Monday, Oct. 3, 1939 The regular meeting of the City Council was.called to order at 7:30 P.M. by Mayor McCallen. Councilmen present: Morehouse, Chamness, Talbert, Henrickson, McCallen. Councilmen absent: None. Minutes On motion by Henrickson seconded by Talbert, minutes for the month of September were approved as read. Canvass of This being the date set for canvassing the ballots of the Special ballots Special Municipal Election held in the City of Huntington Beach, California, on water bond election Wednesday the 27th day of September, 1939, the City Council opened and canvassed absentee ballots as follows: Total number of ballots e fourteen (14Y. Number of voters voting for. Proposition #1 were five (5). Number of voters voting against Proposition #1 were nine (9). Resolution The City Council proceeded to canvass the returns of the Special #851'A° Municipal Election above named after which the Clerk presented and read -Resolution No. 951 a resolution of the City Council of the City of Hunt- ington Beach, Calif,irnia, canvassing the returns of the special municipal election held in said City on Wednesday the 27th day of September, 1939. Said resolution reads in part as follows: "WHEREAS, the City Council of the City of Huntington Beach, Calif- ornia, did at a regular meeting of said City Council held on the 7th day of August, 1939, adopt Ordinance No. 429, ordering, calling and providing for the holding of a special election on September 27, 1939, for the purpose of voting upon the authorization of bonds for the purposes here- inafter stated, and WHEREAS, due notice of the• holding of said speci`A1 election has heretofore been given at the time and in,the manner provided by law, and WHEREAS, this is the time and place provided for the canvassing of the returns of said special election, NOW THEREFORE, the City Council of the City of Huntington Beach, California, do resolve, d@termine and declare as follows: Section ;: (1) That the whole'number of votes cast in the City of Huntington Beach at said special election, including all absentee votes, -is975. (2) That the proposition, designated as !'Proposition 1", voted upon at said special election was the following: "SHALL THE CITY OF HUNTINGTON BEACH, CALIF®RNIA, INCUR A BONDED DEBT OF .$265,000.00, SUCH• DEBT TO BEAR INTEREST AT -THE RATE OF NOT TO EXCEED FIVE PERCENT PER ANNUM, PAYABLE SEMIANNUALLY, FOR THE PURPOSE OF THE ACQUISITION, CONSTRUCTION AND COM- PLETION BY THE CITY OF HUNTINGTON BEACH, CALIFORNIA, OF THE FOLLOWING MUNICIPAL IMPROVEMENT; TO -WIT: THE ACQUISITION, CONSTRUCTION AND COMPLETION OF MUNICIPAL WATERWORKS FOR THE PURPOSE OF SUPPLYING WATER TO SAID CITY, INCLUDING THE ACQUISITION OF WATER, WATER RIGHTS, RIGHTS OF WAY, AND THE AC2 QUISITION OR CONSTRUCTION AND COMPLETION OF RES_ ERVOIR, PUMPING PLANTS, WATER MAINS, LINES, EQUIP- MENT, APPARATUS, AND APPURTENANCES AS MAY BE NECESSARY OR CONVENIENT IN CONNECTION THEREWITH?" 3 M"z Page 2 - Minutes Oct-3, 1939• (3) That the number of votes given at each consolidated voting precinct for and against said Proposition 1 was as follows: Proposition No.l Proposition No.1 Yes No Consolidated Voting Precinct A. 89 112 Consolidated Voting Precinct B. 90 94 Consolidated Voting Precinct C. 100 140 Consolidated Voting Precinct D. 131 115 Absentee Vote. 5 9 (4) The Total number of votes given in the City for and against said Proposition 1 hereinbefore recited including absentee votes, were as follows: PROPOSITION 1 Yes 405 PROPOSITION 1 No 470 Section 2: IT IS HEREBY FOUND AND DECLARED that said Proposition 10 hereinabove recited, to -wit: "SHALL THE CITY OF HUNTINGTON BEACH, CALIFORNIA, INCUR A BONDED DEBT OF $265,000.00, SUCH DEBT TO -BEAR INTEREST AT THE RATE OF NOT TO EXCEED FIVE PER CENT PER ANNUM, PAYABLE SEMIANNUALLY FOR THE PURPOSE OF THE ACQUISITION, CONSTRUCTION AND COMPLETION BY THE CITY OF HUNTINGTON BEACH, CALIFORNIA, OF THE FOLLOWING MUNICIPAL IMPROVES MENT TO -WIT: THE ACQUISITION, CONSTRUCTION AND COX- PLETION OF MUNICIPAL WATERWORKS FOR THE PURPOSE OF SUPPLYING WATER TO SAID CITY, INCLUDING THE ACQUISI- TION OF WATER, WATER RIGHTS, RIGHTS OF WAY, AND THE ACQUISITION OR CONSTRUCTION AND COMPLETION OF RESF.R_ VOIR, PUMPING PLANTS, WATER MAINS, .LINES, EQUIPMENT, APPARATUS, AND APPURTENANCES AS MAY BE NECESSARY OR CONVENIENT