, for
the fiscal year 1939-1940 and, on motion by Morehouse seconded by
Resolution
Talbert, Resolution No. 851 was passed and adopted by the following Vote;

School
City Attorney Overacker made his report on the feasibility of
election
holding a school election jointly with the State election November 7th.
Mr. Overacker stated that he believed it would be better for the City
to call a special election. Whereupon the City Council authorized the
City Attorney to prepare an ordinance calling a special election, same
to be submitted to the City Council at its meeting September 25, 1939.
Demands On motion by Chamness seconded.by Talbert, demands approved by the
Finance Committee were ordered paid.
• Vacation - On motion by Talbert seconded by Henrickson, City Clerk C. R. Furr
C. R. Furr
was granted a two weeks vacation beginning on or about September llth.
Leave of On motion by Henrickson seconded by Chamness, Councilman Talbert
absence -

Talbert was granted leave of absence for a period of sixty days beginning
September 7th. Councilman Talbert stated that he expected to be out of
the State part of that time.
Fire Chief On motion by Henrickson seconded by Talbert, the Council allocated
r to Convention
the sum of Y$75.00 to cover expense of Fire Chief Sargent attending the
State and National Fire Chieft' convention to be held in San Francisco
the week beginning September 18, 1939.

M ills Land & Councilman Talbert stated that he and Attorney Overacker
Water Co.
had called upon Mr. Moore of the Mills Land and Water Company
but that no definite conclusion had been reached and recommend-
ing that the matter be taken up by the City Council at a later
date.
On motion by dhamness seconded by Talbert, Council adjourned
until 7:30 P.M., Monday, September 25th; 1 939-
