MINUTES
Council Chamber, City Hall,
Huntington Beach, Calif.
Thursday, November 16, 1939
Pursuant to adjournment of November 13, 1939, the City Council met
and was called to order at 2:30 P.M. by Mayor McCallen.
Councilmen present: Morehouse, Chamness, Talbert, Henrickson, McCallen.
Ap Councilmen absent: None.
Adv. in Press- The Clerk read a letter from the Press -Telegram soliciting one-half
Telegram's New
Years edition page advertising in the Telegram's New Year edition in the amount of $260.00
and, on motion by Chamness seconded by Talbert, the Council appropriated the
sum of $260.00 and placed the matter of preparing the advertisement in the
hands of the Beach and Pier Committee and the City Clerk.

of Drumm, Tucker and Drumm-, attorneys at law, as special counsel in the case
of Denio, et. al. -vs- City of Huntington Beach, being No. 37457 now pending
In the Superior Court of the State bf California, in and for the County of
Orange, upon the terms and' conditions set forth in the letter -to the City
Council, dated November 16, 1939, to -wit:
A retainer of $250.00 cash; said attorneys shall submit bills of the
preparation of. said case for trial from time to time, said bills to re-
ceive the approval .of the Mayor and City -Attorney prior to the submission
thereof.to the City Council, it being understood that said bills for pre-
paration of said case for trial shall not exceed the sum of $750.00, and
that for the services of said F.. C. Drumm: of said firm in the trial of
said case -said attorneys shall be paid the -fee of $75.00 per day, and
that any services to be performed after the trial of said case shall be
left to future agreement.
That in the event said case above mentioned is settled or compro-
mised prior to the trial, said firm of attorneys shall be paid for such
services as they render in preparation for trial up to the date of -
settlement and such further services as may be agreed upon in.helping
to affect the compromise or settlement." Motion put and carried unanimously.
Claim for repair The Clerk presented and read a detailed report of depreciation -on
of Mun. , pier
the Huntington Beach municipal pier, also copy of proposed claim to be
made to the Hime Insurance Company of. New York covering damage and de-
struction of a portion of the pier September 24, 1939; both of which
instruments were prepared by City Engineer Overmyer. Whereupon the
following motionNas made by Councilman Henrickson seconded by Council-
man Talbert., -d!.That the above named claim be forwarded by registered
mail to the Home Insurance Company of New York at their San Francisco
office; that the Mayor and City Clerk be authorized to execute the claim
» on behalf_ of the City, of Huntington. Beach in the total amount of
$49,328.00 excluslVe of, cost of removal of debris.11 Motion put and
carried unanimously.

the rooms of the Board of Supervisors, Santa Ana, 10:00 A.M. Thursday,
November 16th. Mayor.McCallen reported on the above named meeting.

Resolution
regarding out- On motion by Councilman Chamness seconded by Councilman
fall sewer line
Talbert, the City Attorney was authorized to draft and present a
resolution to be passed upon by the City Council and forwarded to
the District Attorney requesting that he file suit immediately to
cause the abatement of the nuisance caused by the Orange County •
out -fall sewer line. Motion put and carried unanimously.
On motion by Chamness seconded by Henrickson, the City
Attorney was authorized to contact Assemblymen Clyde Watson and
Thomas Kuchel and urge that they have drafted an Act prohibiting
all cities and counties from dumping sewage into the Pacific
Ocean; that they respectfully request the Governor to include
this matter in his call for a special meeting of the Legislature.
Motion'put and carried by the following vote:
AYES: Councilmen Morehouse, Chamness, Henrickson, Talbe..rt, McCallen. •
NOES: Councilmen: None.
ABSENT: Councilmen: None.
Bids for Ins.
on new fire The Clerk opened and read the following bids for insuring the new
station
fire station against fire and other hazards: r"
J. K. McDonald representing Norwich Union Fire Insurance
Society, Ltd., three years, rate $1.80; 5 years $2.70.
Ila N. Dabney representing Aetna Insurance Company,
three years, rate $1.71; five years $2.562.
Chris H. King representing the Mercantile Insurance
' 'Company, three years, rate $1.56; five years $2..37.
Huston, Suter & Huston representing Firemen's Insurance
Company, three years, rate $1.18; five years $1.77.
All of —the above named policies to be 100% stipulated amount average
clause eight point. 'Bids were ordered received and filed.
City Bldgs. On motion by Talbert seconded by Chamness, the City Engineer
was directed to prepare a list of all city buildings, to be desig-
nated either by street location or by other methods so as to determine
the location of the building, also to prepare an estimated present
value of the buildings together with a brief description of construct-
ion of same.
Demands On motion by Talbert seconded by Chamness, demands approved
by the Finance Committee were ordered paid.
Old Timers' Councilman Talbert stated that there did not seem to be much
dances to
Friday demand by the schools for the dance pavilion and stated that it might-.-.

be best to again allow the Old Timers to use Friday nights. Mayor
McCallen and other Councilmen stated that it was entirely agreeable
with them that the matter be left in the hands of the Beach and
Pier Committee.

On motion by Henrickson seconded by Chamness, the Council
adjourned until 2:30 P. M. Wednesday, November 22, 1939.

There being no quorum present, the Clerk adjourned the meeting
until 7:30 P.M. Monday, November 27, 1939.