IN CONNECTION THEREWITH?", received the affirmative votes of less than two-thirds of the voters of said City voting at said election, and the same was defeated. Section 3: The City Clerk is hereby directed to enter on the records of the City Council a" statement of the result of said election as required by law. Section 4: That the City Clerk shall attest and certify to the passage and adoption of this Resolution by a majority of the votes of the members of the City Council of the City of Huntington Beach. PASSED AND ADOPTED by the City Council of the City of Hunting- ton Beach, California, by a vote of more than a majority of all its members, at a regular meeting of said City Council held on the 2nd day of October, 1939•" Resolution On motion by Morehouse seconded by Henrickson, Resolution No. No. �:.:.: n. A 851%was passed and adopted by the following vote: AYES: Councilmen: Morehouse, Chamness, Henrickson,Talbert, r McCallen. NOES: Councilmen: None. ABSENT:. Councilmen: None. W. J. Bristol W. J. Bristol of the Chamber of Commerce addressed the Council Seats on beach front And stated that the Chamber of Commerce had again gone on record favoring the installation of seats along -the beach front and suggest ing that the municipal pier be repaired with the length as it now •. .-stands and that the money collected from insurance be used in part Page 3 - Minutes Oct. 3, ly3y. 73 1 to retire pier bonds and the building of seats on the beach front. Mr. Bundy F. E. Bundy stated that he agreed with the recommendation of Lights on Ocean Ave. Mr, Bristol and he also suggested that the type of lights along Ocean Avenue be improved. No action was taken by the City Council. Mr. McKelvey The Clerk read a letter from G. F. McKelvey commending the Fire commends fire dept. Department for the efficient work they did in.extinguishing a fire at his home. The letter was ordered filed and the Clerk directed to write Mr. McKelvey thanking him for his remarks. U.P.A. o Engineer Overmyer stated in a letter addressed to the City sewer Council that he had contacted the W.P.A. officials and that it will be agreeable for the City to amend its application and include the ex - Life guard report for 1939 Monthly reports tension of a sanitary sewer on Joliet Street with the construction of a storm drain along lath Street and, on motion by Morehouse seconded by Chamness, the City Engineer was directed to amend the application in accordance with his letter. The Clerk read a letter from Delbert Higgins, chief life guard, covering activities of the life guard department during the 1939 season. The report was ordered filed. The Clerk read monthly reports of the City Treasurer, City Clerk, City Judge, City Collector, Chief of Police and Superintendent of Streets and, on motion by Chamness seconded by Talbert, same were accepted and ordered filed. Carpenter & The Clerk read a letter from City:Engineer•Overmyer recommending cement finisher that the city employ a combination carpenter and cement finisher at a salary of $145.00 per month and, on motion by Talbert seconded by Chamness, the City Engineer was authorized to advertise for a carpenter and cement finisher two times in the Huntington Beach News. Salary of The Clerk read a letter from Street Superintendent Overmyer re - Paul Wiman commending that the salary of Paul Wiman be placed at $135.00 per month beginning October 1st and, on motion by.Henrickson seconded by Talbert, the City Attorney was authorized to prepare a resolution in accordance with the letter, same to be effective on and after -the adoption of said resolution. Application - On motion by Henrickson seconded by Chamness, the application of 0°Brien & Applin J. D. O°Brien and Lee P. Applin to operate gas station at 120 Ocean Avenue was approved. ` Sigq The application of W. E. Spikes to erect 260 x 60 210 board sign at 3031 Main Street was referred back to the city engineer for the reason that same does not comply -with city ordinances. The city engineer to investigate and report.back to the City Council at its next meeting. Drinking The Clerk read a petition signed by a number of residents asking fountain in Memo Fall that a drinking fountain to installed in Memorial Ball and, on motion Page 4 - Minutes Oct. 3, 1939• by Chamness seconded by Talbert, the engineer was directed to ' install a drinking fountain in Memorial Hall, Light in The Clerk read a alley petition signed by a number of residents asking that a light be placed in the alley in Block 905 and, on motion by Talbert seconded by Chamness, the request was granted and the engineer directed to install the light. Armistice Day The Clerk read a letter from Orange County Armistice Day program Celebration committees general chairman requesting exclusive �- rights for parade on November llth and exclusive rights for all concessions from November 9th to 13th inclusive and, on motion by Henrickson seconded by Talbert, the request was granted. Insurance policy The Clerk read a letter signed by the City Clerk addressed on pier cancelled to the Council to the effect that insurance policy covering the municipal pier in the amount of $100,000.00 had been cancelled effective fifteen days after September 25th, 1939 and, on motion by Talbert seconded by Chamness, the Council voted to go on record as not accepting the ogncellation of the insurance from the insurance company until settlement has been made. Ord. #430 At this time the Clerk gave Ordinance No. 430 relating Passed to elections its second and final reading and, on motion by • Henrickson seconded by Morehouse, Ordinance No. 430 was passed and adopted by the following vote: AYES: Councilmen: Morehouse, Chamness, Talbert, Henrickson, McCallen. NOES: Councilmen: None. , ABSENT: Councilmen: None. Auditing city On motion by Henrickson seconded by Chamness, the Clerk was accounts • authorized to advertise for bids for auditing the city accounts and providing that the work be done by certified public accountants; a bids to be opened and examined Monday, October 16, 1939- Light contract The matter of advertising for bids for furnishing the city deferred viith electric light bulbs was deferred until December 1939. Old Timers°'dance Councilman Chamness advised the Council that it was the desire to Wed. night .be of the Beach and Pier Committee - to change the Old Timers° dance to Wednesday night instead of Friday night,. ,The matter was left in charge of the Beach and Pier Committee. Rental contract On -motion by Henrickson seconded by Chamness, the City Attorney fora I was authorized to prepare a rental contract form to be used in renting the dance pavilion. Dance pavilion The matter of reserving the dance pavilion for the Long Beach Junior College October 27th was referred to the Beach and Pier Com© mittee and the City Engineer with instructions to notify the Junior •+` College. Pavilion avail— On motion by Talbert seconded by Chamness, the City Engineer was able to schools & colleges ""directed to notify schools and colleges"in Southern California to the Page 5 - Minutes. uct . 3, 1939- ; t= effect that'the dance pavilion will be available for their use on all nights except Wednesday and Saturday of each week provided reservations are made in advance and accepted by the City Council, rent to be 025.00 per night. City treas. Mayor McCallen informed the Council that if action was to be office taken leading to the consolidation of the office of dity treasurer and assistant city treasurer such action should be taken in the near -10 future and, on motion by Talbert seconded by Henrickson, the City Attorney was authorized to prepare an ordinance naming the salary'of the city treasurer at $175.00 per month and requiring that said city treasurer be qualified to do all the work required in the city treas- urer's office of the City of Huntington Beach'. Demands On motion by Talbert seconded by Chamness, demands approved by •r�. the Finance Committee were ordered paid. Re'soluti,on The Clerk read Resolution No..852 calling a special municipal #852 election for Tuesday, November 21, 1939:and, on motion by Talbert seconded by Chamness, Resolution No. 852 was passed and adopted by the following vote: AXES: Councilmen: Morehouse, Chamness, Talbert,Henrickson, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. Chief of On motion by Henrickson seconded by 04amness, the Council voted to Police to conventions allow the Chief of Police the sum of $75.00 to defray expenses in attend- ing the Chief of Police convention to be held at Santa Cruz October 9th to 12th and San Francisco October l$th to 21st.
